1、民事庭审语篇中的目标实现评价理论视角 民事庭审语篇中的目标实现评价理论视角 Goal Realization via Appraisal in Civil Courtroom Trial Discourse【中文摘要】 本论文旨在根据J.R.Martin和P.R.R.White的评价理论来研究民事法庭审判语篇中使用的最主要的评价资源以及这些主要的评价资源在民事法庭审判中是怎样运用的。之后,该论文根据Jef Verschueren的顺应理论来研究为什么民事法庭审判中的各方要在法庭审判中使用这些主要的评价资源。该论文的研究目标就是要找出庭审中的各参与方使用评价资源的潜在规律。首先,本论文以从中法网
2、上选取的十个民事庭审语篇为语料并且通过使用描述法和说明的方法来描述在民事法庭语篇中使用的评价资源,即民事法庭审判语篇中都使用了态度资源、介入资源和级差资源。随后该论文从统计中得出结论:介入资源是民事法庭语篇中最经常使用的资源。众所周知,法庭审判重视证据。与此同时,法官和人民陪审员也高度关注证据。在民事法庭审判中,原被告双方为了实现各自的目的以及维护自己的权利和利益,原被告中的一方总是竭尽全力的证明对方的证据是虚假的、无关的以及是非法的,以此来说服法官和人民陪审员。由此可见,证据的可信度在民事法庭审判中是十分重要的,因此,本文的第二个研究问题就是法庭审判的各方是如何通过主要评价资源的应用来更好的
3、说明己方证据的可信度以及对方证据的不可信的,即庭审中的各方是怎样通过使用主要的评价资源来达到证明(驳倒)己方(对方)证据的可信度的。对于第三个研究问题,该论文使用Jef Verschuerens的顺应理论,特别是三个世界(物理世界、心理世界以及社交世界)的理论来解释为什么要使用这些主要的评价资源。该论文的意义在于通过对十个民事法庭审判语篇的研究来给从语言学的角度研究法庭审判提供一定的思考,扩大评价理论应用的范围以及给法律界的学者们一些启发。【英文摘要】 The present study is undertaken to investigate what is the main apprais
4、al resources used in the civil courtroom trial and how these main appraisal resources are used on the basis of J.R. Martin and P.R.R. Whites Appraisal Theory and then why these main appraisal resources are employed on the basis of Jef Verschuerens Adaptation Theory. The research object of this thesi
5、s is to find out the patterns how courtroom participants use appraisal resources in civil courtroom trial discourse.Based on ten civil courtroom trial discourses selected from China court web and with the descriptive and expository methods, this thesis first describes all the appraisal resources use
6、d in the civil courtroom trial discourse, that is, attitude, engagement and graduation, and then draws conclusion from statistics that the engagement resources are most frequently used.As everybody knows, a court always attaches greatest importance to evidence, which is also the greatest concern of
7、the judge and peoples assessors of a civil courtroom trial, so in order to achieve their respective purposes, one party(the plaintiff or the defendant) always endeavors to prove that the other partys evidence is fake, irrelevant or illegal so as to convince the judge and the peoples assessors. In th
8、is way, the credibility of evidence is very important, so the second research question is how the credibility of evidence is achieved by using these main appraisal resources, that is, how the authenticity, relevance and legality of evidence are better proved through the employment of these main appr
9、aisal resources.With regard to the third research question, Jef Verschuerens Adaptation Theory, especially the three worlds, that is, physical world, mental world and social world, is used to explain why these main appraisal resources are used to better achieve the goals of courtroom participants.It
10、 is hoped that this thesis, according to the analysis of ten civil courtroom trial discourses, is going to shed some light on the study of courtroom trials from the perspective of linguistics, enrich the scope of application of appraisal theory and enlighten some scholars in the legal field. 【中文关键词】
