1、国际贸易中的出口信用保险法律问题探析 国际贸易中的出口信用保险法律问题探析 The Legal Issues of Export Credit Insurance in International Trade 【摘要】 出口信用保险是在商品出口或相关经济中发生的,保险人(经营出口信用保险业务的保险公司)与被保险人(国内的出口商或银行)签定的一种保险协议。根据该保险协议,被保险人向保险人交纳保险费,保险人赔偿保险协议项下被保险人向国外买方赊销商品或贷放货币后因买方信用及相关因素引起的经济损失。出口信用保险作为一种成熟的保险险种,在国外已经发展了上百年的时间,成为通行的贸易促进工具。在我国,出口信
2、用保险的发展始于上世纪80年代,自2001年中国出口信用保险公司成立后得到快速发展。20多年以来,出口信用保险在扩大企业出口规模、为企业提供融资便利、规避出口收汇风险、增加安全收汇保障方面发挥了重要作用。出口信用保险作为保险的一种,应当符合保险法基本原则。保险法的最大诚信原则、保险利益原则、损失补偿原则、近因原则都应当适用于出口信用保险。另一方面,出口信用保险不同于一般商业保险的特征在于它的政策性,因此,在保险合同的法律关系主体、客体、双方权利义务、违约责任和除外责任等方面存在特殊之处。我国出口信用保险虽然发展迅速,但与西方保险业发达的国家相比还存在较大的差距,我国日益扩大的出口需求与保险供给
3、能力相对不足的矛盾正日益扩大。当前,我国企业未收帐款高达出口额的10%,而出口信用保险却远远没有跟上对外贸易的发展步伐。究其原因,出口信用保险缺乏法律法规保障是重要原因之一。出口信用保险作为为数不多的WTO允许的政策性金融工具之一,能够为中小企业提供直接的融资便利,并且为银行和保险业的合作开拓了崭新的道路,理应得到大力发展。本文针对我国出口信用保险发展过程中出现的法律问题,沿着保险法的基本思路,对出口信用保险应适用的保险法的一般原则、特有原则、出口信用保险合同的法律关系主体、客体、双方权利义务等内容进行了逐一的详细分析,纯粹从法律的视角理清了出口信用保险的基本理论;对近百年来西方发达国家出口信
4、用保险的发展模式和立法情况进行了比较研究,以期能够洋为中用。在此基础上,从公法和私法,即保险业监管法和保险合同法两个方面提出了构建我国出口信用保险法律制度的建议和意见。我国应完善政府对出口信用保险的监督管理,加大政府对出口信用保险的财政支持力度,并根据我国目前的实际情况,着手成立以财政部、商务部、外交部、中国人民银行、保监会、出口信用保险公司等与出口贸易相关的部门或单位组成的部际协调委员会,以便制定有关出口信用保险的方针和政策、决定重大保险项目以及规划出口信用保险的发展方向。建议由最高人民法院通过颁布司法解释的办法明确出口信用保险合同的法律适用问题。最终,在各方面时机成熟的条件下,提升出口信用
5、保险的立法层次,争取人大常委会的单独立法。【Abstract】 Export credit insurance is an agreement which signed by Insurers and the insured in good and service export. Under this agreement, the insured pay the insurance premiums, and the insurance compensate the economic loss which caused by buyers credit and related factors.

7、rance began in the 1980s,getting a rapid development since sinosure, who play an important role in Expanding the scale of export enterprises, providing financing facilities for export exchange earnings to avoid risks, and enhancing the safety and securityAs a kind of insurance, it should comply with

On the other hand, export credit insurance is different from the characteristics of general commercial insurance policy. Therefore, there are special points in subject, object, the rights and obligations of
9、 both sides, except for breach of contract responsibility and liability exists unique.Although Chinas export credit insurance has developed rapidly, there are still long way from Western developed countries. At present, Chinas enterprises uncollected accounts up to 10 per cent of exports, and export
10、 credit insurance has far have not kept pace with the pace of the development of foreign trade. The lack of law is one important reason. As a WTO allows financial policy tool, it can provide direct financing facilities, and develop a brand-new path for the banking and insurance industry. So it shoul
11、d vigorously develop.This paper pay attention to the legal problems in export credit insurance, make a detailed analysis of the general principles of the unique principles of export credit insurance contracts legal relations subject, object, the rights and obligations of both parties. Make comparing
12、 research of the western developed counties. On this basis, point out the recommendations and observations of building Chinas export credit insurance system from the public and private law. That is, improving the governments export credit insurance on the supervision and management of the Government
13、, increasing the support of export credit insurance. And in accordance with the actual situation in China, to set up a Ministry of Finance, Ministry of Commerce, Ministry of Foreign Affairs, Peoples Bank of China, the China Insurance Regulatory Commission, export credit insurance and export trade, a
14、nd other relevant units of the inter-ministerial coordination committee, making decisions on major projects as well as insurance of export credit insurance planning direction. Supreme Peoples Court should make judicial interpretation of the export credit insurance to clear the legal application of t
