1、国际合作与交流项目合作研究协议书撰写说明及范本国际合作研究项目 申请书撰写提纲 国际合作研究项目采用网上填写申请书方式。申请书由基本信息表、报告正文和相关附件材料三部分构成。 一、信息表格 请在指定的位置选择或按要求输入正确信息，信息填写必须保证准确清楚。 请申请人注意：您的申请书“基本信息表”一页的内容在获得资助后将以在基金委的网站等适当形式向社会公开，凡涉及保密和知识产权问题的内容不得写入，项目依托单位须认真核查。必须写入摘要中的保密内容应特殊声明，并说明理由。其声明和说明以书面形式作为附件随同纸质申请书一并申报，内容保密的摘要未提交声明而被公开的责任自负。 二、申请书报告正文 (一) 立
2、项依据 1. 项目的研究意义及科学依据 2. 国内外研究现状分析 3. 合作双方的互补性 4. 主要参考文献及出处 (二) 合作研究内容及合作研究方案 1. 研究目标、内容及拟解决的关键问题； 2. 拟采取的研究方案、技术路线及可行性分析； 3. 合作方式：课题设置、研究重点及双方分工。 (三) 合作基础 1. 双方优势、特色所在，与本项目有关的研究工作积累和已取得的研究工作成绩； 2. 已具备的实验条件，尚缺少的实验条件和拟解决的途径。 (四) 合作方投入情况：匹配经费、仪器设备、关键技术等等。 三、相关附件材料 1、 英文申请书 2、 合作协议书：撰写说明及范本中的要求详见下页。 合作研究
3、协议书撰写说明及范本 基本内容： 1. 合作研究题目 2. 双方主持人和主要参加者 包括合作双方主持人和主要参加者的列表。 3. 合作研究计划、分工和进度 简述研究课题的内容，清楚阐明合作双方分别承担的研究工作和相应责任，必要时需提出时间表。 4. 经费来源和使用 简述双方合作研究的经费来源和如何使用，必要时外国合作方需提供相关证明或书面承诺 5. 知识产权归属、使用和转移 阐述合作研究成果的归属、使用或共享等有关约定； 6. 研究期限、变更和退出 写明合作研究的起止日期，如何处理项目结题前项目主持人和主要参加人的变更等。 7. 协议法律效力的约定 协议生效、有效期、中止等的有关约定 8. 双

State clearly which part is “Partner A”s work and which part is “Partner B”s. Include time frames in this part if necessary. 4. Sources of Funding and Its Use Describe sources
6、 of funding for the collaborative research and the mechanism to use it. Provide certificates or written commitment of the foreign collaborator if necessary. 5. Ownership, Use and Transfer of the Intellectual Property Clearly state who shall own the intellectual property and how to use or share it. 6

Duration, Amendament and Withdrawal Clearly state the specific dates that the collaborative research starts and ends and the process to deal with changes concerning principal investigators and main participants before the research terminates. 7. Ownership, Use and Transfer of the Intellectual Property Intellectual property rights of the project cover all results obtained within the project. The IPR of common results will be shared by all parties concerned. The IPR of results ob
14、tained independently by one party without any assistance from the other party or obtained before or after the collaboration will belong to the respective party. Authorship and acknowlegement in papers should be based on contribution to the project and decided in discussions involving all parties con
15、cerned. Before submitting any application for realted intellectual property rights, one party should first consult with the other party and may proceed only after the other party has agreed without objection on the ownership of the IPR. Without the written consent of both parties, none of the projec
16、ts common IPR may be transferred to any third-party. VI. Duration, Amendament and Withdrawal The project will terminate upon completion of all research activities, which is agreed on the date of *. A research partner who decides to withdraw from the project before the above-mentioned date shoold not
17、ice other members of the collaborative research at least three months before the change happens. Any amendament to this agreement should be agreed by both parties. VII.
