3、院国家水稻863课题组邹江石研究员等专家培育的“两优培九”是我国唯一公认的超级杂交稻组合，目前年度种植面积超过7000万亩，是全国种植面积最大的一个水稻品种。该品种亩产一般超过700公斤，高产田块达800公斤以上。它还具有纯度高、品性优质、抗性强等特点。该品种获得了发明专利（专利号是ZL98111352.4）、植物新品种权（品种权号是CNA20000064.0）等知识产权保护。该品种的知识产权独占许可人是南京两优培九种业有限公司。该公司每年度向下游经销商签发大约九张分许可证书，通过后者向全国种子公司和农户等销售“两优培九”种子。,ZL98111352.4号专利与相应的植物品种权具有可靠的市场控
4、制力，能够对侵权、仿冒行为进行有效的封杀。例如，ZL98111352.4号专利保护一种杂交稻的培育方法，包括播种父母本，在母本植株抽穗期喷施赤霉素。此外，它还有六项权利要求，保护安全隔离、适期播种、合理密植、适宜行比、调节花期、人工辅助授粉、防治粒黑粉病、去杂去劣等配套措施。例如，权利要求二保护的措施是安全隔离距离大于500米，或与所述父母本的抽穗扬花期相隔15天以上进行制种隔离。南京两优培九种业有限公司在维护知识产权方面耗费了大量心血，打赢了上百起官司，有效维护了农民的利益。例如，2002年，江西法院判决直接销售假冒种子的萍乡市安源区种子公司预先赔偿农民60万元损失，最终侵权责任由提供假冒种
