1、工程合同中的安全施工与环境保护条款中英文对照版工程合同中的安全施工与环境保护条款（中英文对照）SAFETYATWORK,ORDERLYCONDUCTANDENVIRONMENTALPROTECTION合同履行期间，合同当事人均应当遵守国家和工程所在地有关安全生产的要求，合同当事人有特别要求的，应在专用合同条款中明确施工项目安全生产标准化达标目标及相应事项。承包人有权拒绝发包人及监理人强令承包人违章作业、冒险施工的任何指示。Thecontractpartiesshould,duringtheexecutionofcontract,abidebytheStateandlocalauthoritys
2、requirementsofsafeworks,if,anyparticularrequirementbytheparty,theobjectandthecorrespondingissueswhichreachedbytheconstructionprojectsafetyproductionstandardizationshouldbespecifiedinparticularcondition.Thecontractorisentitledtorefuseanydirectionfromtheemployerandthesupervisorofworksagainstregulation
3、sandadventureconstruction.在施工过程中，如遇到突发的地质变动、事先未知的地下施工障碍等影响施工安全的紧急情况，承包人应及时报告监理人和发包人，发包人应当及时下令停工用艮政府有关行政管理部门采取应急措施。因安全生产需要暂停施工的，按照第7.8款暂停施工的约定执行。Duringtheconstructionprocessincaseofanyemergencymattersuchasgeologicchangeandunexpectedundergroundconstructionobstaclesandothers,thecontractorshouldreportth
4、esupervisorandtheemployerwithoutunduedelayandtheemployershouldtimelygiveordertostopworkinadditiontoreporttherelatedadministrationtotakeemergencymeasuresthereon.Providedthatthesuspensionofworkduetosafeconstruction,theperformancethereofshallbemadepursuanttoparagraph7.8(SuspensionofWork).安全生产保证措施Assura
5、nceMeasuresofSafetyConstruction承包人应当按照有关规定编制安全技术措施或者专项施工方案，建立安全生产责任制度、治安保卫制度及安全生产教育培训制度，并按安全生产法律规定及合同约定履行安全职责，如实编制工程安全生产的有关记录，接受发包人、监理人及政府安全监督部门的检查与监督。Thecontractorshould,pursuanttotherelevantprovisions,preparethemeasuresofsafetytechnologyorparticularconstructionschedules,makeestablishmentofsystemso

7、visionofadministrationauthority.特别安全生产事项ParticularItemsofSafetyConstruction承包人应按照法律规定进行施工，开工前做好安全技术交底工作，施工过程中做好各项安全防护措施。承包人为实施合同而雇用的特殊工种的人员应受过专门的培训并已取得政府有关管理机构颁发的上岗证书。Thecontractorshouldpursuanttolaw,sregulations,maketheinstructionofsafetytechnologyandeverymeasuresofsafetyprotectionintheprocessofcon
8、struction.Thepersonnelworkingontheparticulartypeofwork,whichemployedbythecontractorfortheimplementationofcontractshallbeparticularlytrainedandobtainthepostcertificateissuedbytherelevantauthority.承包人在动力设备、输电线路、地下管道、密封防震车间、易燃易爆地段以及临街交通要道附近施工时，施工开始前应向发包人和监理人提出安全防护措施，经发包人认可后实施。Wheretheconstructionsareef
9、fectedbythecontractorintheworkshopsofpowerequipment,transmissionlines,undergroundpipelinesandtheareaswhichneartrafficstreet,thecontractorshouldpriortoconstruction,submittotheemployerandthesupervisorwithhissafetyprotectionmeasuresandgettheemployer*sapprovalbeforeexecutionthereof.实施爆破作业，在放射、毒害性环境中施工(含
10、储存、运输、使用)及使用毒害性、腐蚀性物品施工时，承包人应在施工前7天以书面通知发包人和监理人，并报送相应的安全防护措施，经发包人认可后实施。Wheretheblastingoperationorworksintheenvironmentwithradiationandtoxic(includingstorage,transportationanduse)and/orconstructioninwhichusingthetoxicandcorrosivematerialsareeffected,thecontractorshouldgivetheemployerandthesupervisor
11、with7daysnoticebeforeworksexecutionwithsubmissionofhissafetyprotectionmeasures,andgettheemployer*Sapprovalbeforeexecutionthereof.需单独编制危险性较大分部分项专项工程施工方案的，及要求进行专家论证的超过一定规模的危险性较大的分部分项工程，承包人应及时编制和组织论证。Needtoworkoutseparatelytheconstructionplanofgreaterriskdivision,sub-projectandspecialprojectAdivisionpr
12、ojectrequiringexpertverificationthatexceedsacertainscaleandismoredangerous.Ifalargesegmentofparticularprojectconstructionprogramneedtobeseparatelypreparedorexpertsargumentfortheprogramisrequired,thecontractorshouldmakethepreparationandorgantheargumentintime.Safetyprocedures安全不UTheContractorshall:承包商
13、应：(a)complywithallapplicablesafetyregulations,遵守所有适用的安全规则，(b)takecareforthesafetyofallpersonsentitledtobeontheSite,照料有权在现场的所有人员的安全，(c)usereasonableeffortstokeeptheSiteandWorksclearofunnecessaryobstructionsoastoavoiddangertothesepersons,尽合理的努力保持现场和工程设有不需要的障碍物,以避免对这些人员造成危险，takeactionssimilartothosewhi
14、chtheContractorisrequiredtotakeundersub-paragraphs(a),(b)and(c)ofSub-Clause4.8SafetyProceduresandunderSub-Clause4.18protectionoftheEnvironment.采取与根据第4.8款安全程序(a)(b)(c)项和第4.18款环境保护要求承包商采取的类似行动。TheContractorshallatalltimesduringtheContractPeriodtakeallreasonableprecautionstomaintainthehealthandsafetyof
15、theContractor,sPersonnel.Incollaborationwithlocalhealthauthorities,theContractorshallensurethatmedicalstaff,firstaidfacilities,sickbayandambulanceserviceareavailableatalltimesattheSiteandatanyaccommodationfortheContractorDsandEmpIoyerDsPersonnel,andthatsuitablearrangementsaremadeforallnecessarywelfa
16、reandhygienerequirementsandthepreventionofepidemics.承包商应自始至终采取合理的预防措施以维护其人员的健康和安全。承包商应与当地卫生部门合作，自始至终在现场以及承包商人员和业主人员住地确保配备医务人员、急救设施、病房以及救护服务，并应做出适当安排提供所有必要的福利和卫生条件，并防止疾病的传染。TheContractorshallappointanaccidentpreventionofficerattheSite,responsibleformaintainingsafetyandprotectionagainstaccidents.Thisp
17、ersonshallbequalifiedfortheirresponsibility,andshallhavetheauthoritytoissueinstructionsandtakeprotectivemeasurestopreventaccidents.ThroughouttheexecutionandoperationoftheWorks,theContractorshallprovidewhateverisrequiredbythispersontoexercisetheirresponsibilityandauthority.承包商应在现场指派一名事故预防官员，负责维护安全并防止
18、事故发生。该人员应能胜任此责任，并有权发布指示及采取预防事故发生的保护措施。在工程的整个实施过程中，承包商应提供该人员为履行责任和实施权力所必需的一切。SafetyandprofessionaltrainingcoursesforContractorSpersonnel,includingallrequiredwellcontrolcertification.钻井承包商人员的安全职业培训I,包括所有要求的井控证。SafetyandprofessionaltrainingcoursesprovidedbyContractorforCompany,Spersonnel.由钻井承包商为公司人员提供的
19、安全职业培训。Allassociatedformalitiesandlogisticsrelatedtotraveldocuments,healthcertificates,visas,workpermits,etc.forContractor,SPersonnel.与钻井承包商人员旅行证件、健康证书、签证、工作许可证等有关的所有手续及后勤服务。安全/安保SAFETY/SECURITYH2SdetectionequipmentonContractor*SUnitincludingalarmsystemandsufficientchargedself-containedbreathingappa
20、ratusondrillfloorandinmudpit/processingareaforkeypersonnelonrigfloor,shakerarea,mudpitarea,andtestingequipmentarea.(AsperContractor*SSafetyManagementSystem硫化氢探测仪器，包括钻台、泥浆处理区装有报警系统，钻台、振动筛、泥浆池、设备测试区的关键人员有足够的呼吸器。（按照钻井承包商安全富里制度）乙方应遵守工程建设安全生产有关管理规定，严格按安全标准组织施工,并随时接受行业安全检查人员依法实施的监督检查，采取必要的安全防护措施，消除事故隐患。由于
21、乙方安全措施不力造成事故的责任和因此发生的费用，由乙方承担。PartyBshallobservethepertinentmanagementrulesinrelationwithsafeproductionofconstruction,strictlyorganizetheconstructionaccordingtothesafetystandards,acceptandfacilitatethelawfulinspectionandsupervisionbysafetyinspectors,takenecessarysafetyprotectionmeasuresandeliminatea
22、nypotentialsafetythreats.PartyBshallassumeanyconsequenceandexpensesresultingfromPartyB,sfailureinsafetymeasures,ifany.甲方应对其在施工场地的工作人员进行安全教育，并对他们的安全负责。甲方不得要求乙方违反安全管理的规定进行施工。因甲方原因导致的安全事故，由甲方承担相应责任及发生的费用。PartyAshalleducateitsstaffintheconstructionsiteonsafetyandberesponsiblefortheirsafety.PartyAshallno

24、anypowerequipment,transmissionline,undergroundpipeline,enclosedworkshop,inflammableandexplosivesegmentortrafficartery,PartyBshallrequesttoPartyA,Srepresentativeforsafetyprotectionmeasures,which,upontheapprovalbyPartyA,Srepresentative,shallbeimplementedatPartyA,Scost实施爆破作业，在放射、毒害性环境中施工（含储存、运输、使用）及使用毒
25、害性、腐蚀性物品施工时，乙方应在施工前14天以书面通知甲方代表，并提出相应的安全防护措施，经甲方代表认可后实施，由甲方承担安全防护措施费用。Incaseofanyblastingoperation,operation(storage,transportationoruse)inradioactive,toxicenvironment,orconstructionwithanytoxicorcausticsubstance,PartyBshallnotifyPartyA,Srepresentativeinwritingwitha14-daypriornoticeandrequestforcorr
26、espondingsafetyprotectionmeasures,which,upontheapprovalbyPartyA,Srepresentative,shallbeimplementedatPartyA,Scost.安全、保卫和环境保护Safety,SecurityandProtectionoftheEnvironment在工程施工、竣工及修补其任何缺陷的整个过程中，承包商应当：TheContractorshall,throughouttheexecutionandcompletionoftheWorksandtheremedyingofanydefectstherein:(a)高度
27、重视所有授权驻在现场的人员的安全，并保持现场和工程的井然有序，以免发生人身事故；(a)havefullregardforthesafetyofallpersonsentitledtobeupontheSiteandkeeptheSite(sofarasthesameisunderhiscontrol)andtheWorks(sofarasthesamearenotcompletedoroccupiedbytheEmployer)inanorderlystateappropriatetotheavoidanceofdangertosuchpersonsand(b)为了保护工程，或为了公众的安全和
28、方便，或为了其它原因，在确有必要的时间和地点，或在工程师或任何有关当局提出要求时，自费提供并保持一切照明、防护、围栏、警告信号和看守；以及(b)Provideandmaintainathisowncostalllights,guardsfencing,warningsignsandwatching,whenandwherenecessaryorrequiredbytheEngineerorbyanydulyconstitutedauthority,fortheprotectionoftheWorksorforthesafetyandconvenienceofthepublicorothers,
29、and(C)采取一切合理的步骤，以保护现场及其附近的环境，并避免由其施工方法而引起的污染、噪声或其它后果对公众造成人身或财物方面的伤害或妨碍。(c)takeallreasonablestepstoprotecttheenvironmentonandofftheSiteandtoavoiddamageornuisancetopersonsortopropertyofthepublicorothersresultingfrompollution,noiseorothercausesarisingasaconsequenceofhismethodsofoperation.安全施工要求SafetyEx
30、ecutionOn-site乙方人员必须做到安全施工，材料堆码有序，工完场清料尽，必须服从甲方管理，遵守各项管理制度。PartyB,Spersonnelonsiteshoulddosafetyexecution,materialstackingorderly,workendandmaterialclear,andshouldobeythemanagementbypartyA,abidebythemanagementrules.承包方应当遵守有关主管部门对施工场地交通、环保、安全生产等管理规定并承担施工中全部安全责任。ContractorshouldcomplywiththecompetentauthoritySmanagementregulationsonthecommunication,environmentalprotectionandsafetyproductiononthesiteandassumeallsafetyresponsibilitiesduringconstruction.
