1、工程合同中对施工进度计划的约定中英文对照版施工进度计划(中英文对照)CONSTRC11ONPROGRAMME施工组织设计应包含以下内容：FollowingcontentsshallbeincludedinContentsofConstructionOrganizationDesign(1)施工方案；ConstructionProgramme;(2)施工现场平面布置图；1.ayoutplanofconstructionsite;(3)施工进度计划和保证措施；Constructionprogressplanandassurancemeasures;(4)劳动力及材料供应计划；Planoflabou
2、randmaterialprovision;(5)施工机械设备的选用；Selectionofmachineryandequipmentforwork;(6)质量保证体系及措施；Qualityassurancesystemandmeasures;(7)安全生产、文明施工措施；Measuresofsafetyworkandorderlyconstruction;(8)环境保护、成本控制措施；Measuresofenvironmentprotectionandcostcontrol;(9)合同当事人约定的其他内容。Othercontentsagreedbypartieshereto.施工组织设计的提
3、交和修改SubmissionandAmendmentofConstructionOrganizationDesign除专用合同条款另有约定外，承包人应在合同签订后14天内，但至迟不得晚于第7.3.2项开工通知载明的开工日期前7天，向监理人提交详细的施工组织设计，并由监理人报送发包人。除专用合同条款另有约定外，发包人和监理人应在监理人收到施工组织设计后7天内确认或提出修改意见。对发包人和监理人提出的合理意见和要求，承包人应自费修改完善。根据工程实际情况需要修改施工组织设计的，承包人应向发包人和监理人提交修改后的施工组织设计。Unlessotherwisespecificallyindicated
4、intheparticularconditionherein,thecontractorshouldwithin14dayssubsequencetosignaturehereof,howevernotlaterthan7dayspriortothecommencedaywhichisstipulatedinArticle7.3.2CommenceNotice,submittheConstructionOrganizationDesigntothesupervisorwhichshalltransferthedesigntotheemployer.Exceptotherwisestatedin
5、particularcondition,theemployerandthesupervisorshallwithin7daysfollowingthereceiptoftheconstructionorganizationdesignmakeconfirmationoramendmentopinionthereof.Thecontractorshould,onthereasonableopinionsandrequirementsoftheemployerandthesupervisor,effectamendmentandperfectionthereof.Providedthatitisn
6、ecessarytomodifythedesignoftheconstructionorganizationdesignaccordingtoactualsituationoftheproject,thecontractorshallsubmittotheemployerandthesupervisortherevisedconstructionorganizationdesign.施工进度计划的编制PreparationofConstructionProgressSchedule承包人应按照第7.1款施工组织设计约定提交详细的施工进度计划，施工进度计划的编制应当符合国家法律规定和一般工程实践
7、惯例，施工进度计划经发包人批准后实施。施工进度计划是控制工程进度的依据,发包人和监理人有权按照施工进度计划检查工程进度情况。ThecontractorshouldpursuanttothestipulationsofArticle7.2ConstructionOrganizationDesignsubmitdetailedconstructionschedulewhichispreparedconformingtotheprovisionsoftheStatelawandgeneralpracticeofengineeringcustomsandusageandexecutedsubseque
8、nttotheemployersapproval.Theconstructionscheduleisthebasisforcontrollingtheprogressoftheproject,andtheemployerandthesupervisorreservetherighttoinspecttheprogressoftheprojectinaccordancewiththeconstructionschedule.施工进度计划的修订RevisionofConstructionProgressSchedule施工进度计划不符合合同要求或与工程的实际进度不一致的，承包人应向监理人提交修订的

10、包人和监理人应在收到修订的施工进度计划后7天内完成审核和批准或提出修改意见。发包人和监理人对承包人提交的施工进度计划的确认,不能减轻或免除承包人根据法律规定和合同约定应承担的任何责任或义务。Unlessotherwisespecifiedinthetermsofparticularconditionhereof,theemployerandthesupervisorshall,within7daysafterreceivingtherevisedconstructionschedule,completeexaminationandapprovalthereof,orprovidetheamen
11、dmentopinionsthereon.Noneoftheconfirmationoftheemployerandthesupervisorontheprogressschedulesubmittedbythecontractorshallmitigateorwaivethecontractorsanyliabilityorobligationwhichisassumedbythecontractorinaccordancewiththeprovisionsoflawandcontract工程进度ProjectSchedule双方应共同努力，按照附件四及时使工程竣工。建造期从开工日计算为一年
12、，C可以经B同意延长竣工期。ThepartiesshallworktogetherinordertoendeavourtoachievehetimelycompletionoftheProjectinaccordancewiththeProjectscheduleasAnnex4accordingtowhichtheconstructionperiodshallbeyearsfromthecommencementdate.However,CmayextendtheconstructionperiodupontheagreementofB.TheContractorshallsubmitadet
13、ailedtimeprogrammetotheEmployer,SRepresentativewithin28daysafterreceivingtheNoticeunderSub-Clause8.1CommencementDate.TheContractorshallalsosubmitarevisedprogrammewheneverthepreviousprogrammeisinconsistentwithactualprogressorwithContractorfSobligation.Eachprogrammeshallinclude:在根据FIDIC金皮书8.1（开工日期）的规定

16、ngineerandtheEmpIoyerDsRepresentativeshallmakeconfirmationorproposemodificationopinionswithindaysafterreceivingtheaforementioneddocuments,failureofwhichshallbedeemedastheconsentsthereto.承包人应在收到发包人书面进场通知后的5个工作日内，向发包人代表和工程师提交一份详尽的施工组织设计和工程进度计划。TKS工程师和发包人代表应在收到上述文件后的一天内确认或提出修改意见，逾期不确认也不提出书面意见的，视为同意。The

19、httoclaimAdditionalContractPricefortheimprovementmeasuresiftheinconsistencybetweenactualscheduleandplannedscheduleisattributabletotheContractor.工程实际进度与经确认的进度计划不符时，承包人应按工程师和/或发包人代表的要求在三天内提出改进措施，经TKSH程师和发包人代表确认后执行。因承包人的原因导致实际进度与进度计划不符，承包人无权就改进措施提出追加合同价款。提交在合同规定的时间内进度计划ProgrammertobeSubmitted承包商应当在中标函签
20、发日之后，以工程师规定的适当格式和详细程度,向工程师递交一份工程进度计划，以取得H程师的同意。无论工程师何时需要，承包商还应以书面形式提交一份对其进行工程施工所拟采用的安抖睡口方法的总说明，以供参考。TheContractorshall,withinthetimestatedintheseConditionsafterthedateoftheLetterofAcceptance,submittotheEngineerforhisconsentaprogramme,insuchformanddetailastheEngineershallreasonablyprescribe,fortheexe

26、artyAtimely.编制施工组织设计，施工总进度计划、用水、用电计划，开竣工通知书、隐蔽工程验收单等并及时送甲方。PROJECTCONSTRUCTIONSHCEDLE项目实施进度表TheEPC,Scontractorshallcompletetheirworkwithin30months.Theprojectconstructionscheduleisarrangedbasedontheactualsituationsofallthemainproductionlinesofsecondstagerevampingandexpansionprojecttomeettherequiremen
27、tsofwholeprojectstartingproduction.承包商应在30个月内完成EPC合同中规定的工作。项目实施进度是根据二期扩建工程各主要生产线在项目整体投产过程中的需要来进行安排。TheAcceptedProgrammeistheprogrammeidentifiedintheContractDataoristhelatestprogrammeacceptedbytheProjectManager.ThelatestprogrammeacceptedbytheProjectManagersupersedespreviousAcceptedProgramme.已认可的施工进度计
28、划是指合同资料中所确定的施工进度计划，或项目经理认可的最新施工进度计划。项目经理认可的最新施工进度计划将取代所有先前已认可的施工进度计划I)进度计划指在7.1款中定义的进度计划，它也可以按7.2款进行修改。TimeSchedulemeanstheTimeScheduledefinedinArticle7.1,asmaybealteredaccordingtoArticle7.20engineering,manufacturing,procurement,supply,transportation,erectionandcoissioning,detailedforallsystemandmai
29、npartsofthepowerplant,civilworks,andspecifiedtimeforstart/finishandrelationshipforeachtask设计，制造，采购，供货，运输，安装，调试的总体进度表，电厂所有系统、主要部分、土建的详细进度表，开工/完工具体时间表，以及各个任务间的关系。Presenttheengineertheweeklyprogressscheduleandrelevantprogressstatistics.Amonthlyreportisalsorequested.向工程师提供周以及月工程进度计划及相应进度统计报表。Thecontract
30、ormustpresenttheconstructionmethodsstatementandtheprogressscheduletotheengineeronthetimestipulatedinthecontractspecialclauses.Andtheengineermakesconfirmationorputforwarddifferentopinionsonthetimefixedinthespecialclauses.Otherwise,seethatasagreement.承包人按专用条款约定的日期，提交施工组织设计和工程进度计划。工程师按专用条款约定的时间确认或提出修改意
31、见，逾期不确认也不提出书面意见的，视为同意。Thecontractorshallexecutetheconstructionworksinaccordancewiththescheduleapprovedbytheengineerandwillbecheckedandsupervisedbytheengineer.ThecontractormustsubmitimprovementsSrequiredbytheengineeriftheworkprogressisnotinaccordancewiththeschedule,andshallexecutetheimprovementsafter
32、approvalbytheengineer.Thecontractorshallnotaskforsupplementalpaymentforthisimprovementifitishimwhocausesthedelayintheschedule.承包人必须按工程师确认的进度计划组织施工,接受工程师对进度的检查、监督。工程实际进度与经确认的进度计划不符时，承包人应按工程师的要求提出改进措施，经工程师确认后执行。因承包人的原因导致实际进度与进度计划不符，承包人无权就改进措施提出追加合同价款。为确保施工工期，甲方根据总工期（总工期以签定的合同工期为准）的要求，以周计划进行工期进度的安排，乙方必
33、须严格按照甲方制定的周进度计划安排工作并确保其完成。IntheexpectationofensuringtermofprojectpartyAwill,pursuanttotherequirementofgeneraltermwhichbesubjecttothetermwhichisstipulatedherein,makepreparationofprogresswithweeklyschedulewithwhichpartyBshouldbeinstrictaccordance,andensureitsaccomplishmentthereof.根据下文第4.2款规定的要求，制订并定期更
34、新项目的施工进度表，并协调分包商（包括供应商）的活动以确保对进度表的遵守。EstablishingandperiodicallyupdatingaConstructionSchedulefortheProject,asrequiredunderParagraph4.2,below,andcoordinatingtheactivitiesoftheSubcontractors（includingsuppliers）toassureadherencetotheSchedule.业主有权要求承包商在施工进度表中所示的日期前完成工程或其任何一部分，或即使承包商的延迟请求已根据通用条件第12条的规定被批
35、准，仍然要求承包商按照施工进度表完成工程。业主根据本第4.4款要求的对工程进度的任何加速应限于承包商能合理达到的限度内，并且应使承包商有权获得一项变更指令，以涵盖任何其所承担的因该等加速工作所引起的额外成本。TheOwnershallhavetherighttorequiretheContractortocompletetheWorkoranypartthereofbeforethedatesetforthintheconstructionSchedule,ortorequiretheContractortocompletetheWorkaccordingtotheConstructionSc
36、heduleeventhoughhisclaimforadelayhasbeenapprovedunderArticle12oftheGeneralConditions.AnyaccelerationintheprogressoftheWorkrequiredbytheOwnerunderthisParagraph4.4shallbelimitedtothatreasonablyattainablebytheContractorandshallentitletheContractortoaChangeOrdertocoveranyadditionalcostsincurredbyhimasaresultoftheacceleration.
