3、atedandadoptedatthe1stexecutivemeetingonSeptember28,2023,areherebyissued,andshallcomeintoforceonDecember1,2023.Director:MaXiaoweiNovember3,2023食品安全标准管理办法第一章总则第一条为规范食品安全标 准管理工作，落实“最严谨的标 准”要求，根据中华人民共和 国食品安全法及其实施条例， 制定本办法。第二条 本办法适用于食品 安全国家标准的制定、修改、公 布等相关管理工作及食品安全地 方标准备案工作。食品安全标准是强制执行的标 准，包括食品安全国家标准和食 品
4、安全地方标准。第三条国家卫生健康委员 会（以下简称国家卫生健康委） 依法会同国务院有关部门负责食 品安全国家标准的制定、公布工 作。各省、自治区、直辖市人民政府 卫生健康主管部门（以下简称省 级卫生健康主管部门）负责食品 安全地方标准制定、公布和备案 工作。MeasuresfortheAdministrationofFoodSafetyStandardsChapterIGeneralProvisionsArticle1TheseMeasuresaredevelopedinaccordancewiththeFoodSafetyLawofthePeoplesRepublicofChinaandth
5、eregulationontheimplementationthereofforthepurposesofregulatingtheadministrationoffoodsafetystandardsandimplementingtherequirementsofthemostrigorousstandards.Article2TheseMeasuresshallapplytothedevelopment,amendment,andissuanceofnationalfoodsafetystandardsandotherrelevantadministrationworkaswellasth
6、erecordationoflocalfoodsafetystandards.Foodsafetystandardsarecompulsorystandards,includingnationalfoodsafetystandardsandlocalfoodsafetystandards.Article3TheNationalHealthAdministration(NHC)shall,inconjunctionwiththerelevantdepartmentsoftheStateCouncil,belegallyresponsibleforthedevelopmentandissuance
7、ofnationalfoodsafetystandards.Thehealthadministrativedepartmentsofpeople,sgovernmentsofallprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernment(provincialhealthdepartments)shallberesponsiblefordeveloping,issuing,andfilinglocalfoodsafetystandards.Article4Foodsafetystandardssh
8、allbedevelopedinordertoprotectpublichealth,bebasedonfoodsafetyriskassessmentresults,andbescientific,reasonable,safe,andreliable.Article5Thedevelopmentofnationalfoodsafetystandardsshallincludebutnotbelimitedtoplanning,scheduling,initiationofdevelopment,drafting,requestingcomments,examination,approval
9、,issuance,aswellasfollow-upevaluation,revision,andamendment.Article6TheNHCshallformaReviewCommitteeforNationalFoodSafetyStandards(ReviewCommitteen)toberesponsibleforexaminingnationalfoodsafetystandardsandprovidingadvisoryopinionsontheworkofnationalfoodsafetystandards,amongothers.Thereviewcommitteeco
10、nsistsofprofessionalcommittees,thechieftechnicalofficer,alegalityreviewworkgroup,thesecretariat,andtheofficeofthesecretariat.Article7Theissuednationalfoodsafetystandardsfallunderscientificandtechnologicalachievementsandthemaindraftersofthestandardsmaybegivenincentivesinaccordancewiththerelevantprovi
11、sionsissuedbythestate.第四条制定食品安全标准 应当以保障公众身体健康为宗 旨，以食品安全风险评估结果为 依据，做到科学合理、安全可 靠。第五条食品安全国家标准 制定工作包括规划、计划、立 项、起草、征求意见、审查、批 准、公布以及跟踪评价、修订、 修改等。第六条国家卫生健康委组 织成立食品安全国家标准审评委 员会（以下简称审评委员会）， 负责审查食品安全国家标准，对 食品安全国家标准工作提供咨询 意见等。审评委员会设专业委员会、技术 总师、合法性审查工作组、秘书 处和秘书处办公室。第七条公布的食品安全国 家标准属于科技成果，可以按照 国家有关规定对标准主要起草人 给予激励
12、。第八条县级以上卫生健康 主管部门依职责对食品安全标准 相关工作提供人员、经费等方面 的保障。Article8Healthadministrativedepartmentsatorabovethecountylevelshallguaranteetheworkrelatingtofoodsafetystandardsinsuchaspectsaspersonnelandfundsaccordingtotheirduties.食品安全国家标准立项ChapterIlInitiationofDevelopmentofNational,一直FoodSafetyStandards-Article 9 T
13、heNHCshall,inconjunctionwiththerelevantdepartmentsoftheStateCouncil,makeannualimplementationplansaccordingtoplansonnationalfoodsafetystandardsandshallrequestcommentsfromthepublic.Article 10 Wherearelevantdepartmentdeemsthatthedevelopmentofnationalfoodsafetystandardsisneededinthefieldsunderitssupervi
14、sion,itshallofferrecommendationsoninitiatingthedevelopmentofstandardstotheNHCbeforepreparingtheannualplanforthedevelopmentofnationalfoodsafetystandards.Anycitizen,legalperson,oranyotherorganizationmayofferrecommendationsoninitiatingthedevelopmentofnationalfoodsafetystandards.Article 11 Therecommenda
15、tionsoninitiatingthedevelopmentofstandardsshallincludebutnotbelimitedtomajorfoodsafetyproblemstobesolved,thebackgroundandreasonsfortheinitiationofthedevelopmentofstandards,thebasisforthemonitoringandassessmentofexistingfoodsafetyrisks,possibleeconomicandsocialimpacts,andthecandidateentitiesfordrafti
16、ngstandards.Article 12 ThenationalfoodsafetystandardstobedevelopeduponrecommendationsshallcomplywithArticle26oftheFoodSafetyLawofthePeoplesRepublicofChina.第九条国家卫生健康委会 同国务院有关部门，根据食品安 全国家标准规划制定年度实施计 划，并应公开征求意见。第十条各有关部门认为本 部门负责监管的领域需要制定食 品安全国家标准的，应当在每年 编制食品安全国家标准制定计划 前，向国家卫生健康委提出立项 建议。任何公民、法人和其他组织都可 以提
17、出食品安全国家标准立项建 议。第十一条 立项建议应当包 括：要解决的主要食品安全问 题、立项的背景和理由、现有食 品安全风险监测和评估依据、可 能产生的经济和社会影响、标准 起草候选单位等。第十二条建议立项制定的 食品安全国家标准，应当符合 中华人民共和国食品安全法 第二十六条规定。第十三条 审评委员会根据Article 13 Thereviewcommitteeshall,accordingtotheneedsoftheworkonfoodsafetystandards,deliberaterecommendationsontheinitiationofthedevelopmentofnat
18、ionalfoodsafetystandardsandofferadvisoryopinionsontheplansforthedevelopmentofnationalfoodsafetystandards.Article 14 Theprojectslistedinannualplansforthedevelopmentofnationalfoodsafetystandardsmaybeadjustedaccordingtoactualneedsduringthedraftingprocess.Iffoodsafetyriskassessmentresultsprovethattherea
19、repotentialhazardsinfoodsafetyormajorproblemsarefoundinfoodsafetyriskmanagement,newitemsforthedevelopmentofnationalfoodsafetystandardsmaybesupplementedurgently.ChapterIIIDraftingofNationalFoodSafetyStandardsArticle 15 TheNHCshallselectanentitywithcorrespondingtechnicalcapabilitythroughbidding,entrus
20、tment,orothermethodstoundertakethedraftingofnationalfoodsafetystandards.食品安全标准工作需求，对食品 安全国家标准立项建议进行研 究，提出食品安全国家标准制定 计划的咨询意见。第十四条列入食品安全国 家标准年度制定计划的项目在起 草过程中可以根据实际需要进行 调整。根据食品安全风险评估结果证明 食品存在安全隐患，或食品安全 风险管理中发现重大问题，可以 紧急增补食品安全国家标准制定 项目。第三章食品安全国家标准起草第十五条国家卫生健康委 采取招标、委托等形式，择优选 择具备相应技术能力的单位承担 食品安全国家标准起草工作。
21、第十六条食品安全国家标 准制定实行标准项目承担单位负 责制，对标准起草的合法性、科 学性和实用性负责，并提供相关 食品安全风险评估依据和社会风 险评估结果资料。Article 16 Thedevelopmentofnationalfoodsafetystandardsshallbesubjecttotheresponsibilitysystemoftheentitiesundertakingstandardprojects.Theentitiesundertakingstandardprojectsshallberesponsibleforthelegality,Scientificity,a
22、ndpracticabilityofthedraftingofstandardsandshallprovidetherelevantfoodsafetyriskassessmentbasisandthematerialsofsocialriskassessmentresults.Article 17 Expertsandteamsfromdifferentdepartmentsandfieldsshallbeencouragedtoformstandardcollaborationgroupstoparticipateinthedraftingofstandards,follow-upeval
23、uation,publicityandtraining,andotherwork.Article 18 Anentityundertakingastandardprojectshallmeetthefollowingconditions:(1) Ithasthetechnicalcapacityrequiredfordraftingnationalfoodsafetystandards.(2) Thereisnoconflictsofinterestinthefieldinvolvedintheundertakenproject.(3) Itisabletoprovidepersonnel,s
24、cientificresearch,andotherresourcesandguaranteesrequiredforthedevelopmentandrevisionofnationalfoodsafetystandards.(4) Ithasanindependentlegalpersonstatus.(5) Standardprojectfundsaresubjecttotheentitysunifiedfinancialmanagementandseparateaccountingandareusedforspecifiedpurposesonly.第十七条鼓励跨部门、跨 领域的专家和
25、团队组成标准协作 组参与标准起草、跟踪评价和宣 传培训等工作。第十八条标准项目承担单 位应当具备以下条件：（一）具备起草食品安全国家标 准所需的技术能力；（二）在承担项目所涉及的领域 内无利益冲突；（三）能够提供食品安全国家标 准制定、修订工作所需人员、科 研等方面的资源和保障条件；（四）具备独立法人资格;（五）标准项目经费纳入单位财 务统一管理，单独核算，专款专 用。第十九条标准项目承担单 位应当指定项目负责人。项目负 责人应当在食品安全及相关领域 具有较高的造诣和业务水平，熟 悉国内外食品安全相关法律法规 和食品安全标准。Article19Theentityundertakingastan
26、dardprojectshalldesignatethepersoninchargeoftheproject.Thepersoninchargeoftheprojectshallhaveahighlevelofknowledgeandcompetenceinfoodsafetyandrelatedfieldsandbefamiliarwithrelevantdomesticandoverseasfoodsafetylawsandregulationsandfoodsafetystandards.Article20Nationalfoodsafetystandardsshallbedrafted
27、basedonfoodsafetyriskassessmentresultsbytakingintofullconsiderationtheresultsofthesafetyriskassessmentofedibleagriculturalproductsinlinewithChinaseconomicandsocialdevelopmentlevelandobjectiveactualneedsandbyreferringtotherelevantinternationalstandardsandinternationalfoodsafetyriskassessmentresults.A
28、rticle 21 Duringthedraftingprocess,theentityundertakingastandardprojectandthepersoninchargeoftheprojectshallconductin-depthinvestigationandresearchandrequestcommentsfromregulatorydepartments,industryassociationsandsocieties,foodproducersandtraders,andotherstandardusers,aswellasrelevanttechnicalinsti
29、tutionsandexperts.ChapterIVExaminationofNationalFoodSafetyStandardsArticle 22 Nationalfoodsafetystandardsshallbeexaminedaccordingtothefollowingprocedures:(1) Preliminaryexaminationbytheofficeofthesecretariat.(2) Examinationbymeetingsofprofessionalcommittees.(3) Examinationbymeetingsofthechieftechnic
30、alofficer.第二十条起草食品安全国 家标准，应当依据食品安全风险 评估结果并充分考虑食用农产品 安全风险评估结果，符合我国经 济社会发展水平和客观实际需 要，参照相关的国际标准和国际 食品安全风险评估结果。第二十一条 标准项目承担 单位和项目负责人在起草过程 中，应当深入调查研究，充分征 求监管部门、行业协会学会、食 品生产经营者等标准使用单位、 有关技术机构和专家的意见。第四章食品安全国家标准审查第二十二条食品安全国家 标准按照以下程序审查：（一）秘书处办公室初审;（二）专业委员会会议审查;（三）技术总师会议审查;（四）合法性审查工作组审查;(4) Examinationbythel
31、egalityreviewworkgroup.(5) Examinationbythemeetingofthesecretariat.(6) Deliberationbythedirectorsmeeting.Article 23 Theofficeofthesecretariatshallberesponsibleforthepreliminaryexaminationofmaterialsinrespectofthelegality,Scientificity,andstandardizationofdraftstandardsandtheircoordinationwithotherna
32、tionalfoodsafetystandardsandtheintegrityofsocialstabilityriskassessment.Article 24 TheScientificityandstandardizationofthedraftforthereviewofnationalfoodsafetystandardsanditscoordinationwithothernationalfoodsafetystandardsandrelevantstandardsaswellasothertechnicalissuesshallbeexaminedandapreliminary
33、examinationofthelegalityofnationalfoodsafetystandardsandsocialstabilityriskassessmentreportsshallbeconductedatthemeetingoftheprofessionalcommittee.Article 25 Whenaprofessionalcommitteeexaminesthestandards,twothirdsormoreofthemembersshallbepresentandtheexaminationconclusionshallbereachedbyconsensus.I
34、fnoconsensusisreached,theissuesshallbevotedbasedonsufficientdiscussion.Itshallbedeemedthatthestandardshavepassedtheexaminationatthemeetingwiththeconsentofthreefourthsormoreofthemembersattendingthemeeting.（五）秘书长会议审查;（六）主任会议审议。第二十三条 秘书处办公室 负责对标准草案的合法性、科学 性、规范性、与其他食品安全国 家标准之间的协调性以及社会稳 定风险评估等材料的完整性进行 初审
35、。第二十四条 专业委员会会 议负责对食品安全国家标准送审 稿的科学性、规范性、与其他食 品安全国家标准和相关标准的协 调性以及其他技术问题进行审 查，对食品安全国家标准的合法 性和社会稳定风险评估报告进行 初审。第二十五条 专业委员会审 查标准时，须有三分之二以上委 员出席，采取协商一致的方式作 出审查结论。在无法协商一致的 情况下，应当在充分讨论的基础 上进行表决。参会委员四分之三 以上同意的方可作为会议审查通 过结论。第二十六条标准草案经专 业委员会会议审查通过后，应当 向社会公开征求意见，并按照规 定履行向世界贸易组织的通报程Article 26 Afterthedraftsofstan
36、dardsareexaminedandapprovedatthemeetingoftheprofessionalcommittee,commentsfromthepublicshallbesoughtandtheproceduresfornotificationtotheWTOshallbeperformed.Article 27 Theexaminationresultsoftheprofessionalcommitteeanditsconnectionwithothernationalfoodsafetystandardsshallbeexaminedandthelegalityofnat
37、ionalfoodsafetystandardsandsocialstabilityriskassessmentreportsshallbereviewedatthemeetingofthechieftechnicalofficer.Article 28 Thelegalreviewworkgroupshallberesponsibleforexaminingthelegalityofstandardsandsocialstabilityriskassessmentreports.Article 29 Theadministrativeexaminationandlegalityreviewo
38、fnationalfoodsafetystandardsshallbeconductedatthemeetingofthesecretariatandtheopinionsofrelevantdepartmentsshallbecoordinated.Afterbeingexaminedandapprovedbythemeetingofthesecretariat,astandarddraftisformedforapproval.Ifnecessary,theconveningofadirectorsmeetingmaybeproposedfordeliberation.Article 30
39、 Incaseofseriousdisagreementsduringvariousstagesofstandardrevieworsignificantissuesrelatedtofoodsafetyorsocialrisk,amongothers,arediscovered,theofficeofthesecretariatmayrequestthesecretariattoorganizeaspecialexaminationanddecidetoterminatethestandarddevelopmentprocessifnecessary.序。第二十七条技术总师会议 负责对专业委
40、员会的审查结果以 及与其他食品安全国家标准的衔 接情况进行审查，对食品安全国 家标准的合法性和社会稳定风险 评估报告进行复审。第二十八条合法性审查工 作组负责对标准的合法性、社会 稳定风险评估报告进行审查。第二十九条秘书长会议负 责食品安全国家标准的行政审查 和合法性审查，协调相关部门意 见。秘书长会议审查通过后形成标准 报批稿。必要时可提请召开主任 会议审议。第三十条标准审查各环节 产生严重分歧或发现涉及食品安 全、社会风险等重大问题的，秘 书处办公室可以提请秘书处组织 专项审查，必要时作出终止标准 制定程序等决定。第五章食品安全国家标准公布ChapterVIssuanceofNationa
41、lFoodSafetyStandardsArticle 31 NationalfoodsafetystandardsshallbeissuedbytheNHCinconjunctionwiththerelevantdepartmentsoftheStateCouncil,towhichtheStandardizationAdministrationoftheP.R.C.shallassignserialnumbers.Article 32 Atransitionalperiodshallbesetbetweenthedateofissuanceandimplementationofnation
42、alfoodsafetystandardsforfoodproducers,traders,andallpartiesimplementingthestandardstomakegoodpreparationsfortheimplementationofthestandards.Foodproducersandtradersmay,accordingtotheirneeds,implementthestandardsinadvanceduringthetransitionalperiodaftertheissuanceofthestandards,butshallpublicizetheimp
43、lementationinadvance.Article 33 TheNHCshallberesponsibleforinterpretingnationalfoodsafetystandardsandtheinterpretationsofthestandardsshallhavethesameeffectasthetextofnationalfoodsafetystandards.Article 34 NationalfoodsafetystandardsandtheirinterpretationsshallbeissuedonthewebsiteoftheNHCforthepublic
44、toaccessanddownloadfreeofcharge.第三十一条食品安全国家 标准由国家卫生健康委会同国务 院有关部门公布，由国家标准化 管理委员会提供编号。第三十二条食品安全国家 标准公布和实施日期之间一般设 置一定时间的过渡期，供食品生 产经营者和标准执行各方做好实 施的准备。食品生产经营者根据需要可以在 标准公布后的过渡期内提前实施 标准，但应公开提前实施情况。第三十三条 国家卫生健康 委负责食品安全国家标准的解 释，标准解释与食品安全国家标 准文本具有同等效力。第三十四条食品安全国家 标准及标准解释在国家卫生健康 委网站上公布，供公众免费查 阅、下载。第三十五条食品安全国家
45、标准公布后，主要技术内容需要 修订时，修订程序按照本办法规 定的立项、起草、审查和公布程 序执行。Article 35 Aftertheissuanceofnationalfoodsafetystandards,ifmajortechnicalcontentneedstoberevised,therevisionprocedureshallbecarriedoutinaccordancewiththeproceduresfortheinitiationofthedevelopmentofstandards,drafting,examination,andissuancespecifiedint
46、heseMeasures.Ifsometechnicalcontentneedstobecorrected,adjusted,oramended,amendmentsshallbemadeintheformofamendmentstonationalfoodsafetystandards.Adjustmentstostandardeditorialerrorsandothercontentshallbecorrectedbypublishingstandarderrorcorrections.个别技术内容需作纠正、调整、 修改时，以食品安全国家标准修 改单形式修改。对标准编辑性错误等内容进行调
47、 整时，通过公布标准勘误加以更 正。第三十六条国家卫生健康 委应当组织有关部门、省级卫生 健康主管部门和相关责任单位对 食品安全国家标准的实施情况进 行跟踪评价。Article 36 TheNHCshallorganizerelevantdepartments,provincialhealthdepartments,andrelevantresponsibleentitiestotrackandevaluatetheimplementationofnationalfoodsafetystandards.Anycitizen,legalorganizationmayrecommendations
48、ontheimplementationofstandards.person,oranyotheroffercommentsandtheproblemsexistingin任何公民、法人和其他组织均可对标准实施过程中存在的问题提出意见和建议。跟踪评价结果应当作为食品安全 国家标准制定、修订的重要依 据。第六章食品安全地方标准备案第三十七条省级卫生健康 主管部门应当在食品安全地方标 准公布之日起30个工作日内向国 家卫生健康委提交备案。省级卫 生健康主管部门对提交备案的食 品安全地方标准的科学性、合法 性和社会稳定性负责。Thefollow-upevaluationresultsshallserveasanimportantbasisforthedevelopmentandrevisionofnationalfoodsafetystandards.ChapterVlRecordationofLocalFoodSafetyStandardsArticle 37 TheprovincialhealthdepartmentshallsubmitlocalfoodsafetystandardstotheNHCforrecordationwithin30working
