1、2023ProcuratorialWhitePaperonIntellectualPropertyinShanghaiReleasedbyShanghaiPeople,sProcuratorateAstheintellectualproperty(hereinafterreferredtoastheTP)isakeyelementofthenewqualityproductiveforces,theIPprotectionmustbestrengthenedindevelopmentofsuchforces.Atpresent,Shanghaiiswitnessingaccelerationo
2、fconstructionofaninternationalcenterfortechnologyandinnovationaswellasbuildingoftheIPprotectionhighlandandthatofaninternationalIPcentralcity.Theprocuratoratewillperformthehigh-qualityandhigh-efficiencyprocuratorialfunctionstoenablenewachievementsinIPprotectionsothatinnovativevigorcanbemotivatedandan
3、innovativeenvironmentcanbecreated.Today(April23),ShanghaiPeoplesProcuratorateholdsapressconferencetoreleasethe2023ProciiratoraiWhitePaperonIntellectualPropertyinShanghaiintheChineseandEnglishversion.Basedonananalysisofthecriminal,civil,administrative,public-interestIPlitigationcaseshandledbythepropc
4、uratoratesinShanghaiin2023,westudynewchangesandtrendsoccurredintheIPdevelopmentandprotectiontosuggestcounter-measuresandrecommendationsonconsolidationofthecomprehensivejudicialIPprotectionwithaviewtoprovidingsubstantiallyoptimizedincomparisonwith2022.ComprehensiveexaminationoftheIPcaseswasstrengthen
5、ed,leadingtoprosecutionof20personsonsuspicionoftheIPinfringementinothercriminalcases.Intermsoftheeffectivejudgmentsrenderedbythecourt,thosewhoweresentencedtominimumthree-yearfixed-termimprisonmentaccountedfor43.9%,indicatingstrengtheningoftheproperty-relatedpenalty.2. SignificantchangesintheIP-infri
6、ngementcriminalstructure.Firstly,althoughthenumberofthetrademarkinfringementcasesstillrankedthetopincriminalcases,itsproportionfurtherdroppedto88.8%.Amongotherthings,therewere873casesofsellingcommoditywithcounterfeitregisteredtrademarksinvolving1,579perpetrators,rankingthetopinvarioustrademark-infri
7、ngementcharges.Therewerealso298casesofcounterfeitingregisteredtrademarksinvolving744perpetratorsand45casesofillegalmanufactureandsalesofillegallyproducedregisteredtrademarksandlogosinvolving124perpetratorsSecondly,thequantityrelativeratioofthecopyright-infringementcasesroseunanimously,accountingfor9
8、.4%from5.3%in2022incriminalcases.Amongotherthings,therewere105casesofcopyrightinfringementinvolving261perpetrators,thenumberofwhichroseby1.8timesincomparisonwith2022.Therewere24casesofsalesofpiratecopiesinvolving46perpetrators,thenumberofwhichrosebyfivetimesincomparisonwith2022.Thirdly,casesofinfrin
9、gementofbusinesssecretswereontherise,accountingfor1.8%incriminalcases.Therewere24casesofinfringementofbusinesssecretsinvolving56perpetrators,thenumberofwhichroseby60%incomparisonwith2022.ThefirstcaseofillegalspyingandprovisionofbusinesssecretsforoverseasorganizationswashandledinShanghaiasofimplement
10、ationoftheAmendments(XI)totheCriminal1.aw.Changesinthecriminalstructurewerecausedby,ononehand,frequentoccurrenceofnew-typecasessuchasthecopyrightandthebusinesssecretinfringementresultedfromincreasingdevelopmentintheneweconomyandhightechnology;ontheotherhand,improvementinthejudicialorganspowerfullypr
11、ofessionalcapabilitiesofcrackingandhandlingofcasesaswellasgradualmanifestationofachievementsintheservicesforscienceandtechnologyinnovationcentersandtheculturalprosperityandinnovation.3. Deeperfulfillmentofthelegalsupervisionofthecriminalproceedings.Pre-interventioninthefrontendofhardcaseswasfullyimp
12、lementedaimingatthefeaturesoftheIP-infringementcriminalcases,i.e.easilyperishableevidenceandtimelinessofevidencecollection.Relyingonmechanismsincludingtheofficeofinvestigationsupervisionandcollaboration,wesupervisedregistrationof283casesaswellaspursuitandprosecutionof213perpetrators,72ofwhomweresent
13、encedtominimumthree-yearfixed-termimprisonment.Transferof52casesonsuspicionoftheIPinfringementtothepolicebytheadministrativeauthoritieswassuggested.50ofwhichwasregisteredforinvestigation.Twocriminalcaseswereprotested.Judgmentagainstoneofthemwasamended.4. Solidprogressesweremadeincivilandadministrati
14、veIPsupervisionandtheIPpublic-interestlitigationwassteadilyexpanded.Therewere28civilsupervisioncasesincludingtwocaseswhereprocuratorialsuggestionsonarelrialweremadeand15caseswhereprocuratorialsuggestionsonrectificationofviolationofthelawweremade.Moreover,thereweretwocasesinvolvingSUPerViSiOnofnon-li
15、tigationadministrativeenforcementwhereprocuratorialsuggestionsonrectificationofviolationofthelawwerebothmade.Inaddition,therewere17IPpublic-interestlitigationcasesincluding11civilcasesandsixadministrativeones.Pre-Iitigationprocuratorialsuggestionsweremadeinfivecaseswheretheadministrativeauthoritiesh
16、avealltakenrectificationmeasuresandperformeddutiesinaccordancewiththelaw.5. ComprehensiveperformanceofprocuratorialfunctionsintheIPrealmwasfullydeepened,featuringincreasinglydiversemeans.Thecomprehensiveprocuratorialfunctionswereperformedinhandlingof129casesbytheprocuratoratesinShanghai,including115
17、casesreverselytransferredtoadministrativeauthoritiesforpunishmentafternolleprosequi,11casesofincidentalcivilactions,twoprosecution-supportedcasesandtwocasesofpublic-interestadministrativelitigation.Ourperformanceofprocuratorialfunctionsdisplayedfeaturesofrelianceoncriminalcases,connectionbetweenthea
18、dministrativelawenforcementandthecriminaljustice,andincreasingdiversifiedperformancemeans,extendingtocivil,administrativeandpublic-interestlitigationcases.(11) Casefeatures1. SignificantcorrelationbetweentheIPcasesanddevelopmentofthenewqualityproductiveforces.Intermsofthecasenumber,thegrowthtrendoft
19、heIPcasesinrecentyearsiscloselyrelatedtodevelopmentintheindustrialeconomyandhighandnewtechnology.Inregionsfeaturingadvancedtechnologicalindustries,thenumberofcaseswasamongthehighestinShanghai.Thenarrowinggapinthenumberofcasesindifferentregionsreflectedthebalanceddevelopmentintheinnovativesourcecapac
20、itytherein.Intermsofthecasecharacteristics,thoseinvolvingartificialintelligence,high-endmanufacture,digitalcopyright,andmaliciouslitigationwereontherise;proportionsofthecopyrightandbusinesssecret-relatedcasesincreasedcontinuously;andthesuperisioncasesinthematterofpatentsbegantoemerge.2. Featuresofcy
21、ber-based,chain-likeandinterweavingIP-iniringementcrimesbecameapparentandtheamountofmoneyinvolvedbecameconsiderable.Cyberizationofthecriminalmeanswasmanifestednotonlyinoperationandsalesbymeansoftheweb,butalsointheonlinespacewheremoreandmorecriminalactsoccurredaimingatinfringementofdigitalbusinesssec
22、retsandcopyrights.Thecriminalactsweremainlyintheformofthejointcrimewithanexplicittrendtowardschain-like,scalable,andindustrializationmodel.Theinternaldivisionoflaborwassocomplexandmeticulousthatthedifficultyofpunishmentthroughouttheentirechainwasgreater.Caseswithinterweavingandconcurringchargeswereo
23、ntherisewherethecriminalinfringementsendangeredboththeright-owners5intellectualpropertyandthewebanddatasafetyatthesametime.Thetotalamountofthemajorityofcasesreachedthecriteriaofhugeamount.CasesworthmorethanRMB100millionwereontherise.3. ThenumberoftheCiVi1.administrativeandpublic-interestlitigationca
24、sesrose,revealingmoreawarenessoftheIPinterestsubjecttoseeksupervisionandrelief.Ascriminalcasesprovidedmoresourcesofcluesforcomprehensiveperformanceoffunctionsincludingthepublic-interestlitigation,featuresoftheintegratedperformanceoftheprocuratorialfunctionsintheIPrealmbecamemorenotable.Incivilandadm
25、inistrativesupervisionandpublic-interestlitigationcases,focuseswerenotonlyonprotectionofrightsandinterestsoftheIPowners,butalsoonthatofthesocialandpublicinterests,aswellastherightsandinterestsofothersubjectsincludingthelicenseesandthepartyaccusedofinfringement.Thewillingnessofpartiestoapplyforcivila
26、ndadministrativeSUPerViSiOnincreasedandthestrengthofprocuratorialsupervisionwassignificantlyenhanced,meaningthatthesubjectsofIPinterestsweremoreinclinedtocomprehensivelyusevarioussupervisionchannelstoseekrelief.Moreover,neweconomicenteprisessuchasthenestingzonefortechnologicalinnovationindustrieslai
27、dmoreandmoreemphasisonprotectionoftheimportantcompetitiveadvantagesbymeansofthecriminalrelief,sotheirwishtoprovidethejudicialauthoritieswithcriminalcluesbecamestronger.4. Anumberofinfluentialcasesemerged,indicatingincreasingimprovementinthecapacityofprocuratorialinnovationsupportingtheoverallinnovat
28、ion.Successfulhandlingofanumberofinfluentialcasesincludingthefirstevercaseofcopyrightinfringementbymeansofavoidingtechnicalmeasuresinthecountry,thefirstever“commercialespionagecaseinShanghai,thecaseofinfringementofthecopyrightofamurdermysterygameandthatofinfringementoftheintegratedcircuittrademarksm
29、anifestedcertaindemonstrativeeffectsintermsofcluediscovery,lawapplicationandIPgovernance.Basedoncasehandling,theprocuratoratesinShanghai,inconjunctionwithmultipleauthoritiessuchastheregulatorydepartmentsandindustrialassociations,formulatedandreleasedtheprocuratorialserviceproductsincludingtheGuideli
30、nesforProtectionandComplianceofTechnologicalMeasuresonEnterpriseDigitalCopyrightsandtheTipsforEnterpriseEmployeestoPrevent1.egalRisksofBusinessSecrets.Throughpromotionofourinnovationability,weformedtheworkmodeof44casehandling-procuratorialinnovation-jointsupportforinnovationtoassistandenrichtheunder
31、lyingsystemoffullsupportforinnovationandtoenhancecultivationanddevelopmentofthenewqualityproductiveforces.II.AnAnalysisofCharacteristicsofVariousIP-InfringementCriminalCasesinShanghai1. )CharacteristicsoftheTrademarkInfringementCriminalCases2. Extensionofthetrademark-carriertypetothehightechnologyse
32、ctor.Inthenumerouscriminalcasesoftrademarkinfringementsin2023,involvingproductssuchasintegratedcircuits,filters,reverseosmosismembranes,brandpesticidesandthefetalbovineserum,thefinancialeffectsandcompetitiveadvantagesbroughtbytherelevantbrandvaluewasgreaterthanthosebroughtbythetraditionalcommodityfi
33、eld.Severepunishmentofsuchinfringementcrimewasofgreatsignificanceforsounddevelopmentinkeyindustriesincludingchips,materials,seedsandbiomedicine.3. Occasionaloccurrenceofthesynchronizedinfringementsofthetrademarkandothermultiplerights.CommodityisthephysicalcarrieroftrademarkswhereastheIPattachedtothe
34、commoditymighthavemultipletypesnotlimitedtocommontrademarksbutinvolvinggeographicalmarksandcopyrights.4. Enhancementtocomplexityandconcealmentofthecriminalactsoftrademarkinfringement.CovertwaysofinfringementsuchaschangesinthebusinesscontentspublicityCaliberandaddingcontentsattachedtothedeliveredprod
35、uctsintermsofcounterfeitingandsalesemerged,differentfromthetraditionalmeansofdirectmarkingandlabelingontheProdlietSinthepast.(II)CharacteristicsoftheCopyrightInfringementCriminalCases1. Asignificantincreaseinhazardofthetortinthesettingofthedigitaleconomy.Criminalstookadvantageofconvenienceofwebdisse
36、mination,privacyandprecisionofdatacapturetomakeillegalprofitsbymeansofextensiveandrapiddisseminationandaccuratedeliveryoftheinfringingworks,whichcausedevenworselossesfortherightowners.2. Apparentfeaturesofcriminalgang-formingandenterprization.Criminalsusuallyformedgroupswithrelativelyfixed-numbermem
37、bers.Theyalsotendedtoperpetratetortsinthenameofenterprisessothattheycouldconfusethelegalandillegalincomesthroughdiversificationofoperations.Insomecrimes,astereotypicalupstreamanddownstreammodeof“acquisitionoftheIPworks-formingcopysamples-enteringthemarketfordistribution“wasdisplayed,wherefixedinfrin
38、gementinterestchainstookshape.3. Increasinglymorecomplicatedandconcurrentlawsandinterestsinfringedbythecrime.Theobjectofthetortwasgraduallybreakingthroughthesingle-worktypeasdefinedbytheCopyright1.awandchangingintothemulti-typeandcomplicatedrightsandinterests.Forinstance,inthecopyright-infringementc
39、asesfrequentlyoccuedrecently,ifthesoftwarecopyrightmainlyconsistsofcomputercodesfeaturingsecrecy,valueandconfidentiality,itcanalsobedeterminedasbusinesssecrets.Moreover,theutechnical-measure-circumvenlion-typccrimewasaddedincopyrightinfringementcrimeintheAmendments(XI)totheCriminal1.aw.Theforegoingc
40、rimemightbecomeconcurrentwiththetypeofillegalintrusionintothecomputerinformationsystems.(Ill)CharacteristicsoftheBusinessSecretInfringementCriminalCases1. Morediversetypesandformsoftheinfringedbusinesssecrets.Whilethetechnicalinformationincludingtechnicalplansanddesigndrawingswerestillthecommonlyinf
41、ringedtypesofbusinesssecrets,non-traditionalcasessuchasmilkteaformulaandexhibitiondesignspersistentlyoccurredinlargenumber.New-typebusinesssecretsinfringementcasesemergedintheformofthebthdesignsandconstructionservices,logisticsindustrysoftwarecodes,andthee-commerceindustryadvertisingpromotionsoftwar
42、eandsen,ices.Meanwhile,Shanghai,asaclusteroftheautomobileindustry,sawoccurrenceofanumberofcasesinvolvinginfringementofnewenergyvehiclesandintelligentvehicletechnologyinthetechnologicalrealmsuchasintelligentdriving,vehicleintelligentnavigation,intelligentcarboostersandelectronicvacuumpumps.2. Theinte
43、rnal-and-external-collusion-typecrimeremainedtobethemajortortmeanswhilenew-typetortskeptemerging.Itisthetypicalwayofthe“intcrnal-and-external-co11usion-typecrimethatthecolleaguesofaperpetratorstolethebusinesssecretsofacompanyafterthelatterhadquit,orpersonsoutsidethecompanycolludedwithemployeesofthec
44、ompanyinacquiringthebusinesssecretsbyillegalmeans.Thekhoding-typcinfringementofbusincsssecretswasregulated.ThecaseofspyingandillegallyprovidingbusinesssecretsforoverseasentityperpetratedbyMr.Zhengwasthefirstever“commercialespionage,caseinShanghaiafterimplementationoftheAmendments(XI)totheCriminal1.a
45、w.Theprocuratoratestrucksuchcrimebyaccurateapplicationofthenewchargeinaccordancewiththelaw.3. Thecrimeofbusinesssecretinfringementanditsrelatedcrimesderivedfromoneanother.Forexample,inthematterofbusinesssecretinfringement,theperpetratorYanandotherpersons,havingconcealedthefactthattheyhadjoinedanewco
46、mpany,fabricatedtheunemploymentcertificatestodefraudtheoriginalcompaniesofthenon-compctitioncompensations.TheycontravenedboththecrimeOfbusinesssecretinfringementandthatoffraudatthesametime.InanotherexamplewhereMr.Zhuandotherpersonsinfringedthebusinesssecrets,theperpetrators,withaviewtoillegallyacqui
47、ringthebusinesssecrets,illegallysignedinthetrainingaccountofCompanyAtodownloadthepersonalinfbnationoftensofthousandsofemployees.Theycontravenedboththecrimeofbusincsssecretinfringementandthatofinfringementofcitizens,personalinformationsimultaneously.III.AnAnalysisofProcuratorialCasesInvolvingCivil,Ad
48、ministrativeandPublic-interest1.itigationintheIPrealminShanghai(I) OverallSituation1. Overallreboundofthenumberofthecivilandadministrativesupervisioncases.TheprocuratoratesinShanghaitookcognizanceof30civilandadministrativesupervisioncasesin2023,up172.7%incomparisonwiththepreviousyear.Ingeneral,thenu
49、mberoftheIPcivilsupervisioncasesstillaccountedforthemajorityoftheproportion.2. Expansionofcoverageofthecausesofcivilsupervisioncases.Thecivilsupervisioncasesinvolvedninetypesofcausesatthreelevels,anincreaseofsixtypesincomparisonwith2022.Thetopthreecausesintermsofproportionindescendingorderare:disputesoverthefranchisecontract(28.6%),trademarkownershipandtort(21.4%),andcopyrightownershipandtort(14.3%).Furthermore,newtypeofcausessuchasthedisputesovertheliabilityfordamagescausedbymaliciousIPlitigationalsoemerged
