1、论宅基地使用权流转的法律问题 论宅基地使用权流转的法律问题 Legal Analysis on the Transfer of Usufruct of Rural Housing Site【中文摘要】 我国农村人口占全国的大多数,地少人多是中国的基本国情之一。对于广大农民来说,土地是财富的来源,除了用于生产的耕地,宅基地也是他们的重要财产之一。由于我国社会主义公有制的国家制度,在特殊年代的计划经济体制下,居住保障始终是宅基地使用权制度设立的价值取向,农民拥有宅基地使用权,但是其流转却受到了严格的限制。改革开放三十年,市场经济得以确立和发展。在一切都市场化的今天,农村土地的市场化成了舆论热议的焦
2、点。从土地承包经营权到农村非农建设用地使用权到宅基地使用权,无论是在理论上还是在现实生活之中,这些土地权利的流转已是大势所趋。然而,我国现行的宅基地使用权流转相关法律数量少,不明确且严重滞后,导致宅基地使用权在法律规制之外无序流转。正确处理宅基地使用权流转问题对整个社会经济的持续发展和保护农民利益意义非常重大。正是由于对农民利益的关注,笔者选择了中国农村宅基地制度研究这一现实意义的课题。本文针对农村宅基地使用权流转问题展开分析讨论。由于宅基地使用权是我国法律上一个特有的概念,所以笔者做了相关概念和特点的界定和归纳。在对宅基地使用权流转的法律规定的回顾中,探寻当时立法者的价值选择,肯定了其对集体
3、和农民利益的保护作用及其借鉴意义。在对宅基地使用权流转现状和成因的考察之后,解析现行法律的优点和缺陷。对法律供给不足带来的现实困扰,笔者试图寻找突围路径,在认为适应时代的价值选择下,提出了几点完善宅基地使用权流转制度的建议。【英文摘要】 The majority of China people live in the rural area.The fact of small average ownership of land is the basic condition of China.For most agricultural people,the rural housing site i
4、s the most important property except the arable land.But during past years,because of public ownership system of socialism of our country,housing support is lways the value orientation of the law maker.The agricultural people can live on the rural housing site,but they have no right to deal the usuf
5、ruct of the rural housing site.For the past thirty years, market-oriented economy has been established and been developing well.Everything is marketized,even the land in the rural.Whether in theory or in real life,the transfer of the right of land is an inevitable trend.However,current laws have not
6、 covered the new situation. Current laws on the rural housing site are few,unclear and lagging.So the trades on the rural housing site are running out of orders.Because of the concern on agricultural people,I choose this subject.This paper is mainly about the transfer of usufruct of rural housing si
7、te.For the Rural Housing Site is a particular concept in China,I try to define this concept and conclude the features of it.During the inspecting of the history of transfer of usufruct of rural housing site, I try to find the value orientation of the lawmakers of that time and try to sum up some val
8、uable meanings for nowadays.After inspecting the current situation of the transfer of usufruct of rural housing site and the causes of formation,I analysis the merits and faults of current laws.And at last I try to give my own suggestions on the transfer of usufruct of rural housing site,which is es
