4、cordancewiththeflightintentionoftheCHARTERER.包机人确认飞行后承运人为包机人提供包机运输合同及乘客保障信息单(客户填写内容包括航线、日期、时刻、人数、乘客姓名、证件名称、证件号码、行李重量、接送车辆、飞行各站联系人及联系方式、机上餐食要求等其他服务要求的详细信息,详见附件六)。AftertheCHARTERERhasconfirmedtheflight,theCARRIERshallprovidetheCHARTERERwithCharterFlightContractandFlightServiceInformationForm(seeAppend
5、ixVIforthecontentfilledinbytheclient,includingthespecificinformationofflightroute,dateztime,passengernumber,passengername,credentialname,credentialNo.zluggageweight,pickingupvehicle,contactpersonandcontactinformationofeachflightstation,flightcateringrequirementsandotherservicerequirements).(一)如包机人在飞
6、行过程中出现起飞时刻，飞行日期，任务航段、乘客信息、各地机场接送机联系人或车辆等一切和飞行有关的信息变更，包机人有责任第一时间通知承运人。(1) Incasethereschangeofinformationrelevanttotheflightincludingdeparturetimezflightdate,missionflightleg,passengerinformation,contractpersonforpickupserviceineachairport,orvehicle,theCHARTERERhastheresponsibilitytoinformtheCARRIERi
7、mmediately.(二)包机人应保证每位乘客持有符合中国民航现行规定的有效证件,进出境乘客应保证持有相关国家要求的有效旅行证件，国际飞行应遵守各国航空管制规定和法律规定。(2) TheCHARTERERshallguaranteethateachpassengerholdsthevalidcredentialcomplyingwiththeexistinglawsandregulationsbyChinaCivilAviation.Thecrossingpassengershallguaranteetoholdvalidtravelcredentialsrequiredbyrelevant
8、country,andinternationalflightshallfollowtheairtrafficcontrolstipulationsandlegalregulationsofeachcountry.(三)由于包机人原因(如身份证、护照等证件与本人身份不符，或携带民航W国家法律法规规定的危险品登机，或不能按合同规定时间准时登机等)包机人未能按约定时间执行或未能履行签订的飞行计划，承运人不负责因此导致未能飞行产生的后果，对于飞行计划中未执行的部分包机款，承运人应返还包机人，但包机人应承担未执行该飞行任务而产生的实际费用。(3) TheCARRIERshallbeexemptedfro
9、mtheliabilityforbreachofContractforfailuretoimplementthescheduledflightmissioninlightofthereasonscausedbytheCHARTERER(suchascredential(IDorpassport)notbeingconsistentwithonezsidentity,carryinganydangerousgoodsprohibitedbycivilaviationandstatelawsandregulations,orpassengersdelayedboarding).TheCARRIER
10、shallreturntheunimplementedcharterexpensetotheCHARTERER,butCHARTERERshallassumeanyexpensesarisingtherefrom.(四)包机人如租用多架承运人飞机,需事先将每架飞机乘坐的乘客名单提供给承运人。(4) IncasetheCHARTERERrentsmultipleaircrafts,he/sheshallprovideCARRIERwiththepassengerlistforeachaircraft.(五)根据民航有关规定，如乘客携带行李超过承运人机型限制范围，承运人可协助乘客办理地面转运或储存
11、，费用由乘客自理。如乘客坚持要求携带超额行李乘坐公务机，承运人有权拒绝起飞。如乘客携带特殊行李请提前咨询承运人。(5) Accordingtotherelevantstipulationsbycivilaviation,incasethepassengercarriestheluggageexceedingthelimitedrangeofthejettypeztheCARRIERmayassistthepassengeringroundtransferorstorageandtheexpenseshallbepaidbythepassenger.Ifthepassengerstillinsi
12、ststotaketheextraluggageonboard,thecarriershallbeentitledtorefusetoprovideflightservices.IncaseofspecialIuggagezthepassengershallconsulttheCARRIERinadvance.(六)如因承运人原因无法安排合同中原定机型执行飞行,承运人将免费为包机人升级至更高级别机型保障飞行，若因包机人拒绝机型调配，则签订的包机合同可被终止，双方承担各自的损失。承运人机型等级顺序从低到高依次为豪客系列一湾流200系列一湾流IV-湾流V-湾流450系列T达索7X一湾流55OBBJ
13、1BBJ2-ACJzzo(6)IncasetheplannedjettypeinthecontractisnotavailablebecauseoftheCARR正R,theCARR正RshallprovideahigherleveljettypefortheCHARTERER.IftheCHARTERERrefusestoacceptthejetadjustmentthecontractshallbeended.TheCHARTERERandtheCARRIERshouldassumetheirrespectiveexpensesderivingtherefrom.第六条包机人按照合同规定时
14、间支付包机款。Article 6 TheCHARTERERshallpaythecharterexpenseinaccordancewiththeContract.第七条承运人为包机人在指定保险公司承保。Article 7 TheCARRIERshallunderwritefortheCHARTERERinspecifiedinsurancecompany.第八条承运人在起飞前一天向包机联系人提供航线各机场地面代理联系方式，由各机场地面代理与包机联系人直接联系并约定飞行当日迎候乘客的时间和地点。Article 8 TheCARRIERshallprovidethechartercontactp
15、ersonwithcontactinformationofeachairportsgroundagentonedaybeforetheflight,sothegroundagentcandirectlycontactthechartercontactpersontodecidethetimeandlocationtomeetthepassengers.第九条飞行当日起飞前一至二小时确认乘客到达当地机场的时间，并通报各保障单位做好飞行前准备，根据约定的时间，机场地面代理在约定地点接引乘客进场、协助乘客办理相关入场手续。Article 9 Confirmthearrivaltimeoneortwo
16、hoursbeforethedepartureandinformallsupportunitstowellpreparefortheflightInaccordancewiththeagreedtime,theairportgroundagentmeetsandguidesthepassengerstoentertheairportatagreedlocationandhelpthemgothroughrelevantboardingprocedure.第十条执行包机飞行。Article 10 Thechartertakestheflight.第十一条飞机抵达目的地前当地地面代理提前与迎接乘客
17、的接机人取得联系，通知等候乘客的时间和地点。Article 11 Beforearrivingatthedestination,thelocalgroundagentshallcontactthepick-uppersoninadvancetoinformthepick-uptimeandlocation.第十二条飞机降落后当地机场地面代理安排乘客出场并送乘客至前来接机的车辆旁。Article 12 Aftertheaircraftislanded,thelocalairportgroundagentshallarrangethepassengerstoexittheairportandsen
18、dthemtothepick-upvehicle.第十三条飞行结束后承运人征询包机人的飞行意见，承运人在接收到包机人提出的意见或投诉后需要在5个工作日内给予包机人回复处理意见或办法。Article 13 Aftertheflight,theCARRIERshallaskCHARTERERforideasorcommentsontheflightandprovidetreatmentplanormethodwithin5workdaysafterreceivingtheopinionorcomplaint.第三章乘机手续Chapter3BoardingProcedure第十四条国内飞行乘客需要在
19、起飞前20分钟抵达起飞地机场，国际飞行乘客需要在起飞前2小时抵达起飞地机场；Article 14 Thedomesticflightpassengershallarriveattheairport20minutesbeforethedeparture,andinternationalflightpassengershallarriveattheairport2hoursbeforethedeparture.第十五条北京出港航班：送乘客车辆停在贵宾室停车场，乘客走VIP通道过安检，上贵宾摆渡车到达飞机下。Article 15 ForBeijingoutboundflights:thepick-u
20、pvehicleshallstopattheparkinglotfortheVIProom.ThepassengersgothroughthesafetyinspectionbyVIPpassageandarriveattheaircraftbyVIPshuttle.第十六条北京进港航班：乘客下飞机后上贵宾摆渡车，摆渡到机坪出口乘客接机车辆等候处。Article 16 Beijinginboundflights:aftergettingofftheaircraft,thepassengersgetontheVIPshuttleandtheshuttlesendsthemtopick-upveh
21、iclesattheexit.第十七条包机人在飞行及进出机场过程中需随身携带有效证件。Article 17 TheCHARTERERshallbringvalidcredentialalongduringflightandwhenenteringandexitingtheairport.第十八条根据中国民航乘客规定，如乘客携带贵重物品乘机，需事先在乘客保障信息单中注明所带物品清单并严格遵守国家与民航的法律法规，如未事先声明，造成的任何后果，由包机人自行承担。Article 18 InlinewithPassengerRequirementsofCivilAviationAdministrati
22、onofChina,passengersbringingpreciousitemsshallidentifythecarryingitemsinPassengerGuaranteeInformationFormandstrictlycomplywiththelawsandregulationsofChinaandcivilaviation.Ifnotstatedinadvance,theCHARTERERshallbeartheconsequencesarisingtherefrom.第十九条贵重物品的性质、价值等应符合相关的国际规定和承运人规定,如乘客携带危险品或违禁物品，造成的任何后果，由
23、包机人承担。Article 19 ThenatureandvalueofpreciousitemsshallcomplywithrelevantinternationalstipulationsandCARRIERregulations.IncasepassengerscarrydangerousgoodsorprohibiteditemsspecifiedbyPassengerRequirementsofCivilAviationAdministrationofChinaztheCHARTERERshallbeliableforanyconsequencesarisingtherefrom.
24、第二十条如乘客携带小动物，需参照中国民用航空旅客、行李国内运输规则中关于小动物的规定。Article 20 PassengerscarryingsmallanimalsinthecourseofdomesticflightsshallabidebyregulationsonliveanimalstipulatedbyChinascivilaviationpassengers,baggage,domestictransportationrules.第二十一条包机人须认真了解前往国家和地区的证件要求，并应保证每位乘机人持有有效证件。承运人可按时提醒并协助包机人办理相关证件手续，但由于包机人所提供的
25、乘客证件与本人不符、失效或不符合前往国家或地区的相关规定而导致飞行未能按合同约定时间执行或取消时，由包机人承担所有相应的责任，与承运人无关。承运人应返还包机人合同中未执行航段费用，但包机人需承担因此而产生的实际费用，所有涉及乘客相关责任的问题，包机人和承运人有义务向乘客传达。Article 21 TheCHARTERERshallensurethateachpassengerholdsvaliddocuments.IncasepassengerdocumentsprovidedbytheCHARTERERareinconsistentorinvalid,theCHARTERERshallass
26、umeallresponsibilitiesincurredbyfailingtooperatetheflightonagreedscheduleunderthecontractorflightcancellation.TheCARRIERshallrefundthefeeofunimplementedfightlegstotheCHARTERERaccordingtothecontractbuttheCHARTERERshallpaytheactualcostsarisingtherefrom.Allissuesrelatedtotheliabilitiesofpassengersshall
27、becommunicatedtopassengersbytheCHARTERERandCARRIER.第二十二条包机人所执行的航线涉及到中国境内外的相关机场时，乘客应自觉遵守相关的机场规定，如有违反而导致的法律责任和刑事责任,由乘客自行承担。Article 22 PassengersshouldconsciouslyabidebyregulationsstipulatedbyrelevantdomesticairportswheretheCHARTERERimplementstheflightroutes.Thepassengershouldbearlegalandcriminalliabil
28、itiesderivingtherefrominsuredbyhimselforherself.第二十三条包机人乘坐北京首都国际机场进出港国际航班时，需由客人本人填写中华人民共和国海关统一制作的进出境旅客行李物品申报单并签字，销售代表、乘务员、地面服务人员等均不得代客人填写；Article23TheCharterneedtofillintheChinaCustomsLuggageDeclarationFormswhenChartertakeinternationalflightsinandoutofChinabyBeijingcapitalinternationalairportzsalesr
29、epresentatives,cabincrewszgroundservicestaffsarenotallowedtofilloutInsteadofCharter.第二十四条合同中提到的儿童，是指年龄满两周岁但不满十二周岁的人。Article24Childrenmentionedinthecontractarepassengersovertwo(2)butlessthantwelve(12)yearsofage.第四章标准空中服务Chapter4StandardAirService第二十五条承运人会根据航程时刻信息，结合机型特点、乘客国籍、宗教信仰、身体状况(是否有糖尿病、高血压等)安排餐
30、食。Article 25 Basedontheflighttime,TheCARRIERwillarrangethecateringbycombiningthejettypefeatures,passengersnationality,religion,physicalcondition(whetherthere*Sdiabetesmellituszhighbloodpressure,etc).第二十六条在自身具备配餐公司的机场，参照海南航空头等舱标准配备餐食；在自身不具备配餐公司的机场，由机场代理或乘务员从星级酒店或高档餐厅外购。外购餐食受航班起飞时刻、包机人指定地点卫生条件、运输保存等条件
31、限制，承运人不承担因以上不可控情况而产生的餐食安全和质量责任。Article 26 TheairportswithcateringcompanyshallpreparethecateringbyreferringtofirstclassstandardofHainanAirlines,andairportswithoutcateringcompanyshallhavetheairportagentorflightattendantsbuyfoodfromstarhotelorfirstclassrestaurant.Outsourcingmealsischarteredflightdepart
32、uretime,designatedplacesanitation,transportation,preservationconditions,suchasmorethanthecarrierdoesnotundertakebecauseofuncontrolledsituationoffoodsafetyandqualityresponsibility.第十一章急救条款Chapter11TermsofFirstAid第六十九条执行急救飞行任务前，包机人须向承运人提交病人的医疗报告、携带医疗设备清单、呈民航局总调度室关于急救飞行航线申请函、急救飞行免责声明等材料；Article69TheCHA
33、RTERERshallprovidetheCARRIERwiththepatientsmedicalreport,listofmedicalequipmenttransport,applicationletteronfirst-aidflightroutesubmittedtothegeneralcontrolcenterofCivilAviationAdministrationofChinazandtheDisclaimerofFirst-aidFlightbeforetheimplementationoffirst-aidflightmission;第七十条在飞行过程中，如承运人发现病人的
34、病情与提交的医疗报告不符，承运人可以拒载并要求包机人承担已发生的全部费用，同时承运人保留因包机人有意隐瞒患者实际病况而引发不良后果的追偿与索赔权利；Article70IncasetheCARRIERfindsthatthepatientsconditiondoesnotconformtothesubmittedmedicalreportinthecourseofflight,theCARRIERmayrefusetotakethepassengerandrequiretheCHARTERERtopayallexpensesincurredthereof;meanwhile,theCARRIER
35、reservesclaimsofrecoveryandrightsofindemnityforadverseconsequencescausedbytheCHARTERERwhointendstoconcealtheactualconditionofthepatient;第七十一条如承运人发现包机人携带医疗设备与提交的医疗设备清单不符，承运人可以拒载并要求包机人承担已发生的全部费用；Article 71 IncasetheCARRIERfindsthatthemedicalequipmentcarriedbytheCHARTERERdoesnotconformtothesubmittedlis
36、t,theCARRIERmayrefusetotaketheequipmentandrequiretheCHARTERERtopayallexpensesincurredthereof;第七十二条急救飞行免责声明需在飞行前由患者亲属或患者授权代理人签字后提交给承运人，承运人在飞行前未收到该协议，有权拒载；Article 72 TheDisclaimerofFirst-aidFlightshallbesubmittedtotheCARRIERuponthesignatureofthepatient1srelativeorauthorizedrepresentativepriortotheflig
37、ht.TheCARRIERshallhavetherighttorefusetocarrythepatientwithouttheagreementpriortotheflight;第七十三条承运的病人如患有传染性疾病，但是不处于传染期，则应当出示医生证明以及第三方出具的非传染性证明方可承运；急救公司还应负责在急救飞行结束后对飞机进行消毒或支付消毒所需费用；Article 73 Incasethepatientsuffersfrominfectiousdiseases,butnotintheinfectiousperiod,amedicalcertificateandnon-infectiou
38、scertificateissuedbythethirdpartyshouldbesubmittedbeforetheflight;thefirst-aidcompanyshallberesponsibletosterilizetheaircraftattheendoftheflightandpaythesterilizationfee;第七十四条如急救飞行为地区或国际航线，包机人需在飞行前按照各地机场及航空局的要求提供三关函及英文的医疗报告。Article 74 Incasethefirst-aidflightisimplementedatregionalorinternationalfli
39、ghtroute,theCHARTERERshallsubmitthreerelatedlettersandmedicalreportinEnglishbeforetheflightinaccordancewiththerequirementsofcorrespondingairportandairportaviationauthority.第七十五条急救氧气瓶配备规定：Article 75 OxygenCylinderAllocationRegulation:(一)合同负责人在与包机人签订北京首都航空有限公司急救运输服务合同或上海金鹿公务航空有限公司急救运输服务合同前，应向包机人确定此次急救
40、飞行中所需每瓶氧气瓶的容量和瓶数(如需配备120升的氧气瓶2瓶，311升的氧气瓶1瓶)；(1) BeforethesigningofFirst-aidTransportationServiceContractofBeijingCapitalAirlinesCo.zLtdorFirst-aidTransportationServiceContractofShanghaiDeerJetAirlinesCo.zLtdzthechartershouldinformthecarrierofthenumberandthecapacityofoxygencylinderneeded.(Forexample,
41、120L:2;311L:D(二)合同负责人需将包机人所需氧气瓶瓶数、容量及收费金额在急救运输服务合同正文行程登记表及报价单中注明清楚；(2)ThepersoninchargeofcontractsigningshouldstateclearlythenumberandcapacityofoxygencylinderneededandthechargeamountintheFlightRouteRegistrationFormoftheFirst-aidTransportationServiceContractaswellasthequotationlist.(三)签订急救运输服务合同后，如因包
42、机人原因原定氧气瓶数量需要减少或飞行结束后尚有剩余，则承运人不退还未使用完毕的氧气瓶费用；(3)AfterthesighingoftheFirst-aidTransportationServiceContractthecartercannotreducethenumberofoxygencylinderandthecarrierwillnotrefundthechargeoftheoxygenleft.（四）签订急救运输服务合同后，如因承运人原因无法按照包机人要求提供所需氧气瓶数量，则承运人应根据最终提供的氧气瓶数量重新计算报价并签订合同，同时需将剩余氧气瓶款项退还包机人；(4)Whenthe
43、carriercannotprovideenoughoxygencylindersasrequiredbythecharterafterthesigningoftheFirst-aidTransportationServiceContractsigned,thecarriershouldrecalculatethequotationaccordingtotheoxygencylindersprovided,signanewcontract,andgivetheexcesschargebacktothecharter.(五)如因承运人原因给包机人提供的氧气瓶数量或容量与包机人预订不符(包括氧气瓶
44、瓶数少配，总氧气容量配错等)，则承运人应退还此次急救飞行氧气瓶收费总款给包机人，同时追究相关责任人责任。(5)Whenthenumberandcapacityofoxygencylinderdonotmeetchartersorderbecauseofthecarriersnegligence(forexample,thenumberisnotenoughorthetotalcapacityisincorrect),thecarriershouldgivebackallthechargeofoxygencylindertothecharter,andthepersoninchargewillg
45、etthepunishment.第七十六条急救氧气瓶收费标准:Article76ChargingStandardofFirst-aidOxygenCylinder:氧气瓶收费标准ChargingStandardofFirst-aidOxygenCylinder氧气瓶容量（升）OxygenCylinderCapacity（Liter）收费标准（元/瓶）第十二章卫星通信收费标准Chapter12ChargeStandardforSatelliteCommunicationService第七十七条适用范围：我司航空各机型机上卫星电话及无线网络使用收费。Article 77 Thisstandardi
46、sappliedtothesatellitephoneandwirelessnetworkservicesavailableoneachflightofmycompany.第七十八条卫星通信收费标准Article 78 ChargeStandardfortheSatelliteCommunication备注:不到15分钟按照15分钟计算，如通话时长为20分钟，按照30分钟收费，即收取2600元；Note:Therateischargedby15minutesevenifthecallislessthen15minutes.Ifthecalllastsfor20minuteszitwillbec
47、hargedbasedon30minutes,thatisRMB2600.如包机人支付美金，则按照卫星电话使用当天承运人适时美金：人民币汇率进行折算。IfthecharterpaysinUSD,thecharterwillbechargedbasedonthecurrentUSD:RMBexchangeratethedayheusesthesatellitephone.卫星通信设备使用记录及费用确认单见附件九。RecordsandFeeConfirmationSheetoftheSatelliteCommunicationDeviceseeattachment.Article 79 Payme
48、ntRulesfortheSatelliteCommunication（一）按照规定如包机人应付而逾期未付的款项,承运人有权自包机人超过约定付款期限的第一日起向包机人收取滞纳金，日收取滞纳金比例为未付款项的千分之五（5%。）;(1) Ifthecharterfailstopaytheunduepaymentasrequired,thecarrierisentitledtochargetheoverduefinetothecharterfromthefirstoverdueday.Thedailyoverduefineis5%ooftheundueamount;（二）如因承运人原因（如临时调换飞机且调换后的飞机上无卫星通信设备或发生机上卫星电话故障等情况），则承运人应退还包机人预付的卫星通信费；(2) Ifthecarrierfailstoprovidethesatelliteservice(nosuchdeviceonthechangedflightorthedevicedoesnztwork),thecarriershallreturntheadvancedpaymenttothecharter;(三)如因包机人原因(如预付费后未使用卫星电话)，则承运人不予退还预付卫星通信费给包机人。(3) Thecarrie
