1、工程合同中有关项目经理的条款中英文对照版工程合同中有关项目经理的条款TheProjectManager:Therepresentativeasappointedbythecontractortoberesponsiblefortheconstructionmanagementandperformanceofthecontract.项目经理：指承包人指定的负责施工管理和合同履行的代表。授权项目经理为先生TheauthorizedprojectmanagerisMr.项目经理应为合同当事人所确认的人选，并在专用合同条款中明确项目经理的姓名、职称、注册执业证书编号、联系方式及授权范围等事项,项目经理
2、经承包人授权后代表承包人负责履行合同。Projectmanagershouldbethepersonwhoisconfirmedbythepartiestheretoandbeclearlystipulatedintheparticularconditionsofcontractwithhisname,professionaltitle,numberofprofessionregistrationcertificate,contactmeans,authorizationscopeandsoon,who,uponauthorizationofthecontractor,mayperformth
3、econtractonbehalfofthecontractor.项目经理应是承包人正式聘用的员工，承包人应向发包人提交项目经理与承包人之间的劳动合同，以及承包人为项目经理缴纳社会保险的有效证明。承包人不提交上述文件的，项目经理无权履行职责，发包人有权要求更换项目经理，由此增加的费用和（或感误的工期由承包人承担。Projectmanagershouldtheformalemployeebythecontractor,withwhomthecontractorshouldsubmittheemployerwiththelaborcontractandtheeffectiveproofofsoci
4、alinsuranceforprojectmanager.Wherefailureofthecontractorssubmissionofthedocumentsabove,projectmanagerhasnorightstoperformitsdutiesandemployerisentitletorequirereplacementofprojectmanager,theexpenseand/ordelayedworktimearisingtherefromshouldbeassumedbythecontractor.项目经理应常驻施工现场,且每月在施工现场时间不得少于专用合同条款约定的
5、天数。项目经理不得同时担任其他项目的项目经理。项目经理确需离开施工现场时，应事先通知监理人，并取得发包人的书面同意。项目经理的通知中应当载明临时代行其职责的人员的注册执业资格、管理经验等资料，该人员应具备履行相应职责的能力。Projectmanagershouldberesidentinworksiteatwhichthedaysshouldnotbelessthesamestipulatedinparticularconditionsofcontract,andcannotassumethedutyofprojectmanagerinotherprojectatsametime.Whenpr
6、ojectmanagerneedtoleavethesite,heshouldnotifythesupervisorinadvanceandobtainthewrittenconsentfromtheemployer.Thenoticeofprojectmanagershouldstipulatetheregisteredprofessionalqualification,managementexperienceandotherinformationofthepersonnelwhoistemporarilyassumethedutiesofprojectmanager,whoshallhav
7、etheabilityofperformthecorrespondingdutiesandliabilities.项目经理按合同约定组织工程实施。在紧急情况下为确保施工安全和人员安全，在无法与发包人代表和总监理工程师及时取得联系时，项目经理有权采取必要的措施保证与工程有关的人身、财产和工程的安全，但应在48小时内向发包人代表和总监理工程师提交书面报告。Projectmanagershallorganizetheexecutionofworkpursuanttothestipulationsofcontract.Incaseofemergency,projectmanagerisentitle,
8、ifunabletoconnectintimewiththeemployersrepresentativeandchiefsupervisor,totakenecessarymeasurestoensurethesafetyofpersonnel,propertiesandworksconcerningtotheproject,neverthelessshould,within48hourssubmitthewrittenreportthereoftotheemployersrepresentativeandchiefsupervisor.承包人需要更换项目经理的，应提前14天书面通知发包人和
9、监理人，并征得发包人书面同意。通知中应当载明继任项目经理的注册执业资格、管理经验等资料，继任项目经理继续履行第3.2.1项约定的职责。未经发包人书面同意，承包人不得擅自更换项目经理。承包人擅自更换项目经理的，应按照专用合同条款的约定承担违约责任。Thecontractorshould,providedthatifneedtoreplacetheprojectmanager,submittheadvance14day,snoticeinwritingtotheemployerandthesupervisorandobtainthewrittenconsentfromtheemployer.The

11、ssumethebreachliabilitiespursuanttotheprovisionsofparticularconditionshereof.发包人有权书面通知承包人更换其认为不称职的项目经理,通知中应当载明要求更换的理由。承包人应在接到更换通知后14天内向发包人提出书面的改进报告。发包人收到改进报告后仍要求更换的，承包人应在接到第二次更换通知的28天内进行更换，并将新任命的项目经理的注册执业资格、管理经验等资料书面通知发包人。继任项目经理继续履行第321项约定的职责。承包人无正当理由拒绝更换项目经理的，应按照专用合同条款的约定承担违约责任。Theemployerisentitle
12、dtorequirethecontractorinwrittennoticetoreplacetheprojectmanagerwhomisdeemedtobeincompetentandshallspecifyinthenoticethereasonsforreplacement.Thecontractorshall,within14daysuponreceiptofreplacenotice,providetheemployerwithimprovementreportinwriting.Wheretheemployershall,uponreceiptofimprovementrepor
13、t,stillrequiretoreplacement,thecontractorshouldeffectthereplacementwithin28daysfollowingreceiptofsecondnotificationofreplacement,andprovidetheinformationofnewlyappointedprojectmanagersregisteredpracticequalification,managementexperienceandothertotheemployer.TheSuccedentprojectmanagerwillcontinueperf
14、ormanceofthedutiesandliabilitiesassetinarticle3.2.1.Theemployerwill,ifwithoutreasonableexcusestorefusethereplacement,assumethebreachliabilitypursuanttotheprovisionsofparticularconditionshereof.项目经理因特殊情况授权其下属人员履行其某项工作职责的，该下属人员应具备履行相应职责的能力，并应提前7天将上述人员的姓名和授权范围书面通知监理人，并征得发包人书面同意。Providedthatifduetocerta

18、ssor,SrightsandobligationsassetoutintheContract.发包人已确认的项目经理原则上不能更换；如承包人如有充分的理由需要更换项目经理，应至少提前7天以书面形式通知发包人，并征得发包人同意。后任继续行使本合同约定的前任的权利，履行前任的义务。TheEmployerhastherighttorequiretheContractortoreplacetheProjectManagerdeemedasincompetentbytheEmployer.TheContractorshallprovideanewcompetentProjectManagerwithi
19、n2daysafterreceivingthewritingnoticefromtheEmployer.发包人有权要求承包人更换其认为不称职的项目经理。承包人应在收到发包人书面通知的两天内提供新的称职的项目经理。合同签署后，承包商应指定一名项目经理，在工程进行过程中全权代表承包商。他将在工作时间内坐镇施工现场。业主向项目经理发出的所有指示，如同发给承包商本人一样，同样具有约束力。OnsigningtheContract,theContractorshallappointaprojectmanagerwhowillrepresenttheContractoratalltimesbepresentattheSiteduringworkinghours.AllcommunicationsissuedbytheOwnertotheprojectmanagershallbebindingasifgiventotheContractor.TheEmployermayreplacetheProjectManagerortheSupervisorafterhehasnotifiedtheContractorofthenameofthereplacement.在替换人选通知承包商后，雇主可撤换项目经理或监理工程师。
