5、文 明建设，促进人与自然和谐共生， 根据中华人民共和国野生动物保 护法等有关法律、行政法规的规 定，结合本市实际，制定本条例。第二条在本市行政区域内从 事野生动物保护及相关活动，适用 本条例。本条例规定保护的野生动物，包括 经国务院批准公布的国家重点保护 野生动物，国务院野生动物保护主 管部门公布的有重要生态、科学、 社会价值的陆生野生动物，以及市 人民政府公布的地方重点保护野生 动物。本条例规定的野生动物及其制品， 是指野生动物的整体（含卵、蛋）、 部分及衍生物。珍贵、濒危的水生野生动物以外的 其他水生野生动物的保护，适用中 华人民共和国渔业法等有关法律 的规定。第三条野生动物保护工作遵 循
6、保护优先、规范利用、严格监管、 社会共治的原则，加强重要生态系 统保护和修复，鼓励和支持开展野 生动物科学研究与应用，秉持生态 文明理念，推动绿色发展。Article1Withaviewtoconservingwildanimals,savingrareandendangeredspeciesofwildanimals,maintainingbiologicaldiversityandecologicalbalance,advancingecologicalcivilization,andpromotingtheharmoniousco-existencebetweenhumanityandn
7、ature,theseRegulationsareformulatedinaccordancewiththeWildAnimalConservationLawofthePeoplesRepublicofChinaandotherrelevantlawsandadministrativerulesandinthelightoftheactualcircumstancesofthisMunicipality.Article2TheseRegulationsshallapplytotheconservationofwildanimalsandassociatedactivitieswithinthe
8、administrativeareaofthisMunicipality.ThewildanimalsunderconservationprescribedintheseRegulationsincludethewildanimalsunderstatepriorityconservationapprovedandpublishedbytheStateCouncil,theterrestrialwildanimalsofsignificantecological,scientificorsocialvaluepublishedbythecompetentdepartmentofwildanim
9、alconservationoftheStateCouncil(hereinaftertheuwildanimalconservationdepartmen),andthewildanimalsunderlocalpriorityconservationpublishedbytheMunicipalPeoplesGovernment.“WildanimalsandtheirProdUCts“intheseRegulationsmeanthewhole(includingspawnsandeggs),thepartsandderivativesofwildanimals.Theconservat
10、ionofaquaticwildanimalsotherthantherareandendangeredspeciesofaquaticwildanimalsshallbegovernedbytheFisheriesLawofthePeoplesRepublicofChinaandotherrelevantlaws.Article3Theconservationofwildanimalsshallfollowtheprinciplesofconservationfirst,regulatedutilization,stringentsupervisionandjointsocialgovern
11、ance0,strengthentheprotectionandrestorationofimportantecosystems,encourageandsupportscientificresearchandapplicationofwildanimals,upholdthephilosophyofecologicalcivilization,andpromotegreendevelopment.Article4Themunicipalanddistrictpeoplesgovernmentsshallstrengthentheirleadershipoverthewildanimalcon
12、servationwork,drawupplanningandmeasuresforconservingwildanimalsandtheirhabitats,andincludethewildanimalconservationexpensesintheirbudgets.Article5Thedepartmentsofforestryandagricultureandruralaffairs(hereinaftercollectivelyreferredtoasthe,wildanimalconservationdepartmen)shallbeinchargeoftheconservat
13、ionofterrestrialandaquaticwildanimalswithintheirrespectiveadministrativeareas.Thedepartmentsofdevelopmentandreform,marketregulation,publicsecurity,transport,planningandresources,ecologyandenvironment,wateraffairs(ocean),education,postaladministration,urbanmanagementandlawenforcement,etc.shall,accord
14、ingtothedivisionoftheirfunctions,takechargeoftheconservationofwildanimals.Article6Conservationofwildanimalsandtheirhabitatsisthecommonresponsibilityofthewholesociety.Itisprohibitedtoillegallyhunt,catch,transportortradeinwildanimalsortoengageinotherprohibitedacts.Itisprohibitedtodestroythehabitatsofw
15、ildanimals.Allorganizationsandindividualsshallconscientiouslyobservethestateandmunicipallawsandrulesonwildanimalconservation,enhancetheirawarenessofconservingwildanimalsandsafeguardingpublichealthsafety,preventthespreadofwildanimal-borneinfectiousdiseases,resistillegaleatingofwildanimals,andcultivat
16、eacivilizedandhealthylifestyle.第四条市、区人民政府应当 加强对野生动物保护工作的领导， 制定野生动物及其栖息地相关保护 规划和措施，将野生动物保护经费 纳入预算。第五条 林业部门、农业农村 部门（以下统称“野生动物保护主 管部门”）分别主管本行政区域内 陆生、水生野生动物保护工作。发展改革、市场监管、公安、交通、 规划资源、生态环境、水务（海洋）、 教育、邮政和城管执法等部门按照 职责分工，负责野生动物保护相关 工作。第六条保护野生动物及其栖 息地是全社会的共同责任。禁止违 法猎捕、运输、交易野生动物以及 从事法律法规规定的其他禁止性行 为，禁止破坏野生动物栖息
17、地。任何组织和个人应当自觉遵守国家 和本市野生动物保护法律法规，增 强保护野生动物和维护公共卫生安 全的意识，防止野生动物源性传染 病传播，抵制违法食用野生动物， 养成文明健康的生活方式。第七条本市各级人民政府应 当加强野生动物保护的宣传教育和 科学知识普及工作，鼓励和支持基 层群众性自治组织、社会组织、企 业事业单位、志愿者开展野生动物 保护法律法规、生态保护等知识的 宣传活动；组织开展对相关从业人 员法律法规和专业知识培训；依法 公开野生动物保护和管理信息。Article7ThepeoplesgovernmentsatalllevelsofthisMunicipalityshallstre
18、ngthenthepublicity,education,andpopularizationofscienceonwildanimalconservation,andencourageandsupportactivitiesofpublicizingthewildanimalconservationlawsandrulesandtheecologicalprotectionknowledgeconductedbythegrassrootsmassautonomousorganizations,socialorganizations,enterprises,publicinstitutions,
19、andvolunteers;shallorganizethetrainingofrelevantpractitionersonthelawsandrulesandprofessionalknowledge;andshalldisclosetothepublicthewildanimalconservationandmanagementinformationinaccordancewiththelaw.Educationdepartmentsandschoolsshalleducatestudentsonwildanimalconservationknowledge.Newsmediashall
20、conductpublicityofthewildanimalconservationlaws,rulesandknowledge,andlegallyusepublicopinionstosuperviseillegalacts.ThisMunicipalitydeterminesthatNovemberofeveryyearisthemonthofwildanimalconservationpublicity,andthesecondweekinAprilisthebird-lovingweek.Article8Anexpertcommitteeforwildanimalconservat
21、ionshallbeestablishedinthisMunicipalitytoprovideadviceontheformulationandadjustmentofthelistofwildanimalsandtheirhabitats,drawingupconservationplanningandmeasures,andpreventionandcontrolofsafetyrisks,etc.Article9ThisMunicipalityencouragescitizens,legalpersons,andotherorganizationstoparticipateinwild
22、animalconservationactivitiesbydonations,financialaids,voluntaryservicesandothermeansinaccordancewiththelaw,andsupportspublicundertakingsforwildanimalconservation.Organizationsandindividualsthathavemaderemarkableachievementsinwildanimalconservationorresearchshallbecommendedandrewardedinaccordancewith
23、theprovisions.Article10ThewildanimalconservationdepartmentofShanghaishallestablishamechanismofcommunicationandcoordinationwiththeircounterpartsintheprovincesandcitiesintheYangtzeRiverDelta,withfocusontheinvestigationofwildanimalsandtheirhabitatresourcesinadjacentareas,theprotectionofspecificwildlife
24、species,andthehandlingofemergencies,aswellasonstrengtheninglawenforcementcoordinationandcooperation,includingsuchtasksascasejurisdictionandtransfer,investigationoutsideofonesjurisdiction,disputesettlement,discretionbenchmark,connectivitybetweenadministrativeandlegalenforcement,andreportsoftheresults
25、,etc.教育部门、学校应当对学生进行野 生动物保护知识教育。新闻媒体应当开展野生动物保护法 律法规和保护知识的宣传，并依法 对违法行为进行舆论监督。本市确定每年11月为保护野生动物 宣传月，4月的第二周为爱鸟周。第八条本市建立野生动物保 护专家委员会，为有关野生动物及 其栖息地名录制定和调整、保护规 划和措施制定、安全风险防控等提 供咨询意见。第九条 本市鼓励公民、法人 和其他组织依法通过捐赠、资助、 志愿服务等方式参与野生动物保护 活动，支持野生动物保护公益事业。对在野生动物保护和科学研究方面 成绩显著的组织和个人，按照规定 给予表彰和奖励。第十条野生动物保护主管部 门应当与长江三角洲区域
26、相关省、 市野生动物保护主管部门建立沟通 协调机制，重点在毗邻地区野生动 物及其栖息地资源调查、特定野生 动物物种保护、突发事件处置，以 及案件管辖移送、异地调查、争议 解决、裁量基准、行刑衔接、结果 通报等执法方面加强协同合作。第二章野生动物及其栖息地保护Chapter II ConservationofWildAnimalsandTheirHabitatsArticle 11 ThisMunicipalityshallstepupitsconservationofwildanimalsandtheirhabitats.ThisMunicipalityshallconduct,inaccor
27、dancewiththelaw,categorizedandgradedconsen/ationofthewildanimalsinthelistofwildanimalsunderstatepriorityconservation,thewildanimalsinthelistofterrestrialwildanimalsofsignificantecological,scientificorsocialvalue,andthewildanimalsinthelistofwildanimalsunderlocalpriorityconservation.ThisMunicipalitysh
28、all,inaccordancewiththelaw,conservewildanimalhabitats,establishandimprovetheadministrativesystemforthemunicipallistofwildanimalhabitats,andstrengthentheprotection,restorationandimprovementoftheenvironmentofthewildanimalhabitats.Article 12 Thelistofthewildanimalsunderlocalpriorityconservationshallbed
29、raftedbythemunicipalwildanimalconservationdepartment,andundergothescientificreviewandassessmentorganizedbytheMunicipalPeoplesGovernmentaccordingtolaw,andshallbeformulatedandpublishedonlyafterobtainingtheapprovaloftheStateCouncilwildanimalconservationdepartment.Thelistofthewildanimalsunderlocalpriori
30、tyconservationshallbesubjecttoscientificreviewandassessmenteveryfiveyears,maybeadjustedaccordingtotheresultsofthereviewandassessment,andmaybeadjustedinatimelymanneraccordingtotheactualneedsforwildanimalconservation.第十一条本市加强对野生动 物及其栖息地的保护。本市依法对纳入国家重点保护野生 动物名录和有重要生态、科学、社 会价值的陆生野生动物名录的野生 动物，以及纳入地方重点保护野
31、生 动物名录的野生动物，实行分类分 级保护。本市依法对野生动物重要栖息地予 以保护，并建立和完善市野生动物 栖息地名录管理制度，加强对野生 动物栖息地环境的保护、修复和改 善。第十二条地方重点保护野生 动物名录由市野生动物保护主管部 门拟订，依法经市人民政府组织科 学论证评估，并征求国务院野生动 物保护主管部门意见后制定、公布。地方重点保护野生动物名录应当每 五年组织科学论证评估，根据论证 评估情况进行调整，也可以根据野 生动物保护的实际需要及时进行调 整。第十三条野生动物保护主管 部门应当加强信息技术应用，按照 国家和本市有关规定，定期组织或 者委托有关科学研究机构对野生动 物及其栖息地状况
32、进行调查、监测 和评估，建立健全野生动物及其栖 息地档案。Article 13 Thewildanimalconservationdepartmentshallstrengthentheapplicationofinformationtechnologies,and,inaccordancewiththestateandmunicipalprovisions,organizeorauthorizerelevantscientificresearchinstitutionstoconductsurvey,monitoringandassessmentofthestatusofwildanimal
33、sandtheirhabitatsonaregularbasis,andestablishandimprovethearchivesofwildanimalsandtheirhabitats.第十四条 市野生动物保护主 管部门应当会同市发展改革、规划 资源、生态环境、水务（海洋）、 交通等有关部门以及相关区人民政 府，根据调查、监测和评估结果， 对拟列入市野生动物栖息地名录的 野生动物栖息地编制保护方案。野 生动物栖息地保护方案应当包括实 施主体、位置面积、实施目标、修 复要求和保障措施等内容。野生动物保护主管部门和其他有关 部门应当按照野生动物栖息地保护 方案的要求，采取原生植被保护恢 复、
34、水生态功能优化、外来入侵物 种防治以及特定野生动物重引入等 措施，对原生状态退化的野生动物 栖息地进行修复，提升野生动物生 存环境质量。第十五条市野生动物保护主 管部门应当对野生动物栖息地修复 成效进行评估；经评估，符合野生 动物栖息地保护方案要求的，列入 市野生动物栖息地名录并向社会公 布。市野生动物保护主管部门应当定期 组织对市野生动物栖息地状况进行 评估，根据评估情况对名录进行调 整，也可以根据实际需要适时调整。第十六条市野生动物保护主 管部门应当制定市野生动物栖息地 维护技术规范。Article 14 Themunicipalwildanimalconservationdepartme
35、ntshall,jointlywiththemunicipaldepartmentsofdevelopmentandreform,planningandresources,ecologyandenvironment,wateraffairs(ocean),transport,etc.aswellastherelevantdistrictpeople,sgovernment,andaccordingtotheresultsoftheinvestigation,monitoringandassessment,drawupaplanforconservingthewildanimalhabitats
36、ifitplanstoincludetheminthemunicipallistofwildanimalhabitats.Theplanforconservingthewildanimalhabitatsshallincludetheimplementingentity,location,area,targets,requirementsfortherestoration,guaranteemeasures,amongothers.Thewildanimalconservationdepartmentandotherrelevantdepartmentsshall,accordingtothe
37、requirementsoftheplanforconservingwildanimalsandtheirhabitats,adoptsuchmeasuresasnativevegetation,waterecologyoptimization,alieninvasivespeciespreventionandtreatment,re-introductionofspecificwildanimals,torepairthedegradationoftheoriginalstateofwildanimalhabitatsandimprovetheenvironmentforwildanimal
38、s.Article 15 Themunicipalwildanimalconservationdepartmentshallassesstheresultoftherepairofthewildanimalhabitats.Ifthesehabitatsconformtotheplanforconservingwildanimalhabitatsupontheassessment,theymaybeincludedinthemunicipallistofwildanimalhabitatsandbepublished.Themunicipalwildanimalconservationdepa
39、rtmentshallorganizeregularassessmentofthemunicipalwildanimalhabitats,andadjustthelistaccordingtotheassessmentresults,andmayalsoadjustthelistaccordingtotheactualneeds.Article 16 Themunicipalwildanimalconservationdepartmentshallformulatethetechnicalnormsforthemunicipalwildanimalhabitats.区野生动物保护主管部门应当按
40、照 有关规定以及市野生动物栖息地维 护技术规范等要求，做好本行政区 域内市野生动物栖息地的维护管理 工作。区野生动物保护主管部门可 以委托具有相应能力的单位实施具 体维护。区野生动物保护主管部门应当在市 野生动物栖息地设置保护标识牌以 及必要的保护、监测等设施设备， 并根据需要设置科普设施。第十七条在市野生动物栖息 地内从事的活动应当有利于保护、 恢复、改善野生动物生存环境。在市野生动物栖息地内，禁止开挖 取土、阻断水源等破坏野生动物栖 息地的行为；禁止破坏、损毁有关 保护、监测和科普等设施设备。第十八条根据市野生动物栖 息地的实际情况，可以在市野生动 物栖息地内开展科学考察、科普教 育、自然
41、观光等特色活动。野生动 物保护主管部门应当加强对有关活 动的指导、监督，提升市野生动物 栖息地生态服务功能，促进与周边 社区的协调发展。Thedistrictwildanimalconservationdepartmentsshall,inaccordancewiththerelevantprovisionsandtheaforesaidtechnicalnorms,conductpropermaintenanceandmanagementofthemunicipalwildanimalhabitatswithintheirownadministrativearea.Adistrictwild
42、animalconservationdepartmentmayentrustanentitywiththecorrespondingcapabilitytomaintainthehabitats.Thedistrictwildanimalconservationdepartmentsshallsetupprotectionsignboardsandnecessaryprotectiveandmonitoringfacilitiesinthemunicipalwildanimalhabitats,andmaysetupsciencepopularizationfacilitieswherenec
43、essary.Article 17 Activitiesinthemunicipalwildanimalhabitatsshallbeconducivetotheconservation,restorationandimprovementoftheenvironmentforwildanimals.Inthemunicipalwildanimalhabitats,suchhabitat-destroyingactivitiesasexcavationforearthandobstructionofwatersourcesareprohibited.Itisalsoprohibitedtodes
44、troyordamagetheprotective,monitoringandscience-popularizationfacilities.Article 18 Inthelightoftheactualcircumstancesofthemunicipalwildanimalhabitats,specialactivitiessuchasscientificinvestigation,popularscienceeducation,andnaturesightseeingmaybeconducted.Thewildanimalconservationdepartmentshallstre
45、ngthentheirguidanceandsupervisionoversuchactivities,upgradetheecologicalservicesofthemunicipalwildanimalhabitats,andpromotesynergeticdevelopmentwiththeneighboringcommunities.第十九条机场、铁路、公路、 航道、水利水电、风电、光伏发电、 围堰、围填海等建设项目的选址选 线，应当充分考虑野生动物及其栖 息地保护的需要，避让自然保护地 以及其他野生动物重要栖息地、市 野生动物栖息地、迁徙洞游通道； 确实无法避让的，应当采取措施，
46、 消除或者减少对野生动物及其栖息 地的不利影响，野生动物保护主管 部门应当给予指导。建设项目可能对自然保护地以及其 他野生动物重要栖息地、迁徙洞游 通道产生影响的，按照国家规定执 行。建设项目可能对市野生动物栖 息地产生影响的，规划资源部门应 当就建设工程设计方案征求市野生 动物保护主管部门的意见。第二十条 本市加强野生动物 收容救护能力建设。野生动物保护 主管部门应当按照国家和本市有关 规定，明确野生动物收容救护机构， 组织开展野生动物收容救护工作。野生动物收容救护机构应当根据实 际需要，建立收容救护场所，配备 相应的专业技术人员、救护工具、 设备和药品等，对单位和个人移送 的以及其他需要收
47、容救护的野生动 物进行收容救护。野生动物收容救 护机构及收容救护场所信息，由市 野生动物保护主管部门向社会公 布。Article 19 Theselectionofsitesandlinesforairport,railway,highway,waterway,waterconservancyandhydropower,windpower,photovoltaicpowergeneration,cofferdams,seareclamation,andotherconstructionprojectsshalltakeintoconsiderationtheneedtoprotectwilda
48、nimalsandtheirhabitats,andavoidaffectingnaturereserves,otherimportantwildanimalhabitats,nationalandmunicipalwildanimalhabitats,andmigrationroutesofwildanimals,Iftheavoidancethereofistrulyimpossible,measuresshallbetakentoreducetheadverseimpactsonwildanimalsandtheirhabits,andthewildanimalconservationd
49、epartmentshallrenderguidance.Whereaconstructionprojectmayaffectnaturereserves,otherimportantwildanimalhabitats,orwild-animalmigrationroutes,itshallbeimplementedinaccordancewiththestateprovisions.Whereaconstructionprojectmayaffectamunicipalwildanimalhabitat,thedepartmentofplanningandresourcesshallsolicittheopinionofthemunicipalwildanimalconserva
