4、,国家科学技术奖励条例(1999年5月23日中华人民共和国国务院令第265号发布根据2003年12月20日国务院关于修改国家科学技术奖励条例的决定第一次修订根据2013年7月18日国 务院关于废止和修改部分行 政法规的决定第二次修订 2020年10月7日中华人民共 和国国务院令第731号第三次 修订）第一章总 则第一条 为了奖励在科 学技术进步活动中做出突出 贡献的个人、组织，调动科学 技术工作者的积极性和创造 性，建设创新型国家和世界科 技强国，根据中华人民共和 国科学技术进步法，制定本 条例。第二条国务院设立下 列国家科学技术奖：（一）国家最高科学技术奖；（二）国家自然科学奖；（三）国家技
5、术发明奖；（四）国家科学技术进步奖；（五）中华人民共和国国际科 学技术合作奖。第三条国家科学技术 奖应当与国家重大战略需要 和中长期科技发展规划紧密2003,revisedforthesecondtimeinaccordancewiththeDecisionoftheStateCounciltoRepealandAmendCertainAdministrativeRegulationsonJuly18,2013,andrevisedforthethirdtimeinaccordancewiththeOrderNo.731oftheStateCouncilofthePeoplesRepublic
6、ofChinaonOctober7,2020)ChapterIGeneralProvisionsArticle1Forthepurposesofrewardingtheindividualsandorganizationsthathavemadeoutstandingcontributionsinscientificandtechnologicalprogressactivities,mobilizingtheenthusiasmandcreativityofscientificandtechnologicalworkers,andbuildinganinnovation-orientedco
7、untryandaglobalsuperpowerinscienceandtechnology,thisRegulationisdevelopedinaccordancewiththeLawofthePeoplesRepublicofChinaonScientificandTechnologicalProgress.Article2TheStateCouncilestablishesthefollowingnationalscienceandtechnologyawards:(1)StatePreeminentScienceandTechnologyAward.StateNaturalScie
8、nceAward.(3) StateTechnologicalInventionAward.(4) StateScientificandTechnologicalProgressAward.(5) ChinaInternationalScienceandTechnologyCooperationAward.Article 3 Nationalscienceandtechnologyawardsshallbecloselyintegratedwiththemajorstrategicneedsandmediumandlong-termscientificandtechnologicaldevel
9、opmentplansofthestate.Thestateincreasesrewardsforfundamentalresearchinnaturalsciencesandappliedfundamentalresearch.TheStateNaturalScienceAwardshallfocusonforesightandtheoreticalproperty,theStateTechnologicalInventionAwardshallfocusonoriginalityandpracticality,andtheStateScientificandTechnologicalPro
10、gressAwardshallfocusoninnovationandeffectiveness.Article 4 TheworkconcerningnationalscienceandtechnologyawardsshalladheretotheleadershipoftheCommunistPartyofChina,implementtheinnovation-drivendevelopmentstrategy,implementthepoliciesof“respectinglabor,knowledge,talentsandcreation,jandcultivateandprac
11、ticesocialistcorevalues.Article5Thestatemaintainstheimpartiality,seriousness,authorityandhonorofnationalscienceandtechnologyawards,andconfernationalscienceandtechnologyawardsonthescientificandtechnicalworkerswhoseekthetruth,concentrateonresearch,areproficientinspecialties,conductspecialresearch,dare
12、toovercome,andbravelyscalenewheights.Thenomination,reviewandconfermentofnationalscienceandtechnologyawardsshallnotbeinterferedwithbyanyorganizationorindividual.结合。国家加大对自然科学基 础研究和应用基础研究的奖 励。国家自然科学奖应当注重 前瞻性、理论性，国家技术发 明奖应当注重原创性、实用 性，国家科学技术进步奖应当 注重创新性、效益性。第四条国家科学技术 奖励工作坚持中国共产党领 导，实施创新驱动发展战略， 贯彻尊重劳动、尊重知识
13、、尊 重人才、尊重创造的方针，培 育和践行社会主义核心价值 观。第五条国家维护国家 科学技术奖的公正性、严肃 性、权威性和荣誉性，将国家 科学技术奖授予追求真理、潜 心研究、学有所长、研有所专、 敢于超越、勇攀高峰的科技工 作者。国家科学技术奖的提名、评审 和授予，不受任何组织或者个 人干涉。第六条国务院科学技 术行政部门负责国家科学技 术奖的相关办法制定和评审 活动的组织工作。对涉及国家 安全的项目，应当采取严格的 保密措施。Article6ThescienceandtechnologyadministrativedepartmentoftheStateCouncilshallberespo
14、nsibleforthedevelopmentoftherelevantmeasuresfornationalscienceandtechnologyawardsandtheorganizationofreviewactivities.Forprojectsinvolvingnationalsecurity,strictsecrecymeasuresshallbetaken.Nationalscienceandtechnologyawardsshallbesubjecttomerit-basedadministration.Article7ThestateestablishestheState
15、ScienceandTechnologyAwardsCommission.TheStateScienceandTechnologyAwardsCommissioninvitesexpertsandscholarsinrelevantaspectstoformthereviewcommitteeandthesupervisioncommitteetotakechargeofthereviewandsupervisionofnationalscienceandtechnologyawards.ThemembersoftheStateScienceandTechnologyAwardsCommiss
16、ionshallbenominatedbythescienceandtechnologyadministrativedepartmentoftheStateCouncilandbereportedtotheStateCouncilforapproval.ChapterIlEstablishmentofNationalScienceandTechnologyAwardsArticle8TheStatePreeminentScienceandTechnologyAwardisconferredonthefollowingChinesecitizens:(1) Thosewhohavemademaj
17、orbreakthroughsincontemporaryscientificortechnologicalfrontiersorhaveoutstandingachievementsinthedevelopmentofscienceandtechnology.(2) Thosewhohavecreatedhugeeconomicorsocialbenefitsorecologyandenvironmentbenefitsormadegreatcontributionstomaintainingnationalsecurityinscientificandtechnologicalinnova
18、tions,transformationofscientificandtechnologicalachievements,andhigh-techindustrialization.国家科学技术奖励应当实施 绩效管理。第七条国家设立国家 科学技术奖励委员会。国家科 学技术奖励委员会聘请有关 方面的专家、学者等组成评审 委员会和监督委员会，负责国 家科学技术奖的评审和监督 工作。国家科学技术奖励委员会的 组成人员人选由国务院科学 技术行政部门提出，报国务院 批准。第二章国家科学技术奖的 设置第八条国家最高科学 技术奖授予下列中国公民：（一）在当代科学技术前沿取 得重大突破或者在科学技术 发展中有
19、卓越建树的；（二）在科学技术创新、科学 技术成果转化和高技术产业 化中，创造巨大经济效益、社 会效益、生态环境效益或者对 维护国家安全做出巨大贡献 的。国家最高科学技术奖不分等 级，每次授予人数不超过2名。TheStatePreeminentScienceandTechnologyAwardhasnodistinctioninawardgrades,andshallbegrantedtonomorethantwopersonseachtime.Article9TheStateNaturalScienceAwardisconferredonindividualswhohavemademajors
20、cientificdiscoveriesinclarifyingnaturalphenomena,characteristicsandrulesinfundamentalresearchandappliedfundamentalresearch.uMajorscientificdiscoveriesnasmentionedintheprecedingparagraphshallmeetthefollowingconditions:(1) Havingnotbeendiscoveredorelaboratedbyanyforerunner.(2) Havinggreatscientificval
21、ue.(3) Havingbeenrecognizedbythenaturalsciencecommunitiesathomeandabroad.Article10TheStateTechnologicalInventionAwardisconferredonindividualswho,byapplyingscientificandtechnologicalknowledge,havemademajortechnologicalinventionswhichleadtoproducts,technologies,materials,anddevicesandtheirsystems,amon
22、gothers.uMajortechnologicalinventionsnasmentionedintheprecedingparagraphshallmeetthefollowingconditions:(1) Havingnotbeendiscoveredorpublicizedbyanyforerunner.(2) Beingadvanced,creativeandpractical.第九条国家自然科学 奖授予在基础研究和应用基 础研究中阐明自然现象、特征 和规律，做出重大科学发现的 个人。前款所称重大科学发现，应当 具备下列条件：（一）前人尚未发现或者尚未 阐明；（二）具有重大科学价
23、值；（三）得到国内外自然科学界 公认。第十条国家技术发明 奖授予运用科学技术知识做 出产品、工艺、材料、器件及 其系统等重大技术发明的个 人。前款所称重大技术发明，应当 具备下列条件：（一）前人尚未发明或者尚未 公开；（二）具有先进性、创造性、 实用性；（三）经实施，创造显著经济 效益、社会效益、生杰环境效 益或者对维护国家安全做出(3) Havingcreatedobviouseconomicandsocialbenefitsorecologicalandenvironmentalbenefitsorhavingmadesignificantcontributionstothemainten
24、anceofnationalsecurityafterbeingputintopractice,andhavinggoodapplicationprospects.Article11TheStateScientificandTechnologicalProgressAwardisconferredonindividualsororganizationsthatcomplete,applyandpromoteinnovativescientificandtechnologicalachievementsandhavemadeoutstandingcontributionstopromotings
25、cientificandtechnologicalprogressandeconomicandsocialdevelopment.Innovativescientificandtechnologicalachievementsnasmentionedintheprecedingparagraphshallmeetthefollowingconditions:(1) Havingoutstandingoriginalityintechnologicalinnovationandadvancedtechnicalandeconomicindicators.(2) Havingcreatedobvi
26、ouseconomic,socialbenefits,orecologicalandenvironmentalbenefitsorhavingmadesignificantcontributionstothemaintenanceofnationalsecurityafterapplicationandpromotion.(3) Havingmadesignificantcontributionstotheadvancementofindustrialscienceandtechnologyprogress.Article 12 TheStateNaturalScienceAward,theS
27、tateTechnologicalInventionAwardandtheStateScientificandTechnologicalProgressAwardaredividedintotwogrades,namely,theFirstPrizeandtheSecondPrize.Thosethathavemadeespeciallygreatscientificdiscoveries,technologicalinventionsorinnovativescientificandtechnologicalachievementsmaybegrantedtheGrandPrize.显著贡献
28、，且具有良好的应用 前景。第十一条国家科学技 术进步奖授予完成和应用推 广创新性科学技术成果，为推 动科学技术进步和经济社会 发展做出突出贡献的个人、组 织。前款所称创新性科学技术成 果，应当具备下列条件：（一）技术创新性突出，技术 经济指标先进；（二）经应用推广，创造显著 经济效益、社会效益、生态环 境效益或者对维护国家安全 做出显著贡献；（三）在推动行业科学技术进 步等方面有重大贡献。第十二条国家自然科 学奖、国家技术发明奖、国家 科学技术进步奖分为一等奖、 二等奖2个等级；对做出特别 重大的科学发现、技术发明或 者创新性科学技术成果的，可 以授予特等奖。第十三条中华人民共 和国国际科学技
29、术合作奖授Article 13 TheChinaInternationalScienceandTechnologyCooperationAwardisconferredonthefollowingforeignersorforeignorganizationsthathavemadeimportantcontributionstoChinasscientificandtechnologicalundertakings:(1) Thosethathavemadegreatscientificandtechnologicalachievementsintheresearchanddevelopme
30、ntthroughcooperationwithChinesecitizensororganizations.(2) ThosethathaveachievedparticularlyprominenteffectsinimpartingadvancedscienceandtechnologytoChinesecitizensororganizationsandcultivatingtalents(3) Thosethathavemadegreatcontributionstopromotingtheinternationalscienceandtechnologyexchangeandcoo
31、perationbetweenChinaandforeigncountries.TheChinaInternationalScienceandTechnologyCooperationAwardhasnodistinctioninawardgrades.ChapterIIINomination,ReviewandConfermentofNationalScienceandTechnologyAwardsArticle 14 Nationalscienceandtechnologyawardsshallbesubjecttothenominationsystem,andself-recommen
32、dationsarenotaccepted.Candidatesshallbenominatedbythefollowingentitiesorindividuals:(1) Experts,scholars,andorganizationsthatmeetthequalificationrequirementsasprescribedbythescienceandtechnologyadministrativedepartmentoftheStateCouncil.予对中国科学技术事业做出 重要贡献的下列外国人或者 外国组织：（一）同中国的公民或者组织 合作研究、开发，取得重大科 学技术成果
33、的；（二）向中国的公民或者组织 传授先进科学技术、培养人 才，成效特别显著的；（三）为促进中国与外国的国 际科学技术交流与合作，做出 重要贡献的。中华人民共和国国际科学技 术合作奖不分等级。第三章国家科学技术奖的 提名、评审和授予第十四条国家科学技 术奖实行提名制度，不受理自 荐。候选者由下列单位或者个 人提名：（一）符合国务院科学技术行 政部门规定的资格条件的专 家、学者、组织机构；（二）中央和国家机关有关部 门，中央军事委员会科学技术 部门，省、自治区、直辖市、 计划单列市人民政府。(2) Therelevantdepartmentsofcentralandstateorgans;thes
34、cienceandtechnologydepartmentoftheCentralMilitaryCommission;andthepeople,sgovernmentsofprovinces,autonomousregions,municipalitiesdirectlyundertheCentralGovernment,andcitiesunderseparatestateplanning.ThenominationqualificationsofrelevantindividualsandorganizationsintheHongKongSpecialAdministrativeReg
35、ion,theMacaoSpecialAdministrativeRegionandTaiwanregionshallbeprovidedforbythescienceandtechnologyadministrativedepartmentoftheStateCouncil.EmbassiesandconsulatesofthePeoplesRepublicofChinastationedabroadmaynominatecandidatesfortheChinaInternationalScienceandTechnologyCooperationAward.Article 15 Nomi
36、natorsshallnominatecandidatesinstrictaccordancewiththenominationmeasures,providenominationmaterials,beresponsiblefortheauthenticityandaccuracyofthematerials,andassumecorrespondingresponsibilitiesasrequired.ThenominationmeasuresshallbedevelopedbythescienceandtechnologyadministrativedepartmentoftheSta
37、teCouncil.Article 16 Whereanyindividualororganizationfallsunderanyofthefollowingcircumstancesinscientificandtechnologicalactivities,heoritshallnotbenominatedorbegrantedanationalscienceandtechnologyaward:(1) Endangeringnationalsecurity,causingdamagetothepublicinterests,endangeringhumanhealth,orviolat
38、ingethics.香港特别行政区、澳门特别行 政区、台湾地区的有关个人、 组织的提名资格条件，由国务 院科学技术行政部门规定。中华人民共和国驻外使馆、领 馆可以提名中华人民共和国 国际科学技术合作奖的候选 者。第十五条提名者应当 严格按照提名办法提名，提供 提名材料，对材料的真实性和 准确性负责，并按照规定承担 相应责任。提名办法由国务院科学技术 行政部门制定。第十六条在科学技术 活动中有下列情形之一的，相 关个人、组织不得被提名或者 授予国家科学技术奖：（一）危害国家安全、损害社 会公共利益、危害人体健康、 违反伦理道德的；（二）有科研不端行为，按照 国家有关规定被禁止参与国 家科学技术奖
39、励活动的；(2) Havingscientificresearchmisconductandbeingprohibitedfromparticipatinginnationalscienceandtechnologyawardactivitiesinaccordancewithrelevantprovisionsissuedbythestate.(3) OthercircumstancesasprescribedbythescienceandtechnologyadministrativedepartmentoftheStateCouncil.Article17Thescienceandtec
40、hnologyadministrativedepartmentoftheStateCouncilshallestablishadatabaseofreviewexpertscoveringalldisciplinesandfields,andupdateitinatimelymanner.Reviewexpertsshallbeproficientintheprofessionalknowledgeofthesubjectsandfieldstheyengagein,haverelativelyhighacademiclevelsandgoodscientificethics.Article
41、18 Reviewactivitiesshalladheretotheprinciplesofopenness,fairnessandimpartiality.Ifareviewexperthasanymaterialinterestinconnectionwithacandidate,whichmayaffectthefairnessandimpartialityofthereview,heorsheshallwithdraw.Thereviewmembersofthereviewcommitteeandreviewexpertsparticipatinginreviewactivities
42、shallabidebyreviewdisciplines,andshallnotusetheidentityofreviewmembersorreviewexpertstoseekprofitsorcolludewithotherreviewmembersorreviewexpertsinvotingorconductanyotheractthatmayaffectthefairnessandimpartialityofthereview.Thereviewmeasuresshallbedevelopedbythescienceandtechnologyadministrativedepar
43、tmentoftheStateCouncil.（三）有国务院科学技术行政 部门规定的其他情形的。第十七条国务院科学 技术行政部门应当建立覆盖 各学科、各领域的评审专家 库，并及时更新。评审专家应 当精通所从事学科、领域的专 业知识，具有较高的学术水平 和良好的科学道德。第十八条评审活动应 当坚持公开、公平、公正的原 则。评审专家与候选者有重大 利害关系，可能影响评审公 平、公正的，应当回避。评审委员会的评审委员和参 与评审活动的评审专家应当 遵守评审工作纪律，不得有利 用评审委员、评审专家身份牟 取利益或者与其他评审委员、 评审专家串通表决等可能影 响评审公平、公正的行为。评审办法由国务院科学
44、技术 行政部门制定。第十九条评审委员会 设立评审组进行初评，评审组 负责提出初评建议并提交评 审委员会。Article 19 Thereviewcommitteeshallestablishreviewgroupstoconductthepreliminaryevaluation,andthereviewgroupsshallberesponsibleforputtingforwardpreliminaryevaluationsuggestionsandsubmitthemtothereviewcommittee.Thereviewexpertsparticipatingintheprelim
45、inaryevaluationareselectedrandomlyfromthereviewexpertdatabase.Article 20 Thereviewcommitteeshallreviewthepreliminaryevaluationsuggestionsaccordingtorelevantmeasures,andrecommendtotheStateScienceandTechnologyAwardsCommissionawardeesofvariousawardcategoriesandawardgrading.Thesupervisioncommitteeshalls
46、upervisestheentireprocessofnomination,reviewandobjectionhandlinginaccordancewithrelevantmeasures,andreportthesupervisioninformationtotheStateScienceandTechnologyAwardsCommission.TheStateScienceandTechnologyAwardsCommissionshall,basedontherecommendationsofthereviewcommitteeandthereportofthesupervisio
47、ncommittee,makesdecisionsontheawardeesofvariousawardcategoriesandtheawardgrading.Article 21 ThescienceandtechnologyadministrativedepartmentoftheStateCouncilshallreviewthedecisionsmadebytheStateScienceandTechnologyAwardsCommissionontheawardeesofvariousawardcategoriesandtheawardgrading,andsubmitthemto
48、theStateCouncilforapproval.Article 22 TheStatePreeminentScienceandTechnologyAwardshallbesubmittedtothePresidentofthePeoplesRepublicofChinaforsigning,withmedals,certificatesandprizesconferredbythePresident.参与初评的评审专家从评审 专家库中抽取产生。第二十条评审委员会 根据相关办法对初评建议进 行评审，并向国家科学技术奖 励委员会提出各奖种获奖者 和奖励等级的建议。监督委员会根据相关办法对 提名、评审和异议处理工作全 程进行监督，并向国家科学技 术奖励委员会报告监督情况。国家科学技术奖励委员会根 据评审委员会的建议和监督 委员会的报告，作出各奖种获 奖者和奖励等级的决议。第二十一条国务院科 学技术行政部门对国家科学 技术奖励委员会作出的各奖 种获奖者和奖励等级的决议 进行审核，报国务院批准。第二十二条国家最高 科学技术奖报请国家主席签
