2、ate,andtheadvancepaymenthasnotbeenrepaidbythedate28dayspriortotheexpirydateztheContractorshallextendthevalidityoftheguaranteeuntiltheadvancepaymenthasbeenrepaid.在还清预付款前,承包商应确保该保函一直有效并可执行;但其总额可根据承包商付还的金额逐渐减少.如果该保函条款中规定了期满日期,而在期满日期前28天预付款尚未还清时,承包商应将该保函有效期延至预付款还清为止.Theemployerhasobtainedanirrevocablean

11、ranteesubjecttotheUniformRulesforDemandGuaranteespublishedbytheInternationalChamberofCommerce,orastandbyL/CsubjecteithertosuchRulesortotheUniformCustomsandPracticeforDocumentaryCreditspublishedbytheInternationalChamberofCommerce,ineithercasetotheamountstatedinAnnexA-7oftheContractPrice,tothesatisfac

18、spublishedbytheInternationalChamberofCommerce,orastandbyL/CsubjecteithertosuchRulesortotheUniformCustomsandPracticeforDocumentaryCreditspublishedbytheInternationalChamberofCommerceissuedbyafirst-classinternationalbank.在安装调试根据19条的规定完成后，履约保函应自动减少到合同价格的5%,并在工厂接收后失效并应返还给开证行。在工厂是分阶段或区段接收时，履约保函的金额应根据每个阶段或

20、ons,theperformanceguaranteeshallbedecreasedinvaluedandbereturnedproratothevalueofeachsuchstageorsection.PursuanttoGC13.3(PerformanceBond)oftheGeneralConditions/Volume1-ITB1theContractorshalldelivertoOWNERwithintwentyone(21)daysafterthedateofsigningtheAgreement,abondintheformofPerformanceBonds(PartII
21、IFormsandProcedure-PerformanceBond)heretoissuedbybankacceptabletoOWNER,issuedwithamountisequivalentthetenpercent(10%)ofContractPrice.根据第1卷(ITB)的GC13.3(履约保函)的规定，承包商应该从签订合同协议之日的21天之内，通过业主接受的银行，按照履约保函的格式(第三部分-格式和程序-履约保函)向业主开立一份履约保函，保函金额为.等同于合同总价格的百分之十(10%)。PerformanceBondinanamountequaltofivepercent(5%

24、iltheexpirationoftheDefectLiabilityPeriodwithrespecttosuchpartinanamountequaltofivepercent(10%)oftheContractPriceofthatpart.但是，如果根据GC27.8的规定，电厂的任何部分的缺陷责任期延长，承包商应该安排履约保函的有效期相应延长到缺陷责任期结束，相应的金额为该部分合同价格的百分之十(10%)。PerformanceBond施工保证金PriortoBUYER*sreleasetoSELLERoftheSecondAdvancePaymentSELLERshallprovid
25、eBUYERwithaperformancebondintheformofaBankGuarantee(thePerformanceBondz,)validformonths,throughabankacceptabletoBUYERzinanamountequivalenttoTWENTYPERCENT(20%)oftheContractPrice.TheBankGuaranteeshallbeauthenticatedandconfirmedbyalocaladvisingbanknominatedbyBUYER.ThePerformanceBondshallguaranteeandsec
26、urethesatisfactoryperformanceofanyandallofSELLERzsobligationsspecifiedundertheprovisionsofthisContract,andshallbecallableuponfirstdemandwithoutrecourse.在采购方支付销售方的第二期预付款前，通过采购方许可的银行，销售方把相当于20%(百分之二十)合同造价的款项使用银行保函的形式(施工保证金)提供一份施工保证金给采购方。银行保证书的有效期为一月。银行保证书应该由采购方认可的一家当地的银行鉴定并确认。施工保证金应保证销售方圆满履行其在本合同规定下责任

30、dbytheContractorascompensation,andifsuchcompensationisnotsufficienttocovertheabovementionedliquidateddamages,theContractorshallpaythebalancetotheOwnerwithinthetimedesignatedbytheOwner.若第35.2条中规定的任一情况发生，发包人有权根据承包人提供的银行履约保函，获得该保函下全部的担保金额作为赔偿，若该赔偿不足以抵扣上述违约金的，承包人应在发包人指定的时间内将差额部分支付给发包人。本担保函持续有效并拥有完全效力直到任
