5、aranteeingandsupervisingthatthecompetentdepartmentsofnaturalresourceslegallyperformtheirduties,andprotectingthelawfulrightsandinterestsofcitizens,legalpersons,orotherorganizations,theseMeasuresaredevelopedinaccordancewiththeLawofthePeoplesRepublicofChinaonAdministrativePenalty,theLandAdministrationL
6、awofthePeoplesRepublicofChina,theUrbanRealEstateAdministrationLawofthePeoplesRepublicofChina,theMineralResourcesLawofthePeoplesRepublicofChina,theSurveyingandMappingLawofthePeople,sRepublicofChina,theUrbanandRuralPlanningLawofthePeoplesRepublicofChinaandotherlawsandregulationsontheadministrationofna
7、turalresources.Article2TheseMeasuresshallapplytoadministrativepenaltiesimposedbythecompetentdepartmentsofnaturalresourcesatorabovethecountylevelaccordingtotheirstatutoryfunctionsandproceduresuponcitizens,legalpersons,orotherorganizationsfortheirbehaviorsinviolationofthelawsandregulationsontheadminis
8、trationofnaturalresourcessuchasland,mineralresources,surveyingandmappinggeographicinformation,andurbanandruralplanning.资源行政处罚的实施,保 障和监督自然资源主管部 门依法履行职责,保护公 民、法人或者其他组织的 合法权益,根据中华人 民共和国行政处罚法以 及中华人民共和国土地 管理法中华人民共和 国城市房地产管理法中华人民共和国矿产资 源法中华人民共和国 测绘法中华人民共和 国城乡规划法等自然资 源管理法律法规,制定本 办法。第二条县级以上自 然资源主管部门依照法定 职权和
9、程序,对公民、法 人或者其他组织违反土 地、矿产、测绘地理信 息、城乡规划等自然资源 管理法律法规的行为实施 行政处罚,适用本办法。综合行政执法部门、乡镇 人民政府、街道办事处等 依法对公民、法人或者其 他组织违反土地、矿产、 测绘地理信息、城乡规划 等自然资源法律法规的行 为实施行政处罚,可以适 用本办法。TheseMeasuresshallmayapplytoadministrativepenaltiesimposedbythecomprehensiveadministrativelawenforcementdepartments,peoplesgovernmentsatthecounty
10、level,andsub-districtoffices,amongothers,uponcitizens,legalpersons,orotherorganizationsfortheirbehaviorsinviolationofthelawsandregulationsontheadministrationofnaturalresourcessuchasland,mineralresources,surveyingandmappinggeographicinformation,andurbanandruralplanningaccordingtothelaw.Article3Toimpo
11、seadministrativepenalties,thecompetentdepartmentsofnaturalresourcesshallfollowtheprinciplesofimpartialityandopenness,andensureclearfacts,conclusiveevidence,accuratedetermination,accuratebasis,lawfulprocedures,andappropriatepenalties.Article4Naturalresourcesadministrativepenaltiesinclude:(1) warninga
12、ndcirculationofnoticeofcriticism;(2) fine,confiscationofillegalgains,andconfiscationofillegalproperty;(3) temporarilydetainingthelicense,loweringthequalificationlevel,andrevokingthelicense;(4) orderingsuspensionofproductionorbusiness;(5) demolishingnewbuildingsandotherfacilitiesonillegallyoccupiedla
13、ndwithinaspecifiedtimelimit;and(6) anyotheradministrativepenaltyasprescribedinthelawandregulation.第三条自然资源主 管部门实施行政处罚,遵 循公正、公开的原则,做 到事实清楚,证据确凿, 定性准确,依据正确,程 序合法,处罚适当。第四条自然资源行 政处罚包括:(一)警告、通报批评;(二)罚款、没收违法所 得、没收非法财物;(三)暂扣许可证件、降 低资质等级、吊销许可证 件;(四)责令停产停业;(五)限期拆除在非法占 用土地上的新建建筑物和 其他设施;(六)法律法规规定的其 他行政处罚。第五条省级自
14、然资 源主管部门应当结合本地 区社会经济发展的实际情 况,依法制定行政处罚裁 量基准,规范行使行政处 罚裁量权,并向社会公Article5Theprovincialadministrativedepartmentsofnaturalresourcesshall,inlightoftheactualcircumstancesoflocalsocialandeconomicdevelopment,developthediscretionstandardsforadministrativepenaltiesaccordingtothelaw,standardizetheexerciseofadmin
15、istrativepenaltydiscretion,andmakeanannouncementtothepublic.布。ChapterIlJurisdictionandApplicationArticle6Casesofland,mineralproductsandurbanandruralplanningviolationsshallbeunderthejurisdictionofthecompetentdepartmentsofnaturalresourcesatthecountylevelwheretheimmovablepropertyislocated.Casesofsurvey
16、ingandmappinggeographicinformationviolationsshallbeunderthejurisdictionofthecompetentdepartmentsofnaturalresourcesatthecountylevelattheplacewheretheillegalacttakesplace.Whereitisdifficulttodeterminetheplacewhereanillegalacttakesplace,itmaybeunderthejurisdictionofthecompetentdepartmentofnaturalresour
17、cesatthecountylevelwheretheentityregistrationplace,officepremiseorindividualpermanenthouseholdregistrationofthesuspectedillegalcitizen,legalpersonoranotherorganizationislocated,exceptasotherwiseprescribedbyanylaworregulation.第二章管辖和适用第六条土地、矿产、城乡规划违法案件由不动产所在地的县级自然资源主管部门管辖。测绘地理信息违法案件由违法行为发生地的县级自然资源主管部门
18、管辖。难以确定违法行为发生地的,可以由涉嫌违法的公民、法人或者其他组织的单位注册地、办公场所所在地、个人户籍所在地的县级自然资源主管部门管辖。法律法规另有规定的除外。Article7TheMinistryofNaturalresourcesshallhavejurisdictionovermajorandcomplicatedcasesofnaturalresourcesviolationsoccurrednationwideandthosecasesthatshallbeunderitsjurisdictionassetforthinthelawsandregulations.第七条自然资源
19、部管辖全国范围内重大、复杂和法律法规规定应当由其管辖的自然资源违法案件。Nationwidemajorandcomplicatedcasesofnaturalresourcesviolationsasprescribedintheprecedingparagraphinclude:前款规定的全国范围内重大、复杂的自然资源违法案件,是指:(一)党中央、国务院要 求自然资源部管辖的自然 资源违法案件;(1) casesofnaturalresourcesviolationsunderthejurisdictionoftheMinistryofNaturalResourcesasrequiredby
20、theCPCCentralCommitteeandtheStateCouncil;(二)跨省级行政区域的 自然资源违法案件;(2) casesofnaturalresourcesviolationsacrossprovincialadministrativeregions;and(三)自然资源部认为应 当由其管辖的其他自然资 源违法案件。(3) othercasesofnaturalresourcesviolationsthattheMinistryofNaturalResourcesdeemstofallunderitsjurisdiction.第八条省级、市级 自然资源主管部门管辖本 行政
21、区域内重大、复杂 的,涉及下一级人民政府 的和法律法规规定应当由 其管辖的自然资源违法案 件。Article8Thecompetentdepartmentsofnaturalresourcesattheprovincialormunicipallevelshallhavejurisdictionovermajorandcomplicatedcasesofnaturalresourcesviolationswithintheiradministrativeregionsandcasesthatshallbeundertheirjurisdictionassetforthinthelawsandr
22、egulations.第九条有下列情形 之一的,上级自然资源主 管部门有权管辖下级自然 资源主管部门管辖的案 件:Article9Underanyofthefollowingcircumstances,acompetentdepartmentofnaturalresourcesatthehigherlevelhastherighttoexercisejurisdictionovercasesunderthejurisdictionofacompetentdepartmentofnaturalresourcesatalowerlevel:(一)下级自然资源主管 部门应当立案而不予立案 的;(1)
23、 Acasethatshallhavebeenfiledbyacompetentdepartmentofnaturalresourcesatalowerlevel,butthesaiddepartmentfailstodoso.(二)案情复杂,情节恶 劣,有重大影响,需要由 上级自然资源主管部门管 辖的。(2) Acomplicatedcasewithseriouscircumstancesandsignificantimpactsthatneedstobeunderthejurisdictionofacompetentdepartmentofnaturalresourcesatahigher
24、level.上级自然资源主管部门可 以将本级管辖的案件交由 下级自然资源主管部门管 辖,但是法律法规规定应 当由其管辖的除外。Acompetentdepartmentofnaturalresourcesatahigherlevelmaytransferacaseunderitsjurisdictiontoacompetentdepartmentofnaturalresourcesatalowerlevel,unlessitisprescribedinanylaworregulationthatthecaseshallbeunderitsjurisdiction.第十条两个以上自 然资源主管部门
25、都有管辖 权的,由最先立案的自然 资源主管部门管辖。自然资源主管部门之间因 管辖权发生争议的,应当 协商解决。协商不成的, 报请共同的上一级自然资 源主管部门指定管辖;也 可以直接由共同的上一级 自然资源主管部门指定管 辖。Article 10 Wheretwoormorecompetentdepartmentsofnaturalresourceshavejurisdiction,itshallbeunderthejurisdictionofthecompetentdepartmentofnaturalresourceswhereacaseisfiledfirstly.Wherethecomp
26、etentdepartmentsofnaturalresourceshavedisputesoverjurisdiction,itberesolvedthroughconsultation.Whereconsultationfails,arequestshallbesubmittedtothecompetentdepartmentofnaturalresourcesatanexthigherlevelfordesignationofjurisdiction;andthecompetentdepartmentofnaturalresourcesatanexthigherlevelmaydirec
27、tlydesignatejurisdictionaswell.上一级自然资源主管部门 应当在收到指定管辖申请 之日起七日内,作出管辖 决定。Thecompetentdepartmentofnaturalresourcesatanexthigherlevelshall,withinsevendaysuponreceiptofanapplicationforjurisdictiondesignation,makeajurisdictiondecision.第十一条自然资源 主管部门发现违法案件不 属于本部门管辖的,应当 移送有管辖权的自然资源 主管部门或者其他部门。Article 11 Where
28、acompetentdepartmentofnaturalresourcesdiscoversthatacaseisnotunderitsjurisdiction,itshalltransferthecasetoacompetentdepartmentofnaturalresourcesthathasjurisdictionoverthecaseoranotherdepartment.受移送的自然资源主管部 门对管辖权有异议的,应 当报请上一级自然资源主 管部门指定管辖,不得再Wherethecompetentdepartmentofnaturalresourcesthatacceptsaca
29、setransferredhasanyobjectiontojurisdiction,itshallrequestthecompetentdepartmentofnaturalresourcesatanext自行移送。higherleveltodesignatejurisdiction,andshallnotre-transferthecaseonitsown.第十二条自然资源 主管部门实施行政处罚 时,依照中华人民共和 国行政处罚法第二十六 条规定,可以向有关机关 提出协助请求。Article 12 Whenthecompetentdepartmentofnaturalresourcesim
30、posesadministrativepenalties,itmay,inaccordancewiththeprovisionsofArticle26oftheLawofthePeoplesRepublicofChinaonAdministrativePenalties,requestassistancefromtherelevantauthorities.第十三条违法行为 涉嫌犯罪的,自然资源主 管部门应当及时将案件移 送司法机关。发现涉及国 家公职人员违法犯罪问题 线索的,应当及时移送监 察机关。Article 13 Whereanillegalactissuspectedofcommit
31、tingacrime,thecompetentdepartmentofnaturalresourcesshalltransferthecasetothejudicialauthorityinatimelymanner.Wherecluesinvolvingviolationsandcrimesofpublicofficialsofthestatearefound,theyshallbetransferredtothesupervisoryauthorityinatimelymanner.自然资源主管部门应当与 司法机关加强协调配合, 建立健全案件移送制度, 加强证据材料移交、接收 衔接,完善案
32、件处理信息 通报机制。Thecompetentdepartmentsofnaturalresourcesshallstrengthencoordinationandcooperationwithjudicialauthorities,establishandimprovethecasetransfersystem,strengthenthetransitionoftransferandreceptionofevidencematerials,andimprovethecasehandlinginformationnotificationmechanism.第十四条自然资源 行政处罚当事人有违法
33、所 得,除依法应当退赔的 外,应当予以没收。Article 14 Illegalgainsofpartiessubjecttonaturalresourcesadministrativepenalties,ifany,shallbeconfiscated,besidesthecompensationtobemadeaccordingtothelaw.违法所得是指实施自然资 源违法行为所取得的款 项,但可以扣除合法成本 和投入,具体扣除办法由 自然资源部另行规定。Illegalgainsrefertothemoneyobtainedfromtheimplementationofillegalac
34、tsofnaturalresources,butlegalcostsandinputsmaybededucted,andthespecificdeductionmethodsshallbeseparatelyprescribedbytheMinistryofNaturalResources.ChapterIIICaseFiling,Investigation,andTrial第三章立案、调查和审 理Article15Whereacompetentdepartmentofnaturalresourcesfindsthatanycitizen,legalperson,orotherorganiza
35、tionissuspectedofcommittinganillegalact,thecompetentdepartmentofnaturalresourcesshallverifysuchactinatimelymanner.Foranillegalactinoperation,thecompetentdepartmentofnaturalresourcesshallissueaWrittenNoticeonOrderingtoCeaseanIllegalActinatimelymanneraccordingtothelawsoastostopsuchact.第十五条自然资源 主管部门发现公
36、民、法人 或者其他组织行为涉嫌违 法的,应当及时核查。对 正在实施的违法行为,应 当依法及时下达责令停止 违法行为通知书予以制 止。责令停止违法行为通知书 应当记载下列内容:(1) the name or title of the violator;(一)违法行为人的姓名 或者名称;TheWrittenNoticeonOrderingtoCeaseanIllegalActshallrecord:(二)违法事实和依据;(3) other matters that shall be recorded.(三)其他应当记载的事 项。Article 16 Where a case meets the f
37、ollowing conditions, the competent department of natural resources shall file the case in a timely manner after discovery of the illegal act:第十六条符合下列 条件的,自然资源主管部 门应当在发现违法行为后 及时立案:(1) There is a definite actor.(一)有明确的行为人;(2) There are facts of violation of laws and regulations on the administration o
38、f natural resources.(二)有违反自然资源管 理法律法规的事实;(2) thefactsofandbasisfortheviolationoflaw;and(三)依照自然资源管理 法律法规应当追究法律责 任;(3) Theviolatorshallbesubjecttolegalliabilitiesinaccordancewithlawsandregulationsontheadministrationofnaturalresources.(四)属于本部门管辖;(4) Thecaseisunderthejurisdictionofthisdepartment.(五)违法行为
39、没有超过 追诉时效。(5) Thelimitationofprosecutionfortheillegalacthasnotexpired.违法行为轻微并及时纠 正,没有造成危害后果 的,可以不予立案。Whereanillegalactisminor,iscorrectedinatimelymanner,andcausesnoharmfulconsequence,acaseisnotrequiredtobefiled.第十七条立案后, 自然资源主管部门应当指 定具有行政执法资格的承 办人员,及时组织调查取 证。Article17Afteracaseisfiled,thecompetentdep
40、artmentofnaturalresourcesshalldesignatecase-handlingpersonswithqualificationsforadministrativelawenforcementandorganizetheinvestigationandtakingofevidenceinatimelymanner.调查取证时,案件调查人 员不得少于两人,并应当 主动向当事人或者有关人 员出示执法证件。当事人 或者有关人员有权要求调 查人员出示执法证件。调 查人员不出示执法证件 的,当事人或者有关人员 有权拒绝接受调查或者检 查。Whenconductinginvesti
41、gationandcollectingevidence,thereshallnotbelessthantwolawcaseinvestigatorswhoshallproducetheirlawenforcementcertificatestothepartyorrelevantpersons.Apartyorrelevantpersonnelshallhavetherighttorequireinvestigatorstoproducelawenforcementcertificates.Whereaninvestigatorfailstoproducealawenforcementcert
42、ificate,thepartyorrelevantpersonnelshallhavetherighttorefusetoacceptinvestigationorinspection.当事人或者有关人员应当如实回答询问,并协助调查或者检查,不得拒绝或Apartyorrelevantpersonnelshalltruthfullyanswerquestionsandassistintheinvestigationorinspection,andshallnotrefuseorobstructthe者阻挠。investigationorinspection.第十八条调查人员 与案件有直接利害关

44、aseandmayaffectthefairlawenforcementshallhavetherighttoapplyfordisqualification.当事人提出回避申请的, 自然资源主管部门应当依 法审查,由自然资源主管 部门负责人决定。决定作 出之前,不停止调查。Whereapartyappliesfordisqualification,thecompetentdepartmentofnaturalresourcesshallconductreviewinaccordancewiththelaw,andthepersoninchargeofthecompetentdepartmen
45、tofnaturalresourcesshallmakeadecision.Beforeadecisionismade,theinvestigationshallnotbesuspended.第十九条自然资源 主管部门进行调查取证, 有权采取下列措施:Article 19 Intheinvestigationandtakingofevidence,thecompetentdepartmentofnaturalresourceshastherighttoadoptthefollowingmeasures:(一)要求被调查的单位 或者个人提供有关文件和 资料,并就与案件有关的 问题作出说明;(1)
46、 Requiringtheentityorindividualunderinvestigationtoprovidetherelevantdocumentsandmaterialsandexplainissuesrelatedtothecase.(二)询问当事人以及相 关人员,进入违法现场进 行检查、勘测、拍照、录 音、摄像,查阅和复印相 关材料;(2) Inquiringaboutthepartyandtherelevantpersonnel,enteringthesceneof川egalacttoconductinspectionandsurveyandtakephotographs,re
47、cordings,andvideotaping,andconsultingandduplicatingtherelevantmaterials.(3) Othermeasuresthatmaybetakenaccordingtothelaw.(三)依法可以采取的其 他措施。第二十条当事人拒 绝调查取证或者采取暴 力、威胁的方式阻碍自然 资源主管部门调查取证 的,自然资源主管部门可 以提请公安机关、检察机 关、监察机关或者相关部 门协助,并向本级人民政 府或者上一级自然资源主 管部门报告。第二十一条调查人Article20Whereapartyrejectsinvestigationandtak
48、ingofevidenceorimpedesacompetentdepartmentofnaturalresourcesfromconductinginvestigationandtakingevidencebymeansofviolenceorthreat,thecompetentdepartmentofnaturalresourcesmayrequestthepublicsecurityauthority,procuratorialorgan,supervisoryorgan,orcorrespondingdepartmentforassistance,andreporttothepeoplesgovernmentatthesamelevelorthecompetentdepartmentofnaturalresourcesatanexthigherlevel.员应当收集、调取与案件 有关的书证、物证、视听 资料、电子数据的原件、 原物、原始载体;收集、 调取原件、原物、原始载 体确有困难的,可以收 集、调取复印件、复制 件、节录本、照片、录像 等。声
