1、工程合同中健康和劳动安全条款（中英文对照）工程合同中健康和劳动安全条款（中英文对照）C1.AUSEOFHEA1.THAND1.ABORSAFETY职业健康OccupationHealth劳动保护1.abourProtection健康和安全HealthandSafety承包人应按照法律规定安排现场施工人员的劳动和休息时间，保障劳动者的休息时间，并支付合理的报酬和费用。承包人应依法为其履行合同所雇用的人员办理必要的证件、许可、保险和注册等，承包人应督促其分包人为分包人所雇用的人员办理必要的证件、许可、保险和注册等。Thecontractorshallzinaccordancewiththeprov
2、isionsoftheIawzarrangetheworkandresttimeofworkingpersonnelatthesite,ensurethemtheresttime,andeffectpaymentofreasonableremunerationandexpenses.Thecontractorshall,pursuanttothelaw,sprovision,handlethenecessarydocuments,permits,insuranceandregistrationandothersforthepersonnelemployedbycontractorforperf
3、ormingcontractandsuperviseandurgeitssubcontractortohandlethenecessarydocuments,permits,insuranceandregistrationandothersforthepersonnelemployedbysubcontractor.承包人应按照法律规定保障现场施工人员的劳动安全,并提供劳动保护,并应按国家有关劳动保护的规定，采取有效的防止粉尘、降低噪声、控制有害气体和保障高温、高寒、高空作业安全等劳动保护措施。承包人雇佣人员在施工中受到伤害的，承包人应立即采取有效措施进行抢救和治疗。Thecontractor

5、onsafetywithhightemperature,coldzhighaltitude.Wherethecontractorsemployeesareinjuredintheconstruction,thecontractorshallforthwithtakeeffectivemeasuresfortherescueandtreatmentthereof.承包人应按法律规定安排工作时间，保证其雇佣人员享有休息和休假的权利。因工程施工的特殊需要占用休假日或延长工作时间的，应不超过法律规定的限度，并按法律规定给予补休或付酬。Thecontractorshallinthelightoflaw,
6、sprovisionarrangetheworkinghourstoensureitsemployeesenjoytherighttorestandleave.Duetotheparticularnecessityofengineeringconstructionoccupiestheholidayortolengthenworkinghours,shouldnotexceedthelegallimit,andshouldgiveofforpayaccordingtothelaw.承包人应为其履行合同所雇用的人员提供必要的膳宿条件和生活环境；承包人应采取有效措施预防传染病，保证施工人员的健康，
7、并定期对施工现场、施工人员生活基地和工程进行防疫和卫生的专业检查和处理,在远离城镇的施工场地，还应配备必要的伤病防治和急救的医务人员与医疗设施。Thecontractorshallprovidethenecessaryaccommodationandlivingconditionstothepersonnelemployedforperformanceofthecontractandshalladopteffectivemeasurestopreventinfectiousdiseasesoastoensureworkershealth,andcarryouttheprofessionalep
8、idemicandhygieneinspectionandtreatmentatregularintervalswithinworksitezlivingbaseofworkersandengineeringinadditiontoallocationofthenecessarymedicalpersonnelandfacilitiesforinjurypreventionandemergencytreatmentintheworksitewhereawayfromcityandtown.承包商应始终采取合理的预防措施,维护承包商人员的健康和安全.承包商应与当地卫生部门合作,始终确保在现场,以
9、及承包商人员和雇主人员的任何驻地,配备医务人员、急救设施、病房及救护车服务,并应对所有必需的福利和卫生要求、以及预防传染病做出适当安排。TheContractorshallatalltimetakeallreasonableprecautionstomaintainthehealthandsafetyoftheContractorsPersonnel.Incollaborationwithlocalhealthauthorities,theContractorshallensurethatmedicalstaff,firstaidfacilities,sickbayandambulancese
10、rviceareavailableatalltimesattheSiteandatanyaccommodationforContractorsandEmployersPersonnel,andthatsuitablearrangementsaremadeforallnecessarywelfareandhygienerequirementsandforthepreventionofepidemics.任何事故发生后,承包商应立即将事故详情通报雇主.承包商应按雇主可能提出的合理要求,保持记录,并写出有关人员健康、安全和福利、以及财产损坏等情况的报告。TheContractorshallsendz
11、totheEmployer,detailsofanyaccidentassoonaspracticableafteritsoccurrence.TheContractorshallmaintainrecordsandmakereportsconcerninghealth,safetyandwelfareofpersons,anddamagetoproperty,astheEmployermayreasonablyrequire.与钻井承包商人员旅行证件、健康证书、签证、工作许可证等有关的所有手续及后勤服务。Allassociatedformalitiesandlogisticsrelatedt
12、otraveldocuments,healthcertificates,visas,workpermits,etc.forContractorsPersonnel.承包商的行为应符合工程信息中规定的对健康和安全的要求。TheContractoractsinaccordancewiththehealthandsafetyrequirementsstatedintheWorksInformation.供应方保证其应遵守所有与本合同项下服务相关的职业健康和安全法律和法规规定，并遵循购买方的授权采购代表为此作出的所有指示。Vendorwarrantsthatitshallcomplywithallre
13、levantoccupationalhealthandsafetylawsandregulationsinrelationtotheServiceshereunder,andshallobeyalldirectionsgivenbyBuyer1sAuthorizedProcurementRepresentativeinthisregard.如果石油作业威胁到人生命和健康，严禁开展这样的作业。Oiloperationsshallnotbeconductediftheyrepresentadangertohumanlifeandhealth.乙方必须保证项目施工场地内材料、机械设备摆放整齐，随时保
14、证施工便道畅通无阻。施工过程中，乙方应遵守国家、业主、甲方关于职业健康安全及环境保护的规章制度和要求，确保乙方员工身体健康和施工安全；PartyBshouldensureallmaterials,machineryandequipmentbeinglaidneatlywithinthesiteandensuretheaccessroadforexecutionunimpededandwithoutbarrier.PartyBshouldcomplywiththeregulations,rulesandrequirementofoccupationalhealth,safetyandenvironmentalprotectionbyStatezemployerandpartyAztoensureemployeeshealthandexecutionsafety.
