1、论代位权诉讼 摘 要代位权诉讼属于1种债权保全方式，我国1999年3月15日通过的中华人民共和国合同法第73条首次在立法上正式确立了债权人代位权。之后，最高人民法院又对代位权诉讼的具体运作作出了司法解释。我国代位权诉讼制度设置的重要目的是解决现实生活中大量存在的“3角债”问题，但能否真正提高司法效率，切实保障债权人的合法利益，本文将从代位权诉讼的成立条件,当事人的诉讼地位等有关程序提出自己对代位权诉讼的见解。关键词：保全制度；代位权诉讼；诉权；主体；诉讼标的AbstractThe generation of position power lawsuit belongs to a way of
