3、overnmentonJanuary19j2023,andareherebypromulgated.TheyshallbeeffectiveasofMay1,2023.上海市电梯安全管理办法已经2023年1月9日市政府第190次常务会议通过，现予公布，自2023年5月1日起施行。Mayor:GongZheng市长龚正January19,20232023年1月19日上海市电梯安全管理办法（2023年1月19日上海市人民政 府令第76号公布自2023年5 月1日起施行）第一章总则第一条（目的和依据）为了加强本市电梯安全管理，保 障人身和财产安全，根据中华 人民共和国特种设备安全法等 法律、法规和国
4、家有关规定，结 合本市实际，制定本办法。第二条（适用范围）本市行政区域内电梯生产（含制 造、安装、改造、修理）、经 营、使用、维护保养、检验、检 测、安全评估以及相关监督管理 活动，适用本办法Q本办法所称电梯，包括载人 （货）电梯、自动扶梯和自动人 行道等。具体范围按照国家规定 的特种设备目录及特种设备安全ProceduresofShanghaiMunicipalityontheAdministrationofLiftSafety(PromulgatedbyDecreeNo.76ofShanghaiMunicipalPeoplesGovernmentonJanuary19,2023,andto
5、beeffectiveasofMay1,2023)ChapterIGeneralProvisionsArticle 1 (PurposesandBasis)Withaviewtostrengtheningtheworkoflift(elevator)safetyinthisMunicipality,andprotectingpersonalandpropertysafety,theseProceduresareformulatedinaccordancewiththelawsandrules,includingtheSpecialEquipmentSafetyLawofthePeoplesRe
6、publicofChinaandrelevantprovisionsoftheState,andinthelightoftheactualcircumstancesofthisMunicipality.Article 2 (ApplicationScope)Theliftproduction(includingmanufacturing,installation,renovationandrepair),businessoperation,use,maintenance,inspection,testing,safetyassessmentandrelatedsupervisoryadmini
7、strationactivitieswithintheadministrativeareaofthisMunicipalityshallcomplywiththeseProcedures.FortthepurposesoftheseProcedures,uIiftsnincludepassengerandfreightlifts,escalators,andpassengerconveyors.Thespecificscopethereofshallbedeterminedaccordingtothespecialequipmentcatalogueandthespecial-技术规范确定。e
8、quipment-safetytechnicalnormsformulatedbytheState.Article 3 (GovernmentDuties)Themunicipalanddistrictpeople,sgovernmentsshallstrengthenleadershipovertheliftsafetyworkwithintheirrespectiveadministrativeareas,urgerelevantdepartmentstoperformtheirsupervisionandadministrationdutiesaccordingtolaw,andesta
9、blishacoordinatingmechanismtosolvetheproblemsinliftsafetyadministrationinatimelymanner.Thesub-districtofficesandthetown/townshippeoplesgovernmentsshallassistrelevantadministrativedepartmentsineffectivelysupervisingandadministeringtheliftsafetywork.Article 4 (DepartmentDuties)Theadministrativedepartm
10、entsforspecialequipmentsafetysupervisionshallberesponsibleforsupervisingandadministeringtheliftsafetyworkintheirrespectiveadministrativearea.第三条（政府职责）市、区人民政府应当加强对本行 政区域内电梯安全管理工作的领 导，督促各有关部门依法履行监 督管理职责，并建立协调机制， 及时解决电梯安全管理中存在的 问题。街道办事处、乡镇人民政府应当 协助有关行政管理部门做好电梯 安全监督管理工作。第四条（部门职责）特种设备安全监督管理部门负责 本行政区域内的电梯
11、安全监督管 理工作。住房城乡建设管理、房屋管理、 规划资源、交通、公安、应急、 消防救援等行政管理部门和机构 应当按照各自职责，做好电梯安 全监督管理的相关工作。Theadministrativedepartmentsandagenciesofhousingandurban-ruraldevelopment,housingmanagement,planningandresources,transportation,publicsecurity,emergencymanagement,fireandrescue,etc.shall,accordingtotheirrespectivefuncti
12、onsandduties,dowelltherelevantworkofliftsafetysupervisionandadministration.Article5(EntitieswiththeMainResponsibilities)第五条（主体责任）Theentitiesofliftproduction,businessoperation,use,andmaintenanceandrepairshallberesponsibleforthesafetyoftheliftstheyproduce,operate,use,andmaintainandrepair,andestablisha
13、systemofresponsibilitiesforliftsafety.电梯生产、经营、使用管理、维护保养等单位应当对其生产、经营、使用、维护保养的电梯安全负责，依法建立并落实电梯安全责任制度。Article6(TradeSelf-discipline)第六条（行业自律）ThelifttradeassociationandotherrelevanttradeassociationsofthisMunicipalityshalldothefollowingworkproperly:本市电梯行业协会等相关行业组织应当加强行业自律，做好以下工作：1.analyzing,studyingandre
14、leasingtradeinformation;（一）收集、分析、发布行业信息；2.participatingintheformulationofrelevantstandards;（二）参与相关标准的制定;3.organizingthepublicity,consultation,educationandtrainingonliftsafety;（三）组织开展电梯安全宣传咨询、教育培训；4.advancingthebuildingofatradecreditsystem,andimprovingthecredibilityofthememberunits;and（四）推进行业诚信体系建设,开
15、展会员单位诚信建设；5.coordinatingintechnicalassessment,andadvancingliftsafetyliabilityinsurance.（五）配合开展技术鉴定、推行电梯安全责任保险等工作。Article7(IntelligentLiftPlatform)第七条（智慧电梯平台）technology and methods to raise and management ability of accident本市建立统一的智慧电梯平台， 完善上海智慧电梯码，依托城市 运行“一网统管”平台，强化电 梯安全数字化管理与服务，实现 对电梯生产、经营、使用、维护 保养
16、、检验检测等相关信息的识 别、分析、预警，实行分级分类 监管。第八条（先进技术应用）电梯生产、使用管理、维护保养 等单位应当采用先进技术和科学 管理手段，提高电梯安全性能和 管理水平，增强事故防范能力和 应急救援能力。鼓励科研单位、高校、企业等研 发有利于提高电梯安全性的新材 料、新技术、新工艺等。第九条（宣传教育）特种设备安全监督管理部门等相 关行政管理部门应当加强电梯安 全知识的宣传教育，增强公众安 全意识和自我保护能力。学校应当将电梯安全知识纳入公 共安全教育范畴，增强学生安全 文明使用电梯的意识。ThisMunicipalityshallestablishaunifiedplatfor
17、mforintelligentlifts,improveShanghaisintelligentliftcode,andshall,byrelyingontheIntegratedOnlineAdministrationPlatform,strengthendigitalizedmanagementandserviceforliftsafety,andachieveclassifiedandcategorizedsupervisionovertheidentification,analysisandearlywarningsoftheliftproduction,businessoperati
18、on,use,maintenance,repair,inspectionandtesting.Article 8 (ApplicationofAdvancedTechnology)1.iftproducers,usemanagingunits,andmaintenanceunitsshalladoptadvancedscientificmanagementtheliftsafetyperformancelevelandstrengthentheirpreventionandemergencyrescue.Researchinstitutes,universitiesandenterprises
19、shallcarryoutresearchtodevelopnewmaterials,techniques,technologies,etc.thatareconducivetoimprovelifesafety.Article 9 (PublicityandEducation)Theadministrativedepartmentforspecialequipmentsafetysupervisionshallpromotepublicityofliftsafetyknowledge,andenhancethesafetyawarenessandself-protectionabilityo
20、fthepublic.Schoolsshallincludeliftsafetyknowledgeintheirpublicsafetyeducation,andenhancethestudents*awarenessofsafeandcivilizeduseoflifts.鼓励新闻媒体、相关社会团体以 及公众聚集场所管理者等，开展 电梯安全知识宣传。Newsmedia,relevantsocialorganizations,andadministratorsofpublicgatheringplacesareencouragedtodisseminateliftsafetyknowledge
21、.Article10(Insurance)第十条（保险）本市推行电梯安全责任保险，鼓 励电梯生产、使用管理、维护保 养等单位投保电梯安全责任保 险。第二章生产和经营Article 11 (Selection and Supply of Lift Types)第十一条求）（选型配置要ThisMunicipalityshallimplementtheliftsafetyliabilityinsurance,andencourageliftproducers,usemanagers,andmaintainerstotakeouttheliftsafetyliabilityinsurance.Chap
22、terIlProductionandBusinessOperation建筑设计单位根据建设单位委 托，出具的设计文件中所涉及的 电梯井道、机房、应急救援通道 等建筑结构以及电梯参数等，应 当符合应急救援、消防、无障碍 通行、民用建筑隔声等国家有关 规定和标准要求。施工图审查机构应当对建设工程 施工图设计文件有关电梯配置中 涉及工程强制性标准的内容依法 进行审查。建设单位应当按照设计文件以及Entrustedbythedevelopmentunit,theconstructionanddesignunitsshallproduceliftshafts,motorrooms,emergencyre
23、scuepassagesandotherstructuresaswellastheliftparametersinthedesigndocumentthatcomplywiththerelevantstateprescriptionsandstandardsforemergencyrescue,firepreventionandfighting,accessiblepassages,civilbuildings*soundinsulation,etc.Theagencyexaminingtheconstructionplanshallexamine,accordingtolawandtheco
24、mpulsoryengineeringstandards,thesupplyofliftsasstatedintheconstructionplandesigndocumentsoftheconstructionproject.Thedevelopmentunitshall,accordingtothedesigndocumentandtherelevantsafetytechnicalnormsandstandards,supplyliftsandequipthem(excludingdumbwaiterlifts)withremotemonitoringdevicesthatcomplyw
25、iththerelevantstandards.Whereescalators,andpassengerconveyorsaresuppliedatpublictransportplacessuchasstations,airportterminalsandpassengerwharves,thedevelopmentunitshallselectpublic-transport-typeliftsthatcomplywithrelevantstandardsandrequirements.相关安全技术规范、标准等要求 配置电梯，并配备符合相关标准 的远程监测装置（杂物电梯除 外）。车站、机场
26、、客运码头等 公共交通场所配置自动扶梯和自 动人行道的，应当选用符合相关 标准要求的公共交通型电梯。建设单位在配置电梯（杂物电梯 除外）时，应当满足通信配套的 相关要求，并在交付使用前完成 电梯轿厢的通信网络覆盖。鼓励 在用电梯实现轿厢通信网络覆 盖。Article 12 (Quality Requirements for Lift Production)Lift production activities shall comply with the requirements of the lift safety technical norms and relevant standards.I
27、t is prohibited to use scrapped parts and components for lift production.第十二条（电梯生产质量 要求）电梯生产活动应当符合电梯安全 技术规范及相关标准要求。禁止将报废的零部件用于电梯生 产。Wherethedevelopmentunitsupplieslifts(excludingdumbwaiterlifts),itshallmeettherequirementsforaccompanyingcommunicationdevices,sothatthecommunicationnetworkcancoverthelif
28、tcabinsbeforeitisdeliveredforuse.Itisencouragedtocovertheexistingliftcabinswiththecommunicationnetworkaswell.电梯制造单位对出厂的电梯，应当提供安全技术规范要求的设计文件、产品质量合格证明、安装Article13(TheLiftManufacturers第十三条(电梯出厂文Documents)件)1.iftmanufacturersshallprovidetheliftstheymanufacturewithrelevanttechnicaldataanddocuments,includ

30、oductnameplates,safetywarningsignsandinstructionsthereofatconspicuousplacesofthelifts.Article14(TheResponsibilities)Manufacturers第十四条任）（制造单位的责Theliftmanufacturershallberesponsiblefortheliftssafeperformance,andfulfillthefollowingobligations:电梯制造单位应当对电梯安全性能负责，并承担以下义务：1.ensuringthemanufacturedliftsandt
31、heirmainpartsandcomponentsconformtothemodel-testcertificate;（一）出厂的电梯整机和主要部件与型式试验证书保持一致；2.providingtheliftusemanagerswiththenecessaryliftspareparts,technicaltrainingandothertechnicalassistance;（二）向电梯使用管理单位提供必需的电梯备品备件、技术培训和其他技术帮助；3.conductingfollow-upinvestigationontheliftsafetyoperation,andofferingsu
32、ggestionsonsolutionstotheproblemsintheoperation;（三）对电梯安全运行情况进行跟踪调查和了解，对运行中存在的问题提出改进建议；4.repairingorreplacingrelevantpartsandcomponentsfreeofchargeifalifthasaqualityproblemduringthequalityguaranteeperiod;（四）在质量保证期内电梯出现质量问题的，予以免费修理或者更换相关零部件；5.immediatelystoppingproductionoftheliftsthatarefoundwiththes
33、amesafety-endangeringdefectcausedbysuchfactorsasdesignandmanufacturing,voluntarilyrecallingtheselifts,notifyingtheliftusemanagersinatimelymanner,andreportingtothemunicipal（五）发现因设计、制造等原因造成电梯存在危及安全的同一性缺陷的，立即停止生产、主动召回，及时告知电梯使用管理单位，并向市特种设备安全监督管（六）其他法律、法规、规章规 定应当承担的义务。电梯制造单位不得设置影响电梯 正常运行的技术障碍。第十五条（经营单位的责
34、 任）电梯经营单位销售电梯和主要部 件的，应当符合安全技术规范及 相关标准的要求，其产品质量合 格证明、型式试验证书、安装及 使用维护保养说明等相关技术资 料和文件应当齐全。电梯经营单位应当建立电梯、主 要部件的检查验收和销售记录制 度，并妥善保管。第十六条（施工告知）电梯安装、改造、修理单位应当 在施工前，将拟施工的时间、地 点和内容等情况，书面告知特种 设备安全监督管理部门，并在施 工现场予以公示。administrativedepartmentforspecial理部门报告;equipmentsafetysupervision;and6.otherobligationsitshallas
35、sumeinaccordancewithlaw,rulesandregulations.Theliftmanufacturershallnotsetuptechnicalbarriersthataffectthenormaloperationoflifts.Article 15 (TheBusinessOperatorsResponsibilities)Theliftsandtheirmainpartssoldbyaliftbusinessoperatorshallcomplywiththesafetytechnicalnormsandrelevantstandards,andtherelev
36、anttechnicaldataanddocumentssuchastheproductqualitycertificates,modeltestcertificates,andinstructionsoninstallation,useandmaintenanceshallbecomplete.Theliftbusinessoperatorshallestablishasystemofrecordsofinspecting,acceptingandsellingliftsandmainparts,andkeeptherecordsproperly.Article 16 (Notificati
37、onofConstruction)Theliftinstaller,renovatorandrepairershall,beforethestartofaconstructionproject,notifytheadministrativedepartmentforspecialequipmentsafetysupervisioninwritingofsuchinformationasthetime,placeandcontentthereof,andpublicizetheinformationattheconstructionsite.Ifaliftneedstobeinstalledfo
38、raconstructionproject,theinstallershallproviderelevantinformationoftheconstructionprojectplanningpermitandtheconstructionpermitinitswrittennotification.Thedevelopmentunitshallcooperateandproviderelevantinformation.(SafetyManagementRequirementsforLiftInstallation,RenovationandRepair)1.iftinstallation
39、,renovationandrepairshallbeconductedbythemanufacturers,orbyunitswiththenecessaryqualificationsentrustedthereby.Wherealiftmanufacturerentrustsanotherunittoinstall,renovateorrepairalift,itshallprovidesafetyguidanceandmonitoringovertheinstallation,renovationorrepair,andconductcheckoutandshakedowntestsa
40、ccordingtotherequirementsofthesafetytechnicalnorms.Theentrustedunitshallnotsub-entrustorsub-entrustinadisguisedformthesaidinstallation,renovationandrepairservices.Wheretheoriginalliftmanufacturerhasbeencanceled,andnolongerhasthecorrespondingpermitorthecapabilitytorenovateorrepairlifts,theliftusemana
41、gershallentrustaliftmanufacturerthathasobtainedthecorrespondingpermitaccordingtolawtoconducttherenovationorrepair.Themanufacturerthathasconductedtherenovationorrepairshallberesponsibleforthesafetyperformanceofthelifts.建设项目需要安装电梯的，电梯 安装单位应当在书面告知时，提 供建设项目的建设工程规划许可 和施工许可的相关信息。建设单 位应当配合提供相关信息。第十七条（电梯安装、
42、改 造、修理的安全管理要求）电梯安装、改造、修理应当由电 梯制造单位或者其委托的依法取 得相应许可的单位进行。电梯制 造单位委托其他单位进行电梯安 装、改造、修理的，应当对其安 装、改造、修理进行安全指导和 监控，并按照安全技术规范的要 求进行校验和调试。受托单位不 得转委托或者变相转委托。原电梯制造单位已经注销、不再 具有相应许可或者没有能力进行 改造、修理的，电梯使用管理单 位应当委托依法取得相应许可的 电梯制造单位实施改造、修理。 实施改造、修理的制造单位对改 造、修理后的电梯安全性能负 责。电梯安装、改造、修理单位应当 在施工前，编制安全施工方案， 落实安全防护措施等现场安全生 产条件
43、，对电梯机房、井道、底Theliftinstaller,renovatorandrepairershallformulateaschemeforsafeconstructionbeforethestartoftheconstruction,meettheon-siteworksafetyconditionsincludingsafetyprotectionmeasures,andchecktheliftmotor坑、通道等土建工程进行检查， 符合要求后方可施工。竣工后， 应当在验收通过后30日内将相关 技术资料和文件移交电梯使用管 理单位。room,shaft,pit,passageandot
44、hercivilengineeringprojects,andshallnotstarttheconstructionbeforetheseconditionshavebeenmet.Afterthecompletionoftheconstruction,within30daysofpassingtheacceptancecheck,theyshalltransfertherelevanttechnicaldataanddocumentstotheliftusemanager.(Self-InspectionDuringInstallation,RenovationandOverhaul)1.
45、ift第十八条（电梯安装、改造、重大修理的自行检查）Theliftinstaller,renovatorandrepairershallarrangeprofessionaltechnicianstoconductself-inspectionoftheprocessofliftinstallation,renovationandoverhaul.Onlythoseliftsthathavepassedtheself-inspectionmaybesubmittedtotheinspectingagencyforsupervisoryinspection.电梯安装、改造、修理单位应当安排专业技
46、术人员，对电梯安装、改造和重大修理活动的过程实行自行检查。经自行检查合格的，方可报检验机构进行监督检验。Article19(SpecialRequirementsforAddingaLifttoaBuilding)第十九条（加装电梯的特别要求）Itisnecessarytocomplywiththestandardsandrequirementsforthebuildingstructureandfirepreventionwhileaddingalifttoamultistoreyresidentialbuilding.既有多层住宅加装电梯（以下简称加装电梯）应当符合建筑结构、消防等标准和要
47、求。Theconstructionplandocumentaboutaddingaliftshallpassthefeasibilitystudyonthebuildingsafety.Wheremajorchangestothedesignsoftheoriginalstructureandfirepreventionfacilitiesarenecessary,anewfeasibilitystudyisrequired.加装电梯项目的施工图设计文件应当通过房屋安全性论证，过程中涉及结构、消防等重大设计变更的，应当重新论证。Thecivilengineeringprojectofaddingaliftshallstrictlyfollowtheconstructionplandocument,thespecialconstructionscheme加装电梯土建工程应当严格按照施工图设计文件、经审批通过的专项施工方案及相关的质量安全规范标准施工。施工前，施工单 位应当排摸周边管线分布，对于 可能影响工程施工的管线，应当 在开挖前采取外移等措施。thathasbeenappro
