1、工程合同中的承诺条款（中英文对照）承诺PromisesandUndertakes发包人承诺按照法律规定履行项目审批手续、筹集工程建设资金并按照合同约定的期限和方式支付合同价款。Theemployerpromises,inaccordancewithlawsprovisionslperformtheapprovalprocedures,raiseconstructionfundsandeffectpaymentofcontractedcostandpricepursuanttothetimelimitedandmethodswhicharestipulatedincontract.承包人承诺按照
2、法律规定及合同约定组织完成工程施工，确保工程质量和安全，不进行转包及违法分包，并在缺陷责任期及保修期内承担相应的工程维修责任。Thecontractorpromises,inaccordancewithlawsprovisionsandcontractstipulation,toorganizeandcompletetheconstruction,ensurethequalityandsafetyofengineering,notransfer-contracting/subcontracting,andundertakethecorrespondingliabilitiesofenginee
3、ringrepair/maintenanceinthedefectsliabilityperiodandwarrantyperiod.发包人和承包人通过招投标形式签订合同的，双方理解并承诺不再就同一工程另行签订与合同实质性内容相背离的协议。Wherethecontractisconcludedbybiddingbetweentheemployerandthecontractor,thepartiesheretounderstandingandcommitmentnottoconcludeanyotheragreementwhichdeviatefromthesubstanceofthiscon
4、tract.ContractorsUndertaking承包商的承诺TheContractorundertakesthatthedesign,theContractor7sDocuments,theexecutionandthecompletedworkswillbeinaccordancewith:承包商承诺其设计、承包商文件、实施和竣工的工程符合：承包人向发包人承诺按照合同约定进行施工、竣工并在质量保修期内承担工程质量保修责任。Thecontractorpromisestotheemployerthatheshallcarryoutandcompletealloftheconstructi

13、ulatedherein.设计人承诺按照法律和技术标准规定及合同约定提供工程设计服务。Thedesignerpromisestoprovideengineeringdesignservicesinaccordancewithlegal,technicalstandardsandcontractualagreements.我方在此承诺：根据下述特别说明的第1和第2条，按照本信用证下出具的符合本信用证条件的汇票和装运单据予以议付。Weherebyundertakethatagainstpresentationofthedraftsandshippingdocumentsdrawnunderandi
14、ncompliancewiththetermsofthisCredit,thesameshallbenegotiatedsubjecttospecialinstructionsitem1and2statedhereunder.每笔最终付款均应有T分承包商对最终付款的支付、解除及留置权放弃的书面承诺。该等书面承诺应附有：RequiredforeachfinalpaymentshallbeoneContractorAffidavitofPayment,Release,andWaiverof1.iensforFinalPayment.Attachedtheretoshallbethefollowin
15、g:承包商使用的书面承诺、留置权放弃声明及担保人同意的格式应由业主提供。Theformsfortheaffidavits,waiversofliens,andconsentsofsuretytobeusedbytheContractorshallbethosefurnishedbytheOwner.每笔分期付款均应有一份针对付款申请所涵盖工程的承包商对分期付款的支付、解除及留置权放弃的书面承诺。该等书面承诺应附有：RequiredforeachprogresspaymentshallbeoneContractorAffidavitofPayment,ReleasezandWaiverof1.i
16、ensforProgressPaymentfortheWorkcoveredbytheApplicationforPayment.Attachedtothataffidavitshallbethefollowing:针对付款申请金额中可归因于分包商和材料供应商工程的部分，从该等分包商（包括材料供应商）获得下列其中一项分包商和材料供应商的书面承诺：OneofthefollowingsubcontractorsandmaterialsupplieraffidavitsfromeachSubcontractors,includingeachmaterialsupplier,forthatportio
17、nofthesumsetforthintheApplicationwhichisattributabletohisportionoftheWork:(1)如果其工程仍在进行中,分包商和材料供应商对分期付款的支付、解除及留置权放弃的书面承诺。ASubcontractorsandMaterialSupplierAffidavitofPayment,Release,andWaiverof1.iensforProgressPaymentiftheWorkbyhimisstillinprogress.(2)如果其工程已竣工，分包商和材料供应商对最终付款的支付、解除及留置权放弃的书面承诺。ASubcont
18、ractorsandMaterialSupplierAffidavitofPayment,Release,andWaiverof1.iensforFinalPaymentiftheWorkbyhimiscomplete.TheCompanyacknowledgestoEDCthatitremainsliabletoEDCtoperformalltheliabilitiesandobligationsassumedbytheCompanyundertheContract.公司向EDC承诺仍然承担合同规定的应向EDC履行的相关责任和义务。受托人在本承诺函项下对贵司的付款义务无附加条件，受托人承诺不
19、因委托人未履行与受托人的约定或认为贵司违反目标协议或其他原因而抗辩履行本承诺函项下的付款义务。委托人与受托人在委托款项的金额范围内承担连带付款责任。如果受托人未能在规定期限按规定方式支付全部委托款项，则视为受托人违反了本承诺函、委托人违反了本承诺函及目标协议。贵司可以向委托人与受托人同时求偿并追究违约责任。TheConsigneeshallpayyouaccordingtothisPromisewithoutanyadditionalcondition.AndtheConsigneepromisesnottodefendanypayingobligationunderthisPromisebe
20、causetheConsignorfailstoperformtheagreementwiththeConsigneeortheConsignordeemsyouhavebreachedthetargetagreementoranyotherreason.TheConsignerandtheConsigneeshallundertakeincidentalresponsibilityintheamountrangeoftheentrustedpayment.IftheConsigneefailstopayallentrustedpaymentinthespecifiedtimeandinspe
21、cifiedtermzthentheConsigneewillbedeemedashasbreachedthisPromise,andtheConsignorhasbreachedthisPromiseandthetargetagreement.YoucanclaimcompensationandholdtheConsignorandtheConsigneetoberesponsibleforbreachingtheagreement.Consortiumshallundertaketoguaranteetheperformanceparametersspecifiedinthefollowi
22、ngschedulesbasedonthefollowingreferenceconditions:联合体承诺在下列条件下，担保下表中的性能参数：发包人承诺按照法律规定履行项目审批手续，按照合同约定提供工程勘察条件和相关资料，并按照合同约定的期限和方式支付合同价款。Theemployerpromisestoperformtheprojectapprovalproceduresinaccordancewiththelaw,provideengineeringsurveyconditionsandrelevantmaterialsasperthecontractandpaythecontractpriceaccordingtothetimelimitandmethodasstipulatedherein.勘察人承诺按照法律法规和技术标准规定及合同约定提供勘察技术服务。SurveyorpromisestoprovidesurveytechnicalservicesinaccordancewithIawszregulations,technicalstandardsandcontractualagreements
