1、LaborEmploymentContractThislaborandemploymentcontractisformulatedbybothpartiesthroughfriendlynegotiationonavoluntarybasis.ThecontentsoftheContractcomplywithrelevantlocallawsandmanagementregulations.Bothpartiestothecontractpromisetojointlyabidebyallthetermsofthecontract.ChapterIbasicinformationofboth
2、partiestothelaborandemploymentcontract1 .partyACo.,Ltd.,thecompanysprincipal,thecompanysregisteredaddress,thecompanysbusinessaddress.Companymailbox.2 .PartyBacontactnumber,emailaddress.Chapter II startingtimeandtermoflaboremploymentcontract3 .Afterfriendlynegotiation,bothpartiesunanimouslydecidetoad
3、opttheformof.ThecontractstartsonMay1,2022.4 .ThefixedtermofthecontractisfromMay1,2022toMay1,2025.5 .Thefirstthreemonthsofanemployeeenteringthecompanyaretheprobationperiod,thatis,theprobationperiodofthecontractisfromMay1,2022toAugust31,2022Chapter III worklocationandworkcontent6 .PartyAshallarrangePa
4、rtyBtoworkattheworkplaceaccordingtotheactualworkneeds.7 .PartyAmainlyarrangesPartyBtoengageinDrodUCtSaIeS,whichPartyBneedstocompletecarefully,includingassistingthesalesmanagertoformulatethesalesplan,implementthesalesplan,conductregularcustomervisitsandcustomermaintenance,andotherworkcontentsarranged
5、bythesalesmanager.8 .PartyBneedstoconscientiouslycompletethejobresponsibilitiesandabidebytherulesandregulationsofpartyA.Chapter IV workinghours9 .TheworkofPartyBshalladopttheeightstandardhoursworkingsystem.PartyBshallnotworkmorethaneightstandardhoursperdayand40standardhoursperweekonaverage.Atthesame
6、time,ifPartyAneedsitsemployeestoadoptworkingmethodssuchascentralizedwork,rotationwork,centralizedrestandflexibleworkinghours,itneedstotakefullaccountofPartyB,sphysicalcondition,negotiatewithPartyBandobtainPartyB,sownconsent.PartyAshalInottakeanythreats,intimidation,compulsoryrequirementsandothermean
7、storequirePartyBtoworkforciblyortheworkinghoursexceedthelegalworkinghours.10 .EvenwiththeconsentofPartyB,partyALtd.shallnotallowPartyBtoworkmorethanonehouradayormorethanfourhoursaweek.11 .PartyAmustrespectandguaranteePartyBsrighttorestandvacation.PartyBshallfullyenjoytheholidaysandholidaysstipulated
8、bylaw,aswellastherightsoffamilyvisitleave,marriageleave,funeralleave,paidannualleave,maternityleaveandotherleaveChapter V employeecompensation12 .PartyAshalldeterminethesalarylevelofPartyBaccordingtotheeconomicefficiencyandproductionandoperationcharacteristicsofthecompanyandtheprovisionsoflocallaws.
9、ThesalarylevelgivenbyPartyAtoPartyBshallcomplywithPartyB,slaborskilllevel,laborintensity,laborconditionsandlaborcontribution.PartyAmustadoptthemethodofequalpayforequalworktoPartyB,andshallnotadoptanyformofdiscriminationorsalaryreductiontoPartyB.13 .PartyAshallprovidePartyBwithabasicsalaryof100eurosp
10、erdayor2200eurospermonth.14 .ThebasicsalaryofPartyBduringtheinternshipperiodis90eurosperdayor1980eurospermonth.15 .PartyAshallpayPartyBssalaryinfullbymeansofcurrencyorbanktransferbeforethe5thdayofeachmonth.Incaseoffestivals,holidaysorrestdays,PartyAshalladvancethepaymentdatetothenearestworkingday.16
11、 .AfterobtainingtheconsentofPartyB,PartyAshallcompensatePartyBforhislaborbeyondtheworkinghoursspecifiedbylaw.16.1 fPartyAdefaultsonPartyBslaborremunerationorcanpayPartyBinfull,PartyBmaysuePartyAaccordingtothelaborcontractandlaws.Chapter VI employeewelfare18 .PartyAshallgiveperformancebonustoPartyBac
12、cordingtothecompanysregulationsandtheactualworksituationofPartyB.19 .PartyAshallgivePartyBaperformancecommissionaccordingtothecompanysregulationsandPartyB,sactualwork.20 .TheperformancebonusandperformancecommissionofPartyBduringtheinternshipshallbeconsistentwiththeformalwork.21 .Bothpartiestothecont
13、ractshallpaythesocialinsuranceexpensesofemployeesinaccordancewiththeprovisionsoflocallaws,andtheexpensesbornebyPartyBshallbewithheldandpaidbyPartyA.22 .Duringtheperformanceofthelaborandemploymentcontract,ifPartyBneedsrestandvacation,suffersfromoccupationaldiseaseorinjuryordeathduetowork,orinjuryorde
14、athduetononworkreasons,PartyAneedstocompensateorcompensatePartyBinaccordancewiththeprovisionsoflocallawsandregulations.23 .PartyAshallcompensatePartyBaccordingtolocallawsandregulationsincaseofmedicaltreatment,pregnancy,production,lactation,etc.duringtheperformanceofthelaboremploymentcontract.24 .Par
15、tyBcanenjoynomorethan10daysofpaidleaveeveryyear.Thecompanywillholdpublicexpenseperformanceeveryyear,andPartyBcanparticipatevoluntarily.ChapterVIIlaborprotection,laborenvironmentandprotectionofoccupationalhazardstoemployees25 .PartyAneedstoestablishperfectworkflowandoperationspecifications,andprovide
16、asafeandhygienicworkingenvironment.26 .PartyAneedstoestablishaprotectionsystemagainstoccupationaldiseasesandoccupationalhazardsandtrainPartyB.PartyBshallstrictlyabidebytheseworksystemsandprocessesintheprocessofwork.27 .PartyAneedstoprovidePartyBwithregularhealthexaminationtoensurePartyBshealth28 .If
17、PartyAviolatesthelawandforcesPartyBtoworkatrisk,PartyBhastherighttorefuse.PartyBmayaccusePartyAofactsendangeringitsownhealthandlifesafety.ChapterVIIIdisciplineandevaluationprocedures29 .PartyAwillassessPartyBsworkaccordingtotheassessmentstandardsystemformulatedbythehumanresourcesdepartmentforPartyB,
18、spost,andcalculatePartyBsperformancesalaryandbusinesscommissionaccordingtothecompanyssalarysystem.30 .PartyBshallabidebyallrulesandregulationsofPartyA,includingworkflowsystem,operationspecificationsystem,administrativesystem,attendancesystem,laborsafetysystemandothersystems.31 IJfPartyBviolatesParty
19、A,smanagementsystem,PartyAhastherighttotakepenaltymeasuressuchasdeductingperformancesalaryanddemotionagainstPartyB.WhenPartyBsbehaviorendangersthecompanyspropertyandlifesafety,PartyAhastherighttocallthepoliceandclaimforthelossescausedbyPartyBChapterIXemployeePolicyManual32 .PartyBshallabidebythecomp
20、anysattendancesystem.Thecompany,sattendancetimeisfrom9:00a.m.to12:00a.m.andfrom1:00p.m.to6:00p.m.onworkingdays.IfPartyBlacksattendance,halfadayssalarywillbededucted.33 .IfPartyBneedsleave,itshallsubmitanapplicationtothesuperiormanagementandhumanresourcesdepartment3daysinadvance.Afterobtainingtheappr
21、oval,itcantakeleave,andworkhandovershallbedonebeforeleave.34 .IfPartyBisabsentfromworkforonedaywithoutreason,thesalaryofthatdaywillbededucted,andifPartyBisabsentfromworkforthreedayswithoutreason,thesalaryofoneweekwillbededucted.IfPartyBisabsentfromworkformorethansevendayswithoutreason,PartyAhastheri
22、ghttoterminatethelaborcontract.ChapterXperformanceandmodicationoflaborandemploymentcontracts35 .PartyA,schangeofcompanyname,personincharge,investor,divisionandmergerwillnotaffecttheperformanceofthecontract.36 .PartyAandPartyBcanchangethecontentsofthislaborandemploymentcontractthroughnegotiation,andt
23、hechangedcontentsshallbedeterminedintheformofanewlaborandemploymentcontract37 .IfPartyAwantstochangePartyBsworkresponsibilities,itcannegotiatewithPartyBamicablyandsignachangecontractorsupplementarycontractafterconsensus.ChapterXIdissolutionandterminationoflaborandemploymentcontracts38.Thecontractsha
24、llbeautomaticallyterminatedaftertheendofthelabortermofthelaboremploymentcontract.39.Duringthedurationofthislaborcontract,PartyAandPartyBmayterminatethislaborcontractthroughfriendlynegotiation.40.IfPartyAneedstoterminatethelaborcontractduetobankruptcyanddisappearanceofthemainbody,PartyAshallgiveParty
25、Bseverancepayandothereconomiccompensationinaccordancewithlocallaws.41.IfPartyAorPartyBillegallycancelsorterminatesthelaborcontract,bothpartiesmayclaimcompensationfromtheotherpartyinaccordancewithlocallaws.ChapterXIIentireagreement42.Theabovecontentsincludethecompletecontentsofthislaborandemploymentcontract.
