4、设计工作范围和内容6.1 Designworkscopeandcontent6.1.1 分包商应按照本分包合同专用合同条件约定的设计工作范围和内容进行勘察和/或设计工作，在分包合同约定的期限内履行勘察和/或设计义务。6.1.2 TheSubcontractorshallcarryoutthesurveyand/ordesignworksinaccordancewiththescopeandcontentofthedesignworkasspecifiedintheSpecialConditionsofContractforthisSubcontractandperformthesurveyan
5、d/ordesignobligationswithintheperiodagreedintheSubcontract.6.1.3 如勘察和/或设计工作范围和内容发生变化,承包商应及时通知分包商，以便分包商按照变化后的设计工作范围和内容进行设计工作。6.1.4 TheContractorshalldulynotifytheSubcontractorofanyvariationinthescopeandcontentoftheinvestigationand/ordesignworkfortheSubcontractortocarryoutthedesignworkinaccordancewith
6、thechangedscopeandcontentofthedesignwork.6.1.5 如勘察和/或设计工作范围和内容发生变化,承包商有权调整本分包合同的合同价格，承包商和分包商应商定新的分包合同价格。6.1.6 Foranyvariationinthescopeandcontentofthesurveyand/ordesignwork,theContractorshallbeentitledtoadjustthecontractpricehereofandthenewSubcontractpriceshallbeagreedbytheContractorandSubcontractor
7、.6.2 施工图设计6.3 Designofconstructiondrawing6.3.1 如承包商要求分包商进行施工图设计，应在分包合同中予以明示约定。6.3.2 WheretheContractorrequirestheSubcontractortomaketheconstructiondrawings,whichshallbeexpresslysetforthinthesubcontract.7 设计依据7Designbasis7.1 设计依据文件7.1Documentfordesignbasis7.1.1 承包商应在本分包合同专用合同条件中明示约定分包商从事勘察和/或设计所依据的文件
8、，这些文件包括但不限于：7.1.2 ThedocumentsuponwhichtheSubcontractorwillrelytocarryoutthesurveyand/ordesignshallbeexpresslysetforthbytheContractorintheSpecialConditionsofContractforthisSubcontract.(a)分包合同协议书；(a) Subcontractagreement;(b)主合同的技术协议(如有)；(b) Technicalagreementofthemastercontract(ifany);(c)本分包合同约定工程的主要
9、技术标准、设计规范和规程。(c) Themaintechnicalstandards,designspecificationsandproceduresfortheworkhereunder.7.2 设计标准7.2DesignStandard7.2.1 分包商应按照本分包合同专用合同条件约定的设计标准进行勘察和/或设计工作。7.2.2 TheSubcontractorshallcarryoutthesurveyand/ordesignworksinaccordancewiththedesignstandardssetforthintheSpecialConditionsofContractfo
10、rthisSubcontract.7.2.3 如业主和/或工程师提出新的或补充的或增加的设计标准和规范,要求承包商按照新的或补充的或增加的设计标准和规范进行设计，则分包商应在收到承包商书面通知后，遵照指示，按照新的或补充的或增加的设计标准和规范进行设计。7.2.4 ProvidedthattheOwnerand/ortheEngineerproposeneworadditionalorincreaseddesignstandardsandspecificationsandrequiretheContractortomakethedesignsubjecttotheneworadditional
11、orincreasedthestandardsandspecificationsofdesign,theSubcontractorshallzuponreceiptofwrittennoticefromtheContractor,complywiththeinstructionsanddesigninaccordancewiththeneworadditionalorincreaseddesignstandardsandspecifications.7.2.5 除非专用合同条件另有约定,如按照新的或补充的或增加的设计标准和规范进行设计导致设计费用的增加时，承包商和分包商应商定增加的设计费用。7
12、.2.6 UnlessotherwisespecifiedintheSpecialConditionsofContractwherethedesigninaccordancewithneworadditionalorincreaseddesignstandardsandspecificationsachievementsinanincreaseindesigncosts,theContractorandSubcontractorshallagreeontheincreaseddesigncosts.8承包商设计审查和业主/工程师的设计审批8Contractorsdesignreviewando
13、wnerengineer,sapprovalfordesign8.1 承包商组织设计审查会议8.1 ReviewmeetingsheldbytheContracto8.1.1 承包商可自行组织设计审查会议，对分包商的设计成果,无论是中间设计成果还是最终设计成果进行审查，承包商自行组织的设计审查会议所发生的费用由承包商承担。8.1.2 TheContractormayorganizeonitsoptionthedesignreviewmeetingstoreviewsubcontractorsdesignachievements,whetherintermediateorfinalzandthe
14、costsincurredbytheContractorinorganizingitsowndesignreviewmeetingsshallbebornebytheContractor.8.1.3 分包商应与承包商商定需要采纳的设计修改意见和建议。分包商应按承包商和分包商商定的设计修改意见和建议对设计进行修改或更正。8.1.4 TheSubcontractorshallagreewiththeContractoronthedesignmodificationsandrecommendationstobeadoptedandshallmakemodificationsorcorrections
15、tothedesigninaccordancewiththedesignmodificationsandrecommendationsagreedbetweenthethem.8.1.5 分包商按照商定的修改意见和建议对设计的修改或更正,并不能免除分包商在本分包合同项下应承担的设计义务。8.1.6 ThemodificationsorcorrectionstothedesignmadebytheSubcontractorinaccordancewiththeagreedmodificationsandrecommendationsshallnotrelieveitsobligationsinr
16、espectofthedesignhereunder.8.2 业主/工程师的设计审批8.2DesignapprovalbytheOwner/Engineer8.2.1 分包商负有义务通过业主/工程师组织的针对设计成果,包括中间设计成果或最终设计成果的各项审查。8.2.2 TheSubcontractorshall,throughtheOwnerEngineerzbeobligedtoorganizeallreviewsofthedesignachievements,includingintermediateorfinaldesignachievements.8.2.3 在设计阶段的全过程中，分
17、包商在征得承包商同意的情况下可负责代表承包商向业主代表进行解释和答疑。分包商对其设计成果的解释和答疑方式可包括面对面解释和答疑，通过书面方式进行解释和答疑,通过解释设计采用的应用程序进行解释和答疑等。8.2.4 TheSubcontractormay,throughoutthedesignphaseandwiththeContractorsconsent,beresponsibleforprovidingexplanationsandansweringquestionstotheOwnersRepresentativeonbehalfoftheContractor.Subcontractors
18、explanationsandanswerstotheirdesigndeliverablesmayincludedoingsobyface-to-face,bywrittenmeansandbyexplainingtheapplicationusedforthedesign,etc.8.2.5 分包商负有义务按业主/工程师审查意见进行修改，并获得业主/工程师的审查确认。分包商应业主/工程师的书面要求对设计成果，包括中间设计成果和最终设计成果进行的修改，视为设计工作的必要组成部分，包含在本合同总价中,不另行计费。8.2.6 TheSubcontractorisobligedtomakethem
19、odificationunderthereviewopinionoftheEmployer/Engineerandtobeconfirmedbythem.Themodificationstothedesignachievements,includingintermediateandfinaldesignachievements,madebytheSubcontractoratthewrittenrequestoftheOwner/Engineershallbedeemedasanecessarypartofthedesignworkandthecostthereofhasbeeninclude
20、dinthelumpsumpriceofthisContractandshallnotbechargedseparately.8.2.7 如果业主/工程师认为或确认任何设计文件有缺陷或不符合本分包合同约定时，承包商应通知分包商，同时说明理由。分包商负有义务在业主/工程师要求的期限内完成对设计成果的修改工作，并取得业主/工程师的批准。8.2.8 ProvidedthattheOwner/EngineerdeemsorconfirmsanyofthedesigndocumentsaredefectiveorfailtoconformtothisSubcontracttheContractorsha
21、llnotifytheSubcontractorwiththereasonstherefor.TheSubcontractorshall,withintheperiodrequiredbytheOwner/Engineer,beobligedtocompletetherevisionofthedesignachievementsandobtaintheapprovaloftheOwner/Engineer.8.2.9 业主/工程师对设计文件、图纸及资料的确认或批准并不解除分包商对设计文件、图纸及资料所负有的设计责任和义务。8.2.10 Theconfirmationorapprovalbyth
22、eOwner/Engineeronthedesigndocuments,drawingsandInformationdoesnotrelievetheSubcontractorofitsdesignresponsibilitiesandobligationsinrespectofthedesigndocuments,drawingsandinformation.9设计错误等9Designerrors,etc9.1 设计错误、遗漏、模糊、矛盾及缺陷9.2 Errors,omissions,ambiguity,contradictionsanddefectsindesign9.2.1 分包商应自付
23、费用,及时修正设计文件中所有的错误、遗漏、模糊、矛盾及缺陷。9.1.1 TheSubcontractorshall,atitsownexpense,promptlyrectifyallerrors,omissions,ambiguities,contradictionsanddefectsinthedesigndocuments.9.1.2 如果分包商要求对已批准的设计文件进行修改，应通知承包商并提出书面修改理由，并向承包商提交修改后的文件供审查批准。9.1.3 ProvidedthattheSubcontractorrequireschangestotheapproveddesigndocu
24、ments,theContractorshallbenotified,providedwithWrittenjustificationforthechangesandthereviseddocumentsforreviewandapproval.10设计成果的交付和最终认可10Deliveryandfinalapprovalofthedesignachievements10.1 设计成果交付方式10.1 Deliverymannerofthedesignachievements10.1.1 ,分包商应向承包商提交的设计成果的数量、质量和内容应满足分包合同的要求，包括纸质设计成果文件和电子版设计
25、成果文件。10.1.2 .Thequantity,qualityandcontentofthedesignachievementstobesubmittedbytheSubcontractortotheContractorshallmeettherequirementsoftheSubcontractincludingthesameofpaperandelectronicversion.10.1.3 分包商在提供纸质文件的同时应提供用于设计审批所需的电子文件，提供的电子文件应满足以下条件：10.1.4 TheSubcontractorshallprovideelectronicdocument
26、srequiredfordesignapprovalalongwiththepaperversionandtheelectronicdocumentsprovidedshallmeetthefollowingconditions.(a)满足承包商进行打印和计算机屏幕显示的要求；(a) MeetingtheContractorsrequirementsforprintingandcomputerscreendisplay.(b)图纸电子文件应采用与图纸文件编号一一对应的文件命名格式，并具有易读性，设备材料清册用Excel格式编制；(b) Electronicdocumentationofdraw
27、ingsshouldbeinafilenamingformatcorrespondingtothedrawingfilenumberandbeeasytoread,withtheinventoryofequipmentandmaterialsbeingpreparedinExcelformat.(c)所有资料、图纸的企业标识按专用合同条件约定执行。(c) Theenterpriseidentificationofallmaterialsanddrawingsshallbemadepursuanttothespecialcontractconditions.10.2 设计成果文件签收10.2 S
28、igningfordocumentsofthedesignachievement10.2.1 除专用合同条件另有约定外，承包商可在中国和/或现场签收分包商编制的设计文件和设计图纸。10.2.2 UnlessotherwisespecifiedintheSpecialConditionsofContracttheContractormaysignforthedesigndocumentsanddesigndrawingswhichpreparedbytheSubcontractorinChinaand/oronsite.10.2.3 分包商在递交设计成果文件时，应以书面方式递交。承包商在收到分包
29、商递交的设计成果文件时应予签收。10.2.4 TheSubcontractorshallsubmitthedesignoutputsinwritingwhensubmittingthem.TheContractorshallsignforthedesigndeliverablesuponreceiptbytheSubcontractor.10.3 设计成果文件的版本10.3 Versionsofthedesignachievementdocument10.3.1 分包商应在设计成果文件上注明具体的版次，并注明正式递交的版次和施工图纸的版次。10.3.2 TheSubcontractorshal
30、lindicatethespecificeditionorderonthedesignachievementsdocument,inadditiontoindicatetheeditionorderoftheofficialsubmissionandtheeditionoftheworkingdrawings.10.3.3 分包商应及时向承包商发出书面通知，说明设计成果文件版次的变化。10.3.4 TheSubcontractorshallgivewrittennoticewithoutdelaytotheContractorofchangestotheversionofthedesignou
31、tputdocument.10.4 设计成果文件的最终认可10.5 Finalapprovalofthedesignachievementdocuments在不损害本分包合同其他条款约定的情况下，分包商设计成果文件的最终认可以取得业主和/或工程师的书面批准为准。WithoutprejudicetotheotherprovisionsofthisSubcontract,thefinalapprovaloftheSubcontractorsdesignachievementsshallbesubjecttothewrittenapprovaloftheOwnerand/ortheEngineer.
